French plane-maker Dassault paid "at least €7.5 million" as "secret commission" to a middleman, who is also allegedly involved in the controversial AgustaWestland case, to secure the sale of 36 fighter jets to India but Indian investigation agencies the CBI and the Enforcement Directorate (ED) "did not pursue" the lead despite having documents, a portal Mediapart has reported.

The new claims in the report will once again give ammunition to the Opposition, particularly the Congress and its former president Rahul Gandhi who have been alleging corruption in the deal, to revive the case.

Publishing what it called "alleged false invoices" that enabled Dassault to pay the middleman, it claimed, "despite the existence of these documents, the Indian federal police has decided not to pursue the affair and has not begun an investigation." The payment involved "offshore companies, dubious contracts and 'false' invoices," it added.

According to the Mediapart report, the CBI and the ED have had proof since 11 October, 2018 when it received documents from Mauritius that Dassault paid 7.5 million Euros in "secret commissions to middlemen Sushen Gupta" in the context of the French company's "long and ultimately successful attempt" to secure the 7.8 billion Euro deal.

The documents were received by the CBI a week after a complaint was filed on the "suspicious activity that took place from 2015" with regard to the deal. "However, the CBI decided not to open an investigation, even though just seven days after that corruption complaint was filed it received information proving that secret commission had indeed been paid," it said.

While a set of documents showed that Gupta received the "secret commission" between 2007 and 2012 when the Congress-led UPA government was in power, the report also said, "other documents obtained by Indian detectives show that in 2015, during the final negotiations of the Rafale contract, Sushen Gupta got hold of confidential documents from India's Ministry of Defence detailing the stance of the Indian negotiators, in particular how they calculated the price of the aircraft."

The report said the evidence is contained in the confidential documents unearthed by the Indian investigators in the VVIP chopper scam involving AgustaWestland. Mediapart said it is in possession of over 12,000 pages of documents that came out of the CBI probe. DH has not independently verified the authenticity of the documents mentioned.

Citing the documents, the report said Dassault gave Interstellar Technologies, a Mauritian company owned by Gupta, 7.5 million Euros between 2007 and 2012, "thanks to IT contracts that were clearly over-billed, and from which most of the money was discreetly sent to Mauritius using a system of alleged false invoices".

Mediapart claimed some of the invoices "even got" the name of the French company wrong, referring instead to "Dassult Aviation".

Gupta's alleged involvement came to light during the investigation into the AgustaWestland case in which investigators claimed he received a "secret commission" from the Italian company via a "letter box or shell company registered in Mauritius, Interstellar technologies Ltd". Mauritius had earlier agreed to send "numerous documents" relating to Gupta's company, which included contracts, invoices and bank statements.

The report also claimed that one of the documents in possession of the ED showed Gupta suggesting that he had handed over money to some Indian officials on Dassault's behalf. "The risk is taken, you have an agent we have paid, now make sure it is legal, clean and defendable. (...) No money, no decisions (...) People sitting in offices asking for money. (...) Those people will, if we don't pay, put us in Jail," the report cites a communication Gupta is claimed to have sent to Dassault in September 2012.

Indian Air Force will soon operate the F3R version of Rafale, which is a bit different from the previous two versions of the aircraft built by Dassault. The 36 Rafale fighter jets procured by India will be the most potent Rafales to be manufactured ever. The Indian Rafale comes with a number of India-specific enhancements. These changes include:

Full Authority Digital Engine Control (FADEC) to enhance the Jets engine to operate in extreme temperatures
Doppler Weather Radar which informs the pilot of the weather ahead
Indian navigation system with SIGMA
Extra Filtered Oxygen Generation
Integration of Spice 1000 Smart Bombs & Astra missiles
Enhanced SPECTRA EW Suit
Quad Pack Ejectors for stand-off weapons
X Guard Fibre Optic Towed Decoy


These were some major changes specific to India. Apart from that, there are quite a few upgrades to:

Radar warning receiver
Low band jammer
Flight data recorder
High-altitude engine start-up
Synthetic aperture radar
Ground moving target indicator and tracking
Infra-red search and track IRST)
Helmet-mounted display
Missile approach warning systems and very high-frequency range decoys


