Where does the incident occurred ? In International water , the only thing which is incorrect is this that the Indian fishermen were killed when there was Indian Flag on that boat.

Rome: Italy on Tuesday recalled its ambassador from India in protest over a new delay in the legal proceedings against two Italian marines accused of killing two Indian fishermen.

Ambassador Daniele Mancini will return to Italy immediately for consultations, the foreign ministry said in a statement, condemning "a new and unacceptable delay by the Indian Supreme Court" in a case that has heightened tensions between the two countries.

The two marines, Massimiliano Latorre and Salvatore Girone, who are staying at the Italian embassy in New Delhi, are accused of killing two Indian fishermen they mistook for pirates while guarding a cargo ship in 2012.

"Given India's evident incapacity in handling this case, Italy will continue and intensify action to defend its sovereign rights in line with international law," Foreign Minister Emma Bonino was quoted as saying.

"Italy's main aim remains trying to obtain the return of the two marines as quickly as possible," she said.

Rome summons Indian ambassador over marines case
Rome — Rome summoned the Indian ambassador on Tuesday to express its unhappiness over a new delay in court proceedings against two Italian marines accused of killing two Indian fishermen.
The foreign ministry "urgently summoned the ambassador... to express the distress and the deep disappointment of the Italian government," said an official statement issued hours after Rome recalled its ambassador in India over the case.

Fun fact: Italy is the most racist country in Europe. There is even racism between themselves. North Italians hate and mock the Southerners (esp. Sicilians). Italians are insecure about their genetic makeup (being mixed with Arabs/Africans) and try to overcompensate by being racist.

Seems Italy is saying that its having influence to stop Indo EU relations. Indian nation is having good relations with all the nations including EU.

Centre blinks, Italian marines won't face death - The Times of India

Dropping SUA charges would have a cascading effect on the role of the National Investigation Agency which would lose jurisdiction to probe the case or file charge-sheet which the agency had claimed to be ready with.

To overcome this, sources said, the Centre is likely to request the apex court to allow NIA to continue with the prosecution even though SUA charges will be dropped. However, the final decision would remain with the SC.


New Government has came in power in Italy and this government has to understand that India is doing things and do care about relations with Italy.

Why this issue is still hanging ?
Nothing unusual, delays are normal in court cases. To add to it indecision whether to press anti-terrorism law or not. Also, non-cooperation from Italy and their antics are the reason for delay.

I think its more about international piracy law or local laws . Anti terrorism law cant be applied in this case because the incident has happened on international waters but Italian marines have fired even when the boat was having Indian flag without any warnings.

That are all claimed conditions, court will have to take a call which is correct.

1. International water and no-flag on boat ( Defense position) ( they say warning was also sounded)

2. International waters and flying Indian flag.

3. Indian waters and flying Indian Flag.

4. Indian waters and flying no Flag.

Also, some say boat was in concurrent waters, I don't know what that means.

India says drops anti-piracy charges against Italian marines
NEW DELHI (Reuters) - - India has dropped a plan to prosecute two Italian marines accused of killing two Indian fishermen under a tough anti-piracy law, a government lawyer said on Monday, offering a chance to end a diplomatic row between the two countries.

Italy had strongly opposed India invoking the law, arguing that it would amount to treating the men as "terrorists" and last week it recalled its ambassador to New Delhi in protest against the delay in the two-year-old case.

The sailors, part of a military security team protecting a privately-owned cargo ship, say they mistook the fishermen for pirates and fired warning shots into the water during the incident in February 2012, off the coast of Kerala state.

Indian attorney general Ghoolam Vahanvati told the Supreme Court on Monday that the prosecution did not intend to proceed against Massimiliano Latorre and Salvatore Girone under the anti-piracy section of the Suppression of Unlawful Acts. He gave no reason.

"We want to delete the anti-piracy clause," he said. The men can still be tried under India's criminal laws, but the punishment there in case of a conviction is ordinarily less stringent than under the piracy law.

The government had originally sought to prosecute the marines under the piracy law partly because the incident occurred outside the geographical area covered by the country's criminal code.

It said, however, that the sailors would not face the death penalty, which the anti-piracy law usually carries, because it has not permitted the investigation agency handling the case to invoke that particular clause in the legislation.

However, it was not clear whether a court would have had to obey this selective block.

The dispute over the marines has provoked a public as well as a political outcry in both countries. In India, supporters of harsh penalties for the men have marched on the streets.

The Supreme Court on Monday said it would rule on whether India's National Investigation Agency which handles cases relating to national security should investigate the fishermen's deaths at its next hearing. It gave no date for the next session.

The top court ruled over a year ago that a trial would take place in India, but charges have not yet been filed. Defence lawyers for Italy and the marines maintain that the incident happened beyond India's jurisdiction.

The delays in filing charges, not unusual in India's notoriously slow legal system, spurred Italy to approach the apex court last month demanding a nod for the marines to return home and a block on any use of the anti-piracy law.

The two men deny killing anyone or aiming directly at the fishing boat. They are on bail but cannot leave India.

Commenting on the Central Government's decision to withdrew anti-piracy charges in the Supreme Court against the two Italian marines, charged with the killing of fishermen, Ministry of External Affairs (MEA) spokesperson Syed Akbaruddin said the issue is about holding the culprits accountable under the Indian law and also hoped that justice is meted out in the case.

"This is not about anyone blinking. It's about trying to ensure that those who are charged with crimes are held accountable under Indian law. It is not a bilateral issue between India and Italy. Nor it is a multilateral issue between India and any other country," said Akbaruddin.
