Stealing Effection of Brother Officers Wife

This phrase is in news nowadays for all the wrong reasons and the Defence Forces haters are having a field day on the subject. Librandus of various shades and hay are going ga ga over it since the Armed Forces have gone to the Supreme Court to allow them to reatin adultry as an offence which was struck down by the SC in the case of Joseph Shine vs Union of India (2018), as Section 497 of the Indian Penal Code pertaining to adultery as unconstitutional, being violative of Articles 14, 15 and 21 of the constitution. It is claimed the Indian armed forces want to be exempted from this.

Army Act 1950 and corresponding Acts in the Indian Navy and Airforce have provisions to try any personnel under these Acts who is guitly of committing any Civil Offence not specifically mentions under Services Acts but are dealt under other Criminal Codes of the land such as IPC etc.

All offences of Sexual nature that are listed in IPC such as rape, outraging the modesty of a woman, etc are triable under respective Services acts as read with Criminal codes of the land. Civil offences are tried if both the accused and the effected party are under the Armed Forces Act. If one of them is a civilian then it is civil jurisdiction and the case can only be dealt with under Army act with the consent of the victim and if handed over to Army by a civil magistrate.

In this backdrop, the cases of adultery would involve three individuals " the Pati Patni and Wo". Here Patni /wife is not triable but the "wow" the third party is triable. Only a man can be triable for Adultery not a woman. In these frames of references if this "Wo" happens to be subject to Army Act then only Army can proceed to try the individual of "unbecoming conduct" or "An Act prejudicial to Good Order and Military Discipline" in that he stealing the affection of bother Officers wife" ...

After the SC stuck down Adultery from IPC - the Armed Forces have approached the court to ratin the ability to treat Adultery as punishable offence.

In that context, a very nasty and hit piece has appeared in the Wire penned by an Ex IPS officer NC Asthan (the officers unprofessional views on BSF Taking over defences of borders overtaking the Army were commented upon threadbare by me in the forum under the head BSF. One can see the intellectual and professional worth of the Officer there )

What is very surprising is that instead of dealing with the issue, this Asthana has taken an opportunity to paint Armymen as Sexual delinquents, immoral, perverts and anti-social people in wanting to continue to apply laws of Adultrty in the Armed Forces.. His article has no head and tail discussing the subject but profanities and stupidity. He narrates all offences related to sexual acts except adultery.

If an IPS officer does not know the meaning of "Officer" as defined under Army act to include a man of authority including the lowest amongst the rank a Lance Naik he has no business going to the press with defamatory writing.

In the height of stupidity, the piece appears to be a communist manifesto rather dealing with a Service matters.
What Asthan does best is exposing his bad class and upbringing as an officer by writing such a hit piece

Worst than that it is absolutely stupid for The Wire to have published such filth which reflects very badly on the writer.

God save this country if we have such class of IPS.

Liberals world over have this same khujli. They are themselves amoral but like to paint every conservative as such. This SJW B.S. needs to be put down, at least where the Armed Forces are concerned. The government and Supreme Court must firmly plant their foot down to ensure such riff-raff is not allowed to needlessly try out their SJW mental gymnastics on the Indian Armed Forces.

These morons don't have the same integrity as the Armed Forces and therefore proceed to play dirty by trying to denigrate Armed Forces in the eyes of the public (who have traditionally considered Armed Forces to be one of the three most honurable institutions in this nation). This is a disgusting form of turf battle waged by these IPS, IAS types. One can only hope that the current government takes cognizance of this fact and moves to induce a change in this rotting IAS, IPS babus set up by introducing a cadre review, while at the same time continuing to expand its policy of lateral entry.

But this type of hit piece being published in The Wire is no surprise. Makes me think that this Government needs to create a law where the journalist can be held accountable for blatant lies and the op-ed author can be held accountable for defamation, at least. But then it makes me think maybe its better that these a$$holes are exposing themselves. These anti-national elements will not go away simply by bringing in a law. The poison whose spread is before everyone's eyes to see now, will all go underground once such a law is brought to bear down upon them. Adversity will cause them to use more sophisticated disinformation methods, they will grow stronger, more resilient. So the only viable solution is to allow the masses to understand the concept of critical thinking as well as the pattern recogntion capability to recognize how the narrative is turned against them and how they are made to hate their country. Once these things enter the common consciousness on the citizens of India, no amount of propaganda by anti-Indian elements will be able to harm the social fabric of this nation.

Of course this needs to be made an integral part of the education system to ensure that subsequent generations automatically become immune to these mind games. Another pre-requisite is factual-rebuttal channels and content creators that can flood the social media and popular places like YouTube with factual rebuttal to such hit-pieces and disinformation campaigns within minutes to hours of such disinformation campaigns. That way, the anti-nationals will keep on exposing themselves and the public will also learn to understand their mental gymnastic patterns.

It might not be the right question to ask, but according to Shiv Aroor's article once our troops crossed the LAC, Col Babu was the first casualty after being hit by a heavy rock, which resulted him in falling into the river. So for what action is he getting the MVC.
Is it for the decision he made to cross the LAC after having a small brawl on the LAC?
Shiv Aroor and the other journalists are not privy to debriefing post galwan clash. All they have reported is hear say. We have to go by what Army says and that's the end of the discussion.

This is how the good Colonel's citation goes ⬇. It says the Colonel was involved in hand to hand combat till his last breath.