The deadliest feature of Rafale is the Beyond Visual Range (BVR) Meteor air-to-air missile with a range in excess of about 150kms and a very large no escape zone as the Meteor is equipped with a two-way datalink, which allows the launch platform to provide updates on targets or re-targeting when the missile is in flight. It also notifies target acquisition by the seeker. The Meteor is installed with an active-radar target seeker, offering high reliability in detection, tracking, and classification that will change the air-to-air combat dynamics in this region. Its integration on the Rafale jets means IAF can hit targets inside both Pakistan and across the northern and eastern borders while staying within Indian airspace.

The tried and tested Scalp/ Storm Shadow, a long-range air-to-ground cruise missile with an excess of 300 kms is another nightmare for Indian adversaries and their airbases and hardened bunkers. The missile has a 2 metres precision which means that a target can be hit with high precision, at a longer range.

India has also placed an order of the French-built HAMMER missiles for Rafale jets that have the ability to destroy any target at the range of around 60-70 km.

The feature of Rafale which makes it such a potent fighter and distinctly ahead of many fighters of its generation is its SPECTRA - Self-Protection Equipment Countering Threats to Rafale Aircraft. It is termed as the cornerstone of Rafale’s outstanding survivability against the latest airborne and ground threats. It provides long-range detection, identification, and accurate localization of infrared homing, radiofrequency, and laser threats. The system incorporates a radar warning receiver, laser warning and Missile Approach Warning (MAW) for threat detection plus a phased array radar jammer and a decoy dispenser for threat countering.

The Rafale has 3 laser warning detectors – 2 under the cockpit and one at the top of the fin with 120-degree coverage. Rafale also has 2 infrared missile launch detectors at the top of the fin. The detectors have been designed to provide the Rafale fighter's self-protection system (Spectra) with an advanced Missile Warning System (MWS) covering most of the sphere around the aircraft. In particular, it also provides the capability to detect MANPAD missiles. These capabilities enable the Rafale to have multi-spectral threat warning against hostile radars, missiles and lasers.

Apart from this it also provides superior situational awareness. Spectra has the capability to perform Signal Intelligence (SIGINT) and Electronic Signal Intelligence (ELINT) missions.

Recently, an Indian Air Force pilot had that said Indian Rafale jets are more advanced and faster than their French counterparts!

By the way, the Pakis keep extolling the 'virtues' of their Thunder blunders and stress that their blk 3 is as good if not better than the Rafale!!! Really? It's like comparing fresh apples to outdated rotten oranges!

Maybe more advanced than the French Rafales on absolute terms but the French planes have updated threat libraries (thanks to France's own military actions along with NATO intel sharing), as well as tactics to outsmart the Russian systems they have faced. They also have full freedom to integrate anything on that aircraft without any fuss. India will have to pay the French a lot of money to integrate its own weapons and electronics.

Maybe more advanced than the French Rafales on absolute terms but the French planes have updated threat libraries (thanks to France's own military actions along with NATO intel sharing), as well as tactics to outsmart the Russian systems they have faced. They also have full freedom to integrate anything on that aircraft without any fuss. India will have to pay the French a lot of money to integrate its own weapons and electronics.
The Indian Rafale are the best of the time. No towed decoys on any other one for exemple.
Libraries? not impossible we gave them under a secret agreement to a so close ally.

The main was made with the first export purchase : Many thanks to Egypt, the first export customer as with Mirage 2000.
India is one more, but not the essential.

I'm now expecting another Indian Purchase. As Indonesian one. In 2022.

I also expect the UAE M2000-9 to end their lives in India, in 2027-2031...

I'm now expecting another Indian Purchase. As Indonesian one. In 2022.

Those mirages are heavily upgraded ,sir .
Uae won't sell them , india needs 42 squadrons , we have 33 now I guess ,it will be good but UAE wont sell them.

Is this F4 standard ? I read a report few days back that France is looking for buyers for F4 standard jets so they can start production for French AF and customer.
What's the difference ?
