Working to get CAATSA waiver for India: Senators
By Lalit K Jha Washington, Jul 13 (PTI) At the request of US Defense Secretary Jim Mattis, US lawmakers are working to get a waiver for India from the punitive Countering America's Adversaries Through Sanctions ACT or CAATSA, under which sanctions kick off on countries that purchase significant military equipment from Russia.

Though the act targets Russia, it is having its unintended consequences on India, which is planning to buy five S-400 Triumf air defense systems for around USD 4.5 billion from Russia, that US officials say could be considered as a significant military purchase.

Republican Senator Dan Sullivan, a member of the Senate Armed Services Committee, yesterday told a Washington audience that Mattis has written a letter in this regard to Senator John McCain, who chairs this powerful committee, to come up with a legislative waiver for India.

On questions during the Annual Leadership Summit of the US India Strategic and Partnership Forum (USISPF) here, Sullivan and Democratic Senator Mark Warner, who is vice chairman of the Senate Select Committee on Intelligence, said there is a desire among lawmakers to find some way to manage India's past commitment to Russia and its defense relationships with that country

Sullivan said he spent a lot of time a day with his colleagues in the House and Senate explaining the importance of getting legislative language right on CAATSA and that realignment of any relationship does not happen overnight.

"One of the biggest proponents of the importance of this relationship is Secretary Mattis. And said, I need this (In his letter to Senator McCain). This is important for our country. This is important for India. This is important for the strategic relationships," Sullivan said.

"I'm hopeful that we're gonna get there on something that will advance our country's interests and advance India's interest and build that trust, Sullivan said as he called for concrete actions in Indo-US defense relationship.

Responding to a similar question at a separate panel, Senator Warner, who is a strong proponent of CAATSA, said the lawmakers are looking into it and does not want India to suffer its unintended consequences.

"There are some with the view that the bill does allow flexibility. House version gives a little more on the waiver side. We are trying to investigate on the Senate side, how we can allow this military partnership to grow but not undermine the principles around CAATSA," Warner said in response to a question.

"It would be easier, I say to my Indian colleagues and friends, if this was simply parts of old aircraft that had been purchased 20 years before rather than a USD4 billion plus air defense system. I do understand as well this was negotiated long before," he said, adding that this long relationship can't be broken overnight.

The reality is far different from the pretention. The reality is regarding petrodollars and Arab intervention. Due to alliance with Arabs, USA can't directly campaign against Arabs or make official statements. So, many excuses and false statements are made

I agree. I don't think US will be happy about the sale. They also don't want the
balance of power(which dosen't exist) with pakistan to be tilted towards India. This is why
they are moving India's focus towarda China. While China is biggest US trading partner.
Any improvement in ties by Asian countries (sco) would put US out of the picture.

But Trump was propped up by Russians. So how could he be anti Russian. IMO its more abt the US arms lobby pressurising the Govt to prevent the loss of business. But luckily India hasnt fell for the trap. AD and fighter planes are two areas in which Russians have a monopoly in India and US wants a pie of it. Trump has mostly been transactional with nations and shown least respect for signed treaties. There is no other option for India but to continue buy Russian in AD and aircrafts.

Because Barak-8 is anti-cruise missile defence. It does not have high speed of maneuverability of high end SAMs. Barak-8 weighs just 300kg and is a dual pulsed motor. The first pulse is slow and makes the missile travel in ballistic path while second pulse is fast and homes in. The slow phase ensure that enemy planes have ample time to fly away

Barak8 and S-400 are in totally different class of missiles.
S-400 family of missiles include 400 kms ranged missile. They can also take down some ballistic missiles. Barak 8 (though compact & agile) is more of MRSAM for Army/Airforce (even though Navy calls is LRSAM)

US President Donald Trump is expected to sign into law on Monday a defence spending legislation that will allow India to go ahead with a $4.5-billion deal to buy five S-400 air defence systems from Russia without the fear of sanctions.

The National Defense Authorisation Act-2019, passed by the House of Representatives and the Senate, grants conditional waivers from unintended sanctions mandated by an existing law to third-party countries such as India that conduct significant business transactions with Russia.

The bill was passed after a “conference”, during which a joint committee of the two houses reconciled legislations passed separately by them and finalised a text both agreed to. The White House has announced Trump’s intent to support the bill.

With Trump set to sign the legislation, Indian diplomats, policy and think tank experts and lobby groups should feel relieved that months of tireless efforts have paid off.

The bill amends the Combating America’s Adversaries Through Sanctions Act (CAATSA), which seeks to punish Russia for the 2016 election meddling, and also threatens sanctions against third-party countries making “significant transactions” with designated Russian entities in military and intelligence.

This would have left India open to secondary or unintended sanctions for its plans to purchase the S-400 air defence systems. US Congress was persuaded to amend the law to exempt countries such as India and Vietnam after a spirited push from defence secretary James Mattis, backed by secretary of state Mike Pompeo, who argued that punishing these countries under CAATSA will push them back into the arms of Russia.

The new exemptions are based on conditions, most of which are met by India, officials and experts said.

The legislation also cuts security aid to Pakistan to $150 million, down from the billions it received earlier for its counter-terror campaign and assistance in the Afghan war. But it lets Islamabad off the hook for proving its counter-terrorism credentials to claim that aid, including proof of actions against the Haqqani Network, a Taliban faction based in Pakistan.

Trump, who is on vacation at his business-owned resort in New Jersey, is expected to sign the “H.R. (House of Representatives) 5515, John McCain National Defense Authorization Act for FY (financial year) 2019” at a ceremony at a military facility in New York state on Monday.

“As a Member of the House Armed Services Committee and the Chair of the Subcommittee on Emerging Threats and Capabilities, I am honoured that the President will sign the historic National Defense Authorization Act in our district at Fort Drum,” Elise Stefanik, a Republican member of the House of Representatives, said in a statement.

The conditions say the proposed transaction by the third-party country should “not endanger the integrity of any multilateral alliance” with the US, should not adversely affect ongoing operations of US armed forces, should not have a negative impact on defence cooperation with the US, and should not significantly increase the risk of compromising US defence systems and operational capabilities.

The country benefiting from the waivers must demonstrate it is taking “steps to reduce its inventory of major defence equipment and advanced conventional weapons produced” by Russia.

Russia may start S-400 missiles supplies to India in 2020

Russia may start shipping its S-400 air defense missile system to India in 2020, Dmitry Shugaev, director of the Russian Federal Service for Military-Technical Cooperation, said Monday.

"If we sign a contract with India by the end of the year, I think we can indeed expect deliveries in 2020," Shugaev was quoted by RIA Novosti news agency as saying.

Russian President Vladimir Putin reached an agreement on the supplies of S-400 at talks with Indian Prime Minister Narendra Modi in October 2016.

According to earlier reports, the value of the deal was estimated at around six billion U.S. dollars.

However, Shugayev said that Moscow is selling the system at a discount because India is considered Russia's strategic partner.

The official conclusion of the deal is expected to take place in October, ahead or at the 19th Russian-Indian summit.


Shugayev said that Russia and India had prepared everything necessary for signing the deal.

The S-400 air defense missile system is considered the most advanced of its kind in Russia, capable of destroying targets at a distance of up to 400 km and a height of up to 30 km.

Shugayev said that there is an opportunity to restart the joint Russian-Indian project of creating a fifth-generation fighter jet for the Indian Air Force, but did not provide details.

However, negotiations had reached a deadlock over the transition to a stage of full-fledged development of the aircraft, according to multiple media outlets.
