Maya Kodnani sentenced to 28 yrs in jail, Babu Bajrangi life



AN Indian court last night sentenced a former state minister to a minimum 28 years in jail for her role in instigating the worst massacre during deadly religious riots in Gujarat in 2002.

Maya Kodnani, who served as a minister in Gujarat's Hindu nationalist state government from 2007-09, was sentenced to "enhanced life imprisonment" over the killing of 97 Muslims in the Naroda Patiya suburb of the city of Ahmedabad.

Principal judge Jyotsna Yagnik called the former minister "the kingpin of the religious riots" and gave her a 10-year and 18-year sentence for murder and other charges including inciting religious hatred.

Judge Yagnik said 57-year-old Kodnani, who was an ally of Gujarat's long-standing Chief Minister Narendra Modi, was guilty of instigating mobs and provoking unlawful assembly.

"In a way, she has helped the entire crime," she said.


Kodnani was among 32 people convicted on Wednesday of murder and taking part in the riots. Seven of them received sentences of 31 years minimum while 22 got standard life sentences of 14 years.

A leader of a local extremist Hindu group, Babu Bajrangi, who was filmed by an Indian news magazine in 2007 describing setting families on fire, was also given an enhanced life sentence until death.

One convict had absconded and would be sentenced once caught, defence and prosecution lawyers said.

Mr Modi's closeness to Kodnani is an embarrassment for a politician widely thought to have prime ministerial ambitions, but whose reputation was tarnished by the blood-letting in 2002 only a few months after he was elected.

The 61-year-old from the Bharatiya Janata Party, who is unable to gain a visa to the US because of the riots, has been widely criticised for failing to stop them, but has consistently denied charges of wrongdoing.

The violence was triggered by the deaths of nearly 60 Hindu pilgrims in a February 2002 train fire that was initially blamed on a mob of Muslims.

Hindus hungry for revenge rampaged through Muslim neighbourhoods across Gujarat in an orgy of violence that marked some of India's worst religious riots since independence from Britain in 1947.

Human rights groups say more than 2000 people, mainly Muslims, were hacked, beaten or burned to death while government figures put the death toll at about 1000.

More than 100 others have been convicted for killing Muslims during the riots.

In 2008, the Supreme Court ordered the reinvestigation of nine of the most sensitive incidents during the riots, including the initial train fire and the violence in Naroda Patiya.

Bajrangi, in a taped interview, confessed to helping orchestrate the killing in Naroda Patiya, where homes were set on fire and some Muslims were set ablaze while hiding in a pit.

"In Naroda and Naroda Patiya, we didn't spare a single Muslim shop, we set everything on fire, we set them on fire and killed them," Bajrangi said.

BJP MLA and former minister in the Narendra Modi government Maya Kodnani and 30 others were today sentenced to life imprisonment by a special court which described the Naroda Patiya massacre of 97 Muslims during the 2002 post-Godhra riots as "a black chapter in the history of Indian Constitution".

Additional Principal Judge Jyotsna Yagnik dubbed communal riots as "a cancer on constitutional secularism" and Kodnani the "kingpin" of the Naroda Patiya carnage and sentenced her to 18 years life imprisonment.

She will, however, have to serve 10 years in jail under section 326 (voluntarily causing grievous hurt by dangerous weapons or means) of IPC before her life sentence gets underway, thereby effectively getting a 28-year imprisonment.

Another high-profile accused, Babu Bajrangi, the notorious leader of Bajrang Dal's moral police who was often caught on the wrong side of the law, will spend the rest of his life in jail.

Seven other accused have been given enhanced life imprisonment and they will have to first serve a 10-year term under section 326 before their life sentences begin.

22 others have been handed down simple life imprisonment of 14 years.



Coming in an election year, the verdict that has established for the first time involvement of a senior BJP leader in the post-Godhra conflagration, may have an adverse fallout on Modi's efforts to remove the taint of the communal riots.

"Communal riots are like cancer on constitutional secularism and incident that happened in Naroda Patiya was a black chapter in the history of the Indian constitution," the judge observed.

"Acts of communal violence was brutal, inhuman and shameful, it was a clear incident of human rights violation as 97 people were killed brutally within the day which included helpless women, children aged persons and the climax of this inhuman and brutal act of violence was reflected in murder of an infant who was 20 days old," the court said highlighting the enormity of the crime.

Social activist Teesta Setalvad, who has taken up the case of the post-Godhra riots victims in Gujarat, said they are "completely satisfied" with the manner in which the court has given "exemplary punishment".

