If retrial is there, Pakistan won't subject him to death penalty again amid tensions for sure, I think.
Government saved his life at least. Now, bringing him back is challenge.

Just to prove that their military courts are legit and the teach India that going to ICJ was futile, Paki will concoct a way to grant him a death sentence again.

But yes, the outcome of the current military tension and the eventual realignment (if any) will have some bearing on what will happen to Kulbhushan.

ICJ will most likely decide in favor of consular access and trial in open court of KJ. Paki interrogated him like he's going to see gallows. KJ returned safely will throw credibility of ISI and military court to garbage.

They will try to deny us Kulbhushan, we need to make sure Pak airspace is closed, no ship will come to their port and all investers are scared off. They will send him back. Like Abhinandan. Way one is released. Second will come back same way. We need to grab them by balls.

ICJ will Order trial of KJ as illegal.........that's all we want, rest we have to do it our self. Send in all ships and soldiers. Keep pressing Pakistan, right now they don't have money to fill fuel in their vehicles. They cant fight war. IK will have to impose more taxes, beg all over the world. That's not the point.

ICJ's verdict in India's favor strengthens India's hand to take punitive action against Pakistan....because the ICJ verdict would have proved India's claim.

That said, we don't know what the verdict would be.
In all likelihood, ICJ might order a retrial in a civilian court (with counselor access). Outright release (though the case for this very ambitious ask was very well laid out by Harish Salve) might be less likely.

How Pakistan is using Kulbhushan Jadhav case to camouflage support to terror

Pakistan has lost its credibility as a responsible country and this is highlighted by the Kulbhushan Jadhav case. Along with North Korea, Pakistan is the only country that is known to support terror, nuclear proliferation and kidnapping people as part of its core strategy.


It is by now well-established that Pakistan is not only a safe haven for terrorists and it funds them but also kidnaps innocent people to try and create a false narrative. Kulbhushan Jadhav case fits in this strategy of Pakistan.


However, Pakistan is trying to leverage, though unsuccessfully so far, the Jadhav case to blame India for its problems in Balochistan.


Pakistan faced a major jolt and humiliation when its argument that the ICJ had no jurisdiction in the Jadhav case was overruled by it.
