Can't 370 be removed by State Assembly (with the Governor acting as a substitute for the State Assembly if/when needed)?

Can Constitution be made without referendum? Can unelected government be asked to make Constitution or laws? In 1947, congress was not elected. Congress was elected for entire India including Pakistan. Since pakistan separated, congress had no mandate over divided India. Congress was only adjustment to keep India together. Since congress failed, it was time for re-election to make Constitution for Hindu India. So, how was Nehru PM or congress legitimate to write Constitution? Constitution itself is invalid. What is the point of debating invalid things? We will do what people want and nothing can come in the way. No Constitution or courts. People's will and dharma is supreme. 370 requires Constitutional amendment, and will depend on whether Amit Shah is able to muster a 2/3rd "present and voting" majority in the Rajya Sabha. Right now Shah enjoys godmode in RS. All he needs to do is make sure 40 more opposition MPs abstain from voting.

Lok Sabha is cakewalk since NDA already has 2/3 majority.

Point to note is there is no Constituent assembly anymore- both in India and particularly the State of Kashmir.
Despite being put under 'Temp provisions' i.e Part XXI of our Constitution, the fuckers in Kashmir's Constituent Assembly didn't remove or edit the Art 370 before dissolving the CA.
And we were left in a fucked up position.
Art 370 is possibly the most screwed up provision ever. Ball is in Governor's court.
