SC cannot stay a Presidential order. It lacks that power.

35A's deletion will happen as follows.

• Cabinet will officially ask President to delete 35A
• President will sign a Presidential order deleting 35A from the Constitution, same exact way it was added in the first place
• Done. No Parliament approval required, no SC judicial review, nothing. SC can't do jack about it

And just so we're clear, this is a Presidential order, and not an Ordinance (which is temporary and requires legislation in the future).

Once President signs the order to delete 35A, Parliament needn't legislate on it for the next quadrillion millennia.

And what about Art. 370, is it the same procedure?

370 requires Constitutional amendment, and will depend on whether Amit Shah is able to muster a 2/3rd "present and voting" majority in the Rajya Sabha. Right now Shah enjoys godmode in RS. All he needs to do is make sure 40 more opposition MPs abstain from voting.

Lok Sabha is cakewalk since NDA already has 2/3 majority.

Governor administers the state on behalf of the union government. You have to remember assembly is legislature and not the executive and much the same way executive is not legislature. Executive office cannot enact laws or abolish old laws.

Looking at the build up in the last few days one can assume that govt wants to either trifurcate the state or abolish Article 370. They have the numbers in the parliament to push through any amendment, but will it pass muster in the Supreme Court ?

Can't 370 be removed by State Assembly (with the Governor acting as a substitute for the State Assembly if/when needed)?
