2019 is do or die for us Indians especially Hindus trust modi and doval there is a reason why these assholes are begging for not to give information secondly as far as ramzan ceasefire was done even i criticized it saying terrorist will re group but look at this way it may have allowed terrorist to re group but it will gather further good will among local kashmiris and respite for locals too after series of encounters everybody knows here with locals on our side we can win this war more easily and lastly this is crop we reaping thanks to Sonia gandhi's policy they allowed pakistani channels and radicalization for more then 10 years which is kashmiri's are more hostile lets not make the same mistake again

Hundred militants and 43 security personnel were killed in Jammu and Kashmir in the first six months of this year, Union Minister Hansraj Gangaram Ahir said today.

Ahir, the minister of state for home, said 16 civilians were also killed during this period, which saw 256 incidents of violence. He was replying to a written question in Rajya Sabha.

In 2017, 342 incidents of violence were reported in the state, in which 213 terrorists were gunned down. A total of 80 security personnel and 40 civilians were killed last year, Ahir said.

As many as 82 security personnel, 15 civilians and 150 terrorists were killed in the state in 2016, which witnessed 322 cases of terrorist violence, he said.

Indian army targets rebel funeral; 1 killed, 2 injured

A young man was killed and two other people wounded when India's army fired at a funeral of a rebel in disputed Kashmir on Saturday, police and residents said, as seven rebels and an Indian soldier were killed in gunbattles in the region.

Soldiers descended on a village in the suburbs of southern Shopian town as thousands gathered to participate in the funeral of a rebel killed along with four others in a gunbattle with government forces in a neighboring village early Saturday, said top police officer S.P. Vaid.

Vaid said the soldiers were acting on a tip that a group of militants had come to the funeral and came under a barrage of stones thrown by local residents.

Locals said clashes erupted after soldiers fired live ammunition at the funeral procession, killing one person. Two others were wounded.

Bench posts the case for hearing to the week commencing August 26.

Chief Justice of India Dipak Misra, heading a Bench, on Monday orally observed that the Supreme Court will consider whether Article 35A, which gives special status to the State and people of Jammu and Kashmir, is violative of the ‘Basic Structure’ of the Constitution.

‘Basic Structure’ is a collective term coined by a 13-judge Bench in the historic Keshavananda Bharati case to include a catena of fundamental rights, including the right to equality, non-discrimination, liberty, life and dignity, enshrined and preserved in the Constitution.


Centre seeks adjournment of case
The Centre, represented by Attorney General K.K. Venugopal, persisted that the case should be adjourned, as an interlocutor was carrying on dialogues with the State’s stakeholders.

The State of J&K, represented by Additional Solicitor General Tushar Mehta, also sought an adjournment.


However, the Bench comprising Justice A.M. Khanwilkar was missing its third member, Justice D.Y. Chandrachud, is on leave.

Chief Justice Misra explained that since the issue was being heard by a three-judge Bench and one of them is absent, the case should be adjourned.

“The challenge to Article 35A is being heard by a three-judge Bench. The Bench will determine whether the case should be referred to a Constitution Bench. Today, as you see, the other judge is absent and so we have to hear the case another day,” he addressed the petitioner lawyers who objected to an adjournment.

One of them even complained that J&K was virtually shut down before every Supreme Court hearing. To this, Chief Justice Misra said the challenge is to a provision, Article 35A, which has been implemented for over 60 years and the petitions were filed only in 2014. The case had progressed to the extent of the question of reference by a three-judge Bench to a Constitution Bench.

The Bench posted the case for hearing to the week commencing August 26.


Article 35A gives the J&K State Legislature a carte blanche to decide the ‘permanent residents’ of the State and grant them special rights and privileges in State public sector jobs, acquisition of property within the State, scholarships and other public aid and welfare programmes. The provision mandates that no act of the State legislature coming under the ambit of Article 35A can be challenged for violating the Indian Constitution or any other law of the land.

NGO's plea
One of the main writ petitions was filed by NGO We the Citizens, which challenges the validity of both Article 35A and Article 370. It argues that four representatives from Kashmir were part of the Constituent Assembly involved in the drafting of the Constitution and the State of J&K was never accorded any special status in the Constitution.

Article 370 was only a ‘temporary provision’ to help bring normality to J&K and strengthen democracy in that State. The Constitution makers did not intend Article 370 to be a tool to bring permanent amendments, like Article 35A, in the Constitution.

The petition said Article 35 A was against the “very spirit of oneness of India” as it created a “class within a class of Indian citizens.” Restricting citizens from other States from getting employment or buying property within Jammu and Kashmir was a violation of fundamental rights under Articles 14, 19 and 21 of the Constitution.

It is naive to see similarity between India vs Pakistan and Israel vs Palestine. Palestine does not have a large military. Palestine does not have nuclear weapons. Palestine did not receive military aid from US and China. On top of all that, Israel receives $30B plus weapons in aid from the US per year. So let us stop this non-sense of comparing India's situation with Israel's situation.
