J&K never merged with India: Omar - Times Of India

SRINAGAR: Jammu & Kashmir chief minister Omar Abdullah on Wednesday reiterated his party's stand that the state's accession was not a merger with the Indian Union in 1947.

"While all the states acceded to the union of India and then merged with it, Jammu & Kashmir only acceded and not merged. That is why we have special status, our own constitution and the flag,'' he said while talking to a European Union Delegation.

He said the Kashmir issue was linked to the partition when future of all states except Jammu & Kashmir was decided and underlined the need for a sustained dialogue with Pakistan and separatists.

Omar said there were diverse views regarding the issue. "While one extremist view is for cession, the other is total merger of the state with the union of India,'' he said.

"Unless the process of dialogue is started with a view to find out flexibility in both of the views and carve out a roadmap of addressing the issues, the position will not change.''

He said the Constitution provides a framework for dialogue with separatists.
WTF is this ? :mad::mad::mad:

He is technically not wrong afaik.

Even NDA's manifesto says Article 370 is non-negotiable.

Because on paper, J&K's merger with India is not complete.

Although, this was an unwelcome comment. For all practical purposes J&K has merged with the Union.

Can't we change the article 370 by passing an ordinance ?
None of the parties are for it, so it doesn't matter. But yes technically abrogation of Article 370 is possible.

what is meant by having their own flag, own constitution and special status ?

It's a state flag ! Every Indian state has it's own flag, nothing special about having it's own flag. It's not a national flag.

Excerpts from Wikipedia...

Diplomatic relations between India and Pakistan soured for many other reasonsand eventually resulted in three further wars in Kashmir the Indo-Pakistani War of 1965, the Indo-Pakistan War of 1971 and the Kargil War in 1999. India has control of 60% of the area of the former Princely State of Jammu and Kashmir (Jammu, Kashmir Valley, and Ladakh); Pakistan controls 30% of the region (Gilgit–Baltistan and Azad Kashmir). China occupied 10% (Aksai Chin) of the state in 1962.

The Chenab formula was a compromise proposed in the 1960s, in which the Kashmir valley and other Muslim-dominated areas north of the Chenab river would go to Pakistan, and Jammu and other Hindu-dominated regions would go to India.

The eastern region of the erstwhile princely state of Kashmir has also been beset with a boundary dispute. In the late 19th- and early 20th centuries, although some boundary agreements were signed between Great Britain, Tibet, Afghanistan and Russia over the northern borders of Kashmir, China never accepted these agreements, and the official Chinese position did not change with the communist revolution in 1949. By the mid-1950s the Chinese army had entered the northeast portion of Ladakh

By 1956–57 they had completed a military road through the Aksai Chin area to provide better communication between Xinjiang and western Tibet. India's belated discovery of this road led to border clashes between the two countries that culminated in the Sino-Indian war of October 1962.[25] China has occupied Aksai Chin since 1962 and, in addition, an adjoining region, the Trans-Karakoram Tract was ceded by Pakistan to China in 1963.

For intermittent periods between 1957, when the state approved its own Constitution, and the death of Sheikh Abdullah in 1982, the state had alternating spells of stability and discontent. In the late 1980s, however, simmering discontent over the high-handed policies of the Union Government and allegations of the rigging of the 1987 assembly electionstriggered a violent uprising which was backed by Pakistan

From what I know, only J&K and Sikkim have state flags. I could be wrong. I'd like to know what the flags of every Indian state look like.

Omar is pro-India but then his base is eroding in Jammu, so his party is perhaps trying to target PDP votebase
