New Delhi: In a sign of more trouble for the UPA, the chorus of voices against the National Counter-Terrorism Center (NCTC) has grown withing the ruling coalition. After numerous Chief Ministers from NDA-ruled states, the UPA's own allies have spoken out against the anti-terror body. Sources say that the National Conference and the DMK are unlikely to support the NCTC. Earlier, West Bengal Chief Minister Mamata had opposed the move claiming it usurped the powers of states.

DEHRA DUN: Accusing the Centre of "infringing" on federal rights of the states, Uttarakhand Chief Minister B C Khanduri today opposed the proposed National Counter Terrorism Centre (NCTC).

"Be it NCTC or any other issue, it is very sad that some of the important decisions are being taken by the Centre unilaterally. The states must be taken into confidence on all important decisions," he said.

Expressing his anguish over Centre for "not sharing" vital information related to NCTC, Khanduri alleged the states were "kept in dark" over the new anti-terror body, scheduled to be operational from March 1

first tell me why was nctc created.there was allready an existing agency created by nda post kargil whose job was to co-ordinate as well as pass information to agency concern but was under pmo.it din`t perform well and was also in news for some kind scandal .if think nctc is under home minstry.so there is some type inter-ministerial war went and ultimate winner was home minstey but with a reduce mandate.

and second every other party except congrees would woory as there is strong chances that it would be misused in future by party in power so all from dmk to ncp to nc are opposing . they just waited from some one to take start what better then cm of orissa

I expect a complete policy paralysis in the future as any policies introduced by NDA will be opposed by congress. Just like how BJP turned its back on fdi congress will do the exact thing.

Exactly, this is one of the rare good moves taken by the UPA government, it should be lauded. People often say that our Indian system is similar to US federal system, but they forget to see that even US has many federal agencies working for it such as FBI, NSA etc and their jurisdiction is much larger than their indian counterparts such CBI/CID, IB etc.....In US, no one says that its an infringement on federalism......

People often say that our Indian system is similar to US federal system, but they forget to see that even US has many federal agencies working for it such as FBI, NSA etc and their jurisdiction is much larger than their indian counterparts such CBI/CID, IB etc.....In US, no one says that its an infringement on federalism......

Congress Recreating the KGB in India

On the face of it, there may appear to be nothing wrong with the UPA Government's decision to make the National Counter-Terrorism Centre operative from March 1. The NCTC has been established under the provisions of the Unlawful Activities (Prevention) Act, 1967, and, according to the Government, will help in a more efficient coordination between the Union and the State Governments to tackle the growing menace of terrorism. But that is just the surface reality.

Deep down, the decision is a dangerous attempt to destroy the autonomy of the States and an assault on the federal structure of the Constitution. This is the reason why a number of Chief Ministers — including a Congress ally, Ms Mamata Banerjee — have strongly protested against it. If the Union Government indeed had the noble intention of enhancing cooperation with the States in fighting terrorism through the NCTC, it should have consulted them and sought their opinion on how best to achieve that objective.

Instead, it has chosen to foist upon them an organisation that threatens to curtail their rights and autonomy. Look at how the NCTC is poised to undermine the federal nature of our democratic system: It will have the power to arrest people and search premises across the country without involving the authorities of the State concerned. Considering that law and order is a State subject, the NCTC would be violating this key provision of the Constitution. That the Government should plan this assault is bad enough; what is worse is that it has given the NCTC powers that till now were restricted to the police, the Central Bureau of Investigation and the National Investigation Agency and which could be exercised only with the concurrence of State Governments.

That concurrence will no longer be required, which is a blow to democracy and citizens' rights. The NCTC, which will report to the Director of the Intelligence Bureau, is in many ways a replication of the KGB. What this says about the Congress does not require elaboration.

This is not the first instance of the Union Government, under the Congress's tutelage, trying to brazenly usurp the rights of the States. In the recent past there have been at least two shameful attempts at grabbing what does not belong to New Delhi — both have been met with stiff resistance and rebuke from several Chief Ministers. The first was the sly move to push through the perverse Prevention of Communal and Targetted Violence (Access to Justice and Reparations) Bill which had sought to undermine the authority and autonomy of the States.

Equally dangerously, the proposed Bill was premised on the presumption that the perpetrators of communal violence are invariably Hindus and the victims members of minority communities. The nation-wide outrage over the proposed law and the refusal by the Congress's allies to accord legitimacy to this perversity by endorsing it forced the Government to shelve the Bill. But that failure has not led to the Congress abandoning its smash-and-grab policy.

As much was evident when it sought to impose a Centrally-drafted Lok Ayukta law on the States, riling both allies and opponents. Similarly, the proposed Right to Food Bill, aimed at glorifying the Nehru-Gandhi clan in the disguise of fighting hunger, reflects the Congress's disregard for what State Governments think of such wasteful welfare schemes. The NCTC is the latest ploy and it must be resisted by all State Governments, irrespective of their partisan views and political loyalties. Federalism cannot be sacrificed to keep the bosses of the Congress in good humour.

