‘No sex, no food’ law passed in Afghanistan


London: Afghanistan has enacted a new legislation empowering men of Shia sect of Islam to deny their wives food and sustenance if they refuse to obey their husbands’ sexual demands, a media report said on Saturday.
The new final draft of the legislation also grants guardianship of children exclusively to their fathers and grandfathers, and requires women to get permission from their husbands to work, The Guardian reported.
It also effectively allows a rapist to avoid prosecution by paying ‘blood money’ to a girl who was injured when he raped her, the report said quoting US charity Human Rights Watch.
In early April, US president Barack Obama and British prime minister Gordon Brown joined an international chorus of condemnation when the earlier version of the law legalised rape within marriage.
Although Afghan president Hamid Karzai appeared to back down, activists said the revised law still contained repressive measures and contradicted Afghanistan’s constitution and international treaties it is signed up to. According to the report, the new law has been backed by the hardline Shia cleric Ayatollah Mohseni, who is thought to have influence over the voting intentions of some Shias, who make up around 20 per cent of the population.
Karzai has assiduously courted such minority leaders in the run up to next Thursday’s election, which is likely to be close, a poll indicated on Saturday. Human Rights Watch demanded that Afghanistan’s international paymasters intervene to protect the country’s oppressed women. “Karzai has made an unthinkable deal to sell Afghan women out in return for the support of fundamentalists in the August 20 election,” said Brad Adams, the group’s Asia director. “So much for any credentials he claimed as a moderate on women’s issues.” Civil society groups, say the law, which regulates the personal affairs of the Shia community, still includes clauses which allow rapists to marry their victims as a way of absolving their crime. It also tacitly approves child marriage. AGENCIES

Is there a difference in the personal laws of Shia and Sunni? I thought the differences were mainly political (who should have been the first Caliph?).

How are these idiotic laws justified by the faith?

I think he meant no Karzai but the actual people trying to enforce this on their wives. He does have a point. Normally its the wife who can make you go hungry, not the other way round.

India and the West have to deal with what they have. There are no good choices for us.

This law is no better than what the Taliban have to Offer! This law is again in, utter disregard to the Quran and the Hadith. This has no religious bearing, just meant to please the far right, who want to starve the women and children!

Exactly.
Moreover,this law allows rapist to avoid persecution.But in true sharia law,rapists have to be persecuted.

This is more like Wahabi/Talibani law.This is innovation to meet these idiots' requirement.Which in Islamic term be called as "Bidhaa".

This kind of fanatics are not into bidaat. This is what they understand of their religion. The question is, does the Shia sect allow this? Is it the same in Iran?

This kind of fanatics are not into bidaat. This is what they understand of their religion. The question is, does the Shia sect allow this? Is it the same in Iran?
As far as I know, the Shia sect is a bit more relaxed. You can see this by the way the Iranian women are allowed to uncover their faces and wear pants etc. They are hardliners, but somewhat saner but none the less hardliners. These clerics can say whatever they want, they need no basis of religion for it.

This law stems out of the fact that Afghanistan has been a largely undemocratic and fedual society where women are treated as tools for enjoyment, nothing more. The taliban did it, and now the so called democratic government is following in its footsteps!

Exactly, I feel its the tradition of the Afghans to keep their women arrested at home. Its a purely male dominated society.

Nice to see the Afghan Government is channeling the spirit of the Taliban.
And here i thought the Afghan people will be shed their feudalistic traditions and concentrate on their development.
Guess it will be this way for some time

Yes its a democratic government in which many war lords are sitting inside the parliament .

Yes there are many differences between personal laws of mainstream Sunnis and Shia in many matters .

It has more to do with the elections and to applease the hardliners within the Shia community . Recently 3 rapists were released by Mr Karzai and the victim was one minor .

Misusing of democracy to come in power by wrong policies , just regimes have been changed in Afghanistan , earlier it was taliban and its war lords now its northern alliance and its war lords .

^He has no option but to please the warlords. If he can't even stay in power, you'd might as well forget about any progress in Afghanistan.

We can only hope that the Afghan people can find it within themselves to overcome these insane practices. These things could have worked in an earlier age, now it is impossible to continue for long.
