Gandhinagar (ABC Live): 1971 War Hero General Jagjit Singh Arora even after his death Still Fights for His 54 Soldiers lodged in Pakistani jails in Indian courts.

Latest, Gujarat High Court has imposed a fine of Rs 10,000, for the second time, on Ministry of Defence for not replying to its notice in connection with a petition filed by General Jagjit Singh Arora seeking release of 1971 Prisoner of Wars (POW).

A division bench of Justices Bhagwati Prasad and B N Mehta had on 11th January fined the Ministry of Defence Rs 10,000 for not filing appropriate reply to the same petition for over 10 years.

The petition has been filed in 1999 by General Jagjit Singh Arora, who had sought direction from the court asking the Centre for release of the 54 POW of 1971 war languishing in Pakistan prison.

The petitioner also demanded adequate compensation for them and prayed that the POWs be treated as soldiers on duty and be given adequate compensation.

When the matter came up for hearing Tuesday, the counsel, representing the Ministry, moved an application to waive fine imposed earlier and sought one month's time for filing reply to Arora's petition.

The court, granting one month's time to file reply, said, "We adjourn the matter for one month with a stipulation that further cost (fine) of Rs 10,000 is imposed on the respondent-Union of India."

The matter will come up for hearing on 22nd February.

It further said that fine amount, that is, Rs 20,000 be deposited in some Relief Fund operated by the Indian Army for the benefit of its personnel.

With regard to waiver of fine, the court said that they were "not inclined" to waive the fine. In the petition, Arora, besides seeking compensation for families of POWs, had demanded that all the 54 be considered on duty till date making them eligible for full salary.

He also demanded that the Union government should take the issue with the United Nations.

Out of the 54 POWs in Pakistan jail, two are from Gujarat Captain Kalyan Rathore from Sabarkantha and pilot N Shanker from Vadodara.

Lt Gen Jagjit Singh Aurora, the GOC in C , Eastern Army Command was the army officer, who signed the surrender treaty with Pakistan's General A A Niazi on December 16, 1971.