"It is the first time that a politician's involvement in communal violence has been recognised," she said.

Judge Yagnik also ordered the Gujarat government to pay a compensation of Rs five lakh to a victim of gangrape but did not charge anybody for the offence for want of evidence.

The court had on Wednesday convicted 32 and acquitted 29 accused in the case. It did not pronounce sentence against one absconding accused.

Though maintaining that death penalty was "desirable" to reduce crime in the society, the court said it believes that such a punishment "undermines human dignity".

"Death penalty brings justice and it is desirable to reduce the crime in the society but this court cannot overlook the global trend prevalent in recent years as by 2009, 139 countries have repealed death sentence and there is a global campaign against death penalty and progressive societies are advocating for restricting death penalty and this court believes use of death undermines human dignity".

It rejected the defence's argument that communal violence in Naroda Patiya was a reaction to Godhra train burning incident.

"This was a pre-planned conspiracy and it cannot be mitigated just by saying that it was a reaction of Godhra train burning incident," it said.

Describing Kodnani as the "kingpin" of the riots, the court said she led the mob and incited it for violence.

Kodnani, who was an MLA at the time of the riots, was made minister of state for women and child development in 2007 but had to resign after she was arrested in March 2009.

Kodnani, a three-time MLA from Naroda who was considered to be close to Chief Minister Modi, is the first woman to be convicted in a post-Godhra riots case.

She broke down after the sentenced was pronounced.

The Naroda Patiya massacre had taken place just a day after the Godhra train-burning incident on February 27, 2002.

Responding to a bandh called by the Vishwa Hindu Parishad, armed mobs had gone on the rampage, slaughtering and burning 97 people, including women and children, and wounding 33 others as communal frenzy gripped Gujarat.

Just saw Pravin Togadiya openly supported these people people and wished that HC will do justice to this 32 people. He's the biggest culprit of 2002, he misused newcomer Modi's fresh immature power.Modi couldn't do anything against him,now he's facing wrath and opposing Guj Govt in some issues but not crossing the border as he knows what would happen if BJP looses here.

Will this cause polarization in Gujarat?
"¨"¨"©May be in some hardcore people but frankly, people now don't care about any cases running in courts. As history says such cases only cause gain of Modi here,don't know about rest of the India.

What is even heartening is that the culprits who started it all, the ones who torched the train, got the death penalty. That is a bigger relief in this whole case.
Lesson of story: Even courts think twice before handing death penalties to Hindu rioters (Justice, IMHO).

My bad then.

But I will explain my POV. A lot of Muslims were killed in Gujarat riots. Justice is finally being served to them. Hindus who died in the train burning have also got justice, Muslims were punished. And I have a feeling all is not lost.

A lot has been said over the years about moving on. Fine with it, I agree. Gujarat has achieved a lot in terms of development, and rightfully it should. But while people bask in the glory of economic opportunities we should not let injustice mire the future generations. They are India's future and should not be made to think that they were victimized and killed because they are a minority. For a democratic and secular Country such as ours, economic prosperity matters, but we should account for the dead too and ensure justice is swift and served. That, IMHO would mitigate hate to an extent and bring about a closure. There are bad elements in every community, every religion. Those bad elements does not define any religion per se.

As about Sikhs, Kashmiri Pandits - yes, they should get justice too. A lot of it is about politics between BJP and Congress. But I still have faith in the Supreme Court.

Fanatics started the riots by burning a train to kill Hindus, fanatics replied to take revenge by killing Muslims, finally fanatics got punished from both the sides, so justice being served :)

But what we learned from it ? Ghanta!

The point is Congress has done politics in this issue to divide and rule for last ten years 'naha dhoke' yet they failed.

Many Congressis were also involved in it how many were punished? If it would have happened in Congress ruled states I dont think any Congressi MLA was going to be punished just have a look at the Marad massacre case.

This is a good example to all.

Now, we must see what the Law does to Tytler and Sajjan Kumar and others.

Likewise, on those who have perpetuated terrorist crimes over the years like the IM and LeT.

Time to set the legal house in order and all are brought to book.

No quarters asked and no quarters given.

And damn the vote bank, caste politics and social engineering!

Politicians have failed us.

Hopefully the judiciary won't!

Dont worry even hard core terrorists like kasab or afzal wont be hanged ,court knows that death punishment to these muslim rioters or terrorist wont be implemented by congress and they die a natural death living in luxurious jails like arthur cell ,but these rioters and 2g scam kanimozhi will be put in tihar jail ,do you get my point.This is how kasab will live and die .Yes government think
twice before treating muslims who are to be hanged