Having a National Counter-Terrorism Center can be good thing, but legal and constitutional safeguards must be put in place that would prevent the NCTC to be used like the gestapo...
Ideally, the NCTC should be used a unified central intelligence grid where intelligence inputs from different intelligence agencies come in and they analyze it and pass on the relevant intelligence to the respective authorities in each state

I could'nt agree more. But we need to terrorism is not a "law and order" problem.

Apart from that the NCTC or any similar agency is hogwash. Why are we creating so many agencies? None of them co-operate with each other anyway.

New Delhi, Feb 29 : Union Home Minister P. Chidambaram on Wednesday said that the proposed National Counter Terrorism Centre (NCTC) should have the bare minimum powers, including the power to arrest, recommended by the committees to have certain operational capability while conducting a counter- terrorism operation.

"The NCTC must have a certain operational capability as recommended by the committees, which have looked into it. You need to have an operational capability while conducting a counter-terrorism operation; the section is attracted only when a counter-terrorism operation is going on," said Chidambaram, when asked about why the powers to arrest is important in case of NCTC.

" When you know that a terrorist crime has been committed or there is a design to commit a terrorist crime, at that stage if the NCTC must have a certain operational capability the bare minimum power is the power to arrest," he added.

Chidambaram further said: "And the next section says as soon as you arrest without unnecessary delay the person arrested must be handed over to the nearest police station. The next section says the Station House Officer of the police station will then take up the case under the Criminal Procedure Code. This is a bare minimum power if you agree the NCTC must have a certain operational capability while conducting a counter terrorism operation."

When asked whether the NCTC's power of right to arrest will open to judicial scrutiny, Chidambaram said: "Only the operations of the NCTC will be given the power under 43(A). And immediately after arrest, the persons has to be handed over to the nearest police station then the case will be registered in the nearest police station, You don't anticipate any legal difficulty. This has been examined carefully by the Intelligence Bureau."

The Ministry of Home Affairs (MHA) has written to the state chief secretaries inviting them and Home Commissioners of all states along with the DGPs and heads of anti-terror organisations for a meeting on March 9 to have elaborate discussions on the states' concerns over the NCTC. The meeting will be chaired by the Union Home Secretary.

Chidambaram had earlier written to 10 chief ministers, saying countering terrorism is a shared responsibility, and the Centre will continue to work with states to fight the menace.

Several state governments, including the Trinamool Congress (TMC), which is the second largest in the Congress-led United Progressive Alliance Government (19 Members of Parliament), joined the chorus against what is being seen as an attempt to infringe upon state's rights.

The main task of the NCTC would be to ensure that the wide variety of security organizations in the country work in tandem, at least on issues related to terrorism.

It will also have the power to seek information, including documents, reports, transcripts, and cyber information from any agency, including from the Central Bureau of Investigation (CBI), National Investigation Agency, National Technical Research Organization, Directorate of Revenue Intelligence and all seven central armed police forces including the National Security Guard (NSG).

The body, which will function under the Intelligence Bureau, has been given its own operational wing with powers to arrest and conduct searches under Section 43A of the Unlawful Activities Prevention Act. (ANI)

What would be the problems if the NCTC works in conjunction with the State Police?

To give an example, it was stated by the Rajasthan Police that the Centre had informed them that Rushdie was a target from Bombay based terrorists, based on information received from the Bombay Police. The Bombay Police denied that there were any such group or any such plot and that they never informed the Centre about such a plot or of terrorists!

It will become the Governors who, though technically independent, are basically stooges of the Union Govt and the Party in power!

And anyway Chidambaram is a power hungry chap who is not a team player. Therefore, his wanting to push such a scheme is understandable.

The central agencies suspect the State Police will jump the gun to gain laurels or leak out the info to help the suspects.

Can central agencies work with JKP?...only at a very rudimentary level.
Can central agencies work with Bengal Police?....no CPI/ Mamta will not think twice before selling out to the Naxalites for their own parochial gain.

RAW, IB and NSA have enough powers to function nationally. So there is no need for another agency.

The independence of the states can be thrown out of the window when it comes to national security.

The security agencies can kill naxalites and terrorists but MLAs will attend their funerals.

You are right.

The Trust factor is Zero between the Centre and the State.

The political chicanery of the recent times and the way the PM has been devalued by his own party does not elicit trust in any way.

The manner in which politics has headed is indeed a sorry state of affairs.

If there was any faith and trust in the Centre's honesty of purpose, then there would be no scams and the attempt to cover it up and then getting mud on the face when exposed. And agitations like that of Anna would not even get one chap to support. Even the nation, it appears, has no faith in the Centre.

I am all for a strong Central Govt since that is the only way to progress, but then when one find arrogant idiots who are all jockeying to be prima donnas and making their Leader, the PM, a stool pigeon, one can only get disheartened and lose faith.

However, the Police can operate efficiently and there is no doubt about that. The Police Reforms should come into place so that they are beyond political manipulation.

The politicians have already infiltrated the Armed Forces and making it like a pliant police force.

What upsets me more is the manner in which they have politicised the Indian Army and the ex Chiefs like JJ and the next clot are the fountainhead of the rot!

Amendments have been defeated.

TMC. abstained probably after a deal was cut to drop Dinesh Trivedi and DMK too after Center hinted at its inclination to vote against SL and SP voted with the govt and we know get are looking to get some ministries and join the UPA.
