New bill forces terrorists' relatives to pay compensation for attacks

The State Duma has approved the first reading of a bill that allows the relatives of terrorists to pay compensation for the damage inflicted during their attacks.

The bill consists of a set of amendments to the Russian Criminal Code and the Law on Terrorism. Apart from making terrorists and their relatives pay damages, including the moral damages, resulting from terrorist attacks, it simplifies the legal procedures allowing punishment for terrorists' recruiting and training as well as for forming terrorist groups.

The current draft of the document also suggests fining people close to the terrorists, such as spouses and in-laws as well as "people whose life, health and wellbeing the attacker values because of the nature of their relationship." However, applying this rather broad definition will only be possible if law enforcers have sufficient proof the property that would be used for compensations was itself received in the course of terrorist activities.

For this, the Federal Security Service (FSB) is given powers to demand an explanation over the sources of assets belonging to the terrorists' families. If there is not sufficient proof the sources are legal, prosecutors and the courts have the right to seize the property and sell it. One of the main sponsors of the bill, FSB deputy director Yuri Gorbunov explained the details to Lower House MPs on Tuesday.

Currently the victims of terrorist attacks can only sue the immediate perpetrators for damages. Partial compensation is also offered by the state.

The head of the State Duma Security Committee, Irina Yarovaya, said the main objective of the new bill was to make terrorism "unprofitable and unappealing" adding that family ties were very strong among those who committed such crimes and could be used as leverage.

Yarovaya added that similar laws are currently in force in Germany, France and China and that they have proved their effectiveness.

According to the current draft of amendments to the Criminal Code undergoing terrorist training must be punished with five to ten years in prison together with a fine of 500,000 roubles (over $150,000). The crime of organizing a terrorist group carries from ten to fifteen years in prison and a fine of 1 million roubles (about $300,000). Presently Russian law also has punishment for terrorism, but for it to be applied the group must be recognized as such by the Supreme Court. The new amendments simplify and quicken the procedure, Gorbunov said.

However, the amendment provides that people who voluntarily quit the ranks of terrorist groups must not be prosecuted if during their participation in the group they have not committed any crime.

The fresh counterterrorist bill was submitted to the Parliament on September 27 on the initiative of President Putin.

The sad part is most terrorists end up coming from broken homes, there are of course a few exceptions such as Osama, but for most part are lured to it by money, and are then brainwashed. So the families are not gonna be able to pay up.

Since there is a large chunk of these terrorists who are jobless brainwashed kids(like Kasab), it would be appropriate for this law to target the parents so that the terrorist will think twice before doing something and the parents will also try to reign in their kids and always keep tabs on them.
I think the law should be limited to the parents and/or the spouses.

This bill is mainly to check the Chechen provincial government as there are clashes between the Russian central government and Chechan with the audit of Chechen Oil revenues and over Subsidies worth millions of dollars .Even the Chechen government was approaching to Azerbaijan because of the dispute with Rosnetf.

This bill would be mainly to keep the provincial government under check because of the oil revenues issue

Then we should punish relatives of ISI officers on every terror attack in India. That way attacks will be easily controlled.

Israeli military establishment has carried out numerous target killings or Assasinations in the name of hurting terrorists which resulted in the deaths of innocent civilians including minors . The tactics which are adopted by the Israelis have backfired on them only and whatever the Israeli military establishment is doing on Occupied Palestine is nothing but continuing of Occupation .

MOSCOW, November 3 (RIA Novosti) – President Vladimir Putin signed a law Sunday forcing the relatives of terrorists to pay for the damages caused by their attacks.
The law submitted by President Putin in September that includes measures to criminalize training in terrorist camps was approved by the country's parliament in late October.
Effort to target the families of militants marks the latest attempt by Russian authorities to stamp out an insurgency in the turbulent North Caucasus that has claimed thousands of lives over more than a decade.
Under the law, material and moral damages inflicted as a result of a terrorist attack should be compensated "by the perpetrator and his or her family members, relatives, in-laws and other people, whose lives, health and well-being are significant to him or her because of established personal relations."
The new law stipulates closer scrutiny toward property belonging to the relatives and loved ones of people who have "committed a terrorist act," with the goal of verifying whether such money or goods were acquired legally.
People found guilty of training with the aim of carrying out terrorist activities will now face a maximum penalty of 10 years in prison and fines of up to 500,000 rubles ($15,700). Anybody found guilty of creating terrorist networks could be sentenced to 20 years behind bars and fines of up to one million rubles.
Individuals found to be parts of terrorist organizations can now be punished with 10-year jail sentences and 500,000 ruble fines.
The new legislation increases penalties for setting up, leading or financing armed groups to up to 10 years. Participation in such groups, including those based abroad, is punishable with up to six years in jail.

Some terrorists can be estranged from their families and relatives, and hence don't care if their relatives are penalized for their crimes. The pork-bullet idea makes just a tiny bit more sense as a deterrent.
