Lahore:

Lahore High Court on Tuesday ordered the release of Jamaat-ud-Dawah chief and alleged mastermind of Mumbai terror attack Hafiz Mohammad Saeed.

The court heard the petition challenging the detention of Hafiz Saeed, who was detained in the aftermath of the Mumbai terror attack.

The arguments presented by Saeed's counsel A K Dogar, told a three-member bench of the Lahore High Court that there were "no legal grounds" for the the JuD chief's detention by Pakistani authorities.

Dogar also rebutted arguments presented by Pakistan's Attorney General Latif Khosa during the last hearing of the case on May 30.

Referring to the government's contention that Saeed was detained after the UN Security Council designated the JuD a terrorist organisation, Dogar said Islamabad had not acted on several UN resolutions on the Kashmir issue, which had been put in cold storage.

He also claimed the UN acted on the dictates of the US.

During the last hearing, Attorney General Khosa had told the court that the government had evidence that showed the JuD's 'prima facie links' with Al Qaida. This was the first time that Pakistan admitted that JuD has links with Al Qaida.

Dogar had told the court on Monday that while Al Qaida has been designated a terrorist group by the UN and several countries, it was not banned under Pakistani laws.

He was always free. He was enjoying the royal treatment organised by PA and ISI in the name of 'house arrest', now that the heat is off, he is in open. Nothing more.
The only way for these thugs to fear India is for us to start eliminating them wherever they are. If culprit cant be brought to justice, then we should take justice to the culprit. Eliminate Sayeed, Dawood, Azhar(JeM),.......etc and see how they wet their pants.......

Don't worry guys, our government will go back ....... to US to "show them the path" to earn more US praise. India should appear as a soft and peaceful nation no matter what, forget the Indians killed, it happens, life... blah blah blah...

I am bored. Really, I am sure even our government knew that Pakistan, the terrorist nation will never do anything no matter how big the size of the dossier given by India is. It was a joke for Pakistan to please the world media. Now it is upto Indian media, not the spineless government at the centre, to destroy Pakistan through any means necessary. Let's see how many apologists come out begging for peace between two nations after this..

What stupidity of Pakistani judges?. They don't have jurisdiction over UN mandate and cannot comment on that at all. Moreover UN resolutions on Kashmir are 'non-binding' while the UN resolution on JuD is obligatory. Well, I didn't have very high expectations of these kangaroo courts anyways. It is completely politicized.

Well I am with Johnee in this. We must follow Israel's example. Enough is Enough. Why are we still making stupid hues and cries. Why do we want someone else to do our job for us? We now know that Obama's administration is incompetent. So why go and ask him again to do what he is not willing to do?

In case of 26/11 our Govt is making what ever possible to punish those responsible. Even if it happens then it does not mean the end of Pak sponspered terrorism in India. What will the Govt do about it ?

India slams Pak, says it’s not serious about combating terror

New Delhi, June 02: India on Tuesday raised doubts over Pakistan’s seriousness in fighting terrorism, in the wake of a court there freeing Hafiz Mohammad Saeed, who is believed to have masterminded the Mumbai terror attacks, from house arrest.

Hafiz Saeed, the chief of Jamaat-ud-Dawah – a front of the Lashkar-e-Toiba – was placed under detention by the Pakistani authorities on December 11 last year after the UN Security Council designated the JuD as a terrorist organisation.

However, a full bench of the Lahore High Court today ordered Saeed’s release, saying there was insufficient evidence to keep the JuD chief under house arrest. Apart from Saeed, Colonel (retired) Nazir Ahmed – another top JuD leader – was also released by the court.

Both Home Minister P Chidambaram and External Affairs Minister SM Krishna separately slammed the Pak court’s decision, saying the move only showed Islamabad’s lack of seriousness about tackling terrorism.

The development again showed Pakistan was not serious about its “commitment to bring to justice the perpetrators of Mumbai attacks”, Chidambaram said.

"We are unhappy," he quipped, but added that Saeed’s release would not affect the Mumbai terror probe being conducted by Indian investigation agencies.

“Terrorism has to be fought, it has to be contained. It is regrettable that Pakistan has resorted to this,” Krishna told reporters here.

Earlier, an MEA spokesman had described Saeed’s release as regrettable and stated that the move raised questions on Pakistan’s sincerity into the Mumbai terror attacks probe.

Commenting on Pakistani Prime Minister Yousuf Raza Gilani’s move to link the resolution of the Kashmir issue with peace and stability in South Asia, the Indian foreign minister said, “Kashmir has nothing to do with this; terror anywhere is abominable.”

In a televised press conference held just after the JuD chief’s release today, Gilani had said, “Kashmir holds the key to durable peace in the region. Pakistan remains committed to finding a just resolution to the dispute in accordance with the UN Security Council resolutions and aspirations of the Kashmiri people.”

Pakistan wants to engage India in a constructive and purposeful dialogue to resolve Kashmir issue, Gilani had stated further.

However, Krishna put the ball back in Islamabad’s court, saying Pakistan needed to create conditions for the Composite Dialogue of which the Kashmir issue was a part.

New Delhi: India on Tuesday expressed its disappointment over the release of Lashkar-e-Toiba (LeT) founder Hafiz Saeed by a Pakistani court, saying it raised questions about Islamabad's sincerity in investigating the 26/11 Mumbai mayhem that New Delhi has blamed on the terror group.

"We are unhappy that Pakistan has not shown the degree of seriousness it should to bring to justice the perpetrators of the crime," Home Minister P Chidambaram said soon after the Lahore High Court delivered its verdict.
"We are disappointed at the release of Hafiz Saeed," External Affairs Ministry Spokesman Vishnu Prakash said in a statement.

Noting that Saeed headed the Jamaat-ud Dawa (JuD) and the LeT, organisations listed by the UN as being affiliates of the al-Qaeda and the Taliban, Prakash said, "Hafiz Saeed is specifically listed as linked to these terrorist groups.”

"It is regrettable that notwithstanding this background and the international obligations it entails on Pakistan, he has been released," the spokesman said.

Pointing out that Saeed, the LeT and the JuD "have a long and well established background of planning and launching terrorist acts against India", Prakash said, "His professed ideology and public statements leave no doubt as to his terrorist inclinations.”

"His release raises serious doubts over Pakistan's sincerity in acting with determination against terrorist groups and individuals operating from its territory," Prakash added.

"These actions by Pakistan raise questions about sincerity of Pakistan's investigations into the conspiracy that planned, launched and executed the terrorist attack on Mumbai in which hundreds of innocent Indian and foreign nationals lost their lives. Pakistan is yet to report the progress of the investigations that it had committed to undertake into that conspiracy," the spokesman informed.

Citing insufficient evidence, the Lahore High Court on Tuesday freed Saeed from house arrest, his lawyer said.
Saeed was detained last December after the United Nations declared the JuD as a terrorist group.

He was originally detained for one month and this had been successively extended. On May 5, his detention was extended by 60 days.
Ajmal Kasab, the lone terrorist captured alive during the Mumbai terror attack, has admitted to being a Pakistani national and to being trained by the LeT for the Mumbai attacks.

we need to get out of these semantics frankly. The whole wide world knows that Pakistan is the epicentre of terrorism, PA is the big mother, politicians of Pakistan are a bunch of jokers, and Pakistan is neck deep in nuke prolifiration. We know it, everyone else knows it, Pakistan knows the everyone knows its 'secrets'. But what has that resulted in? Billions in aid....

So, lets stop hanging on to the semantics that are of no use. We all know that Pakistan is a rogue nation that uses terrorism as a state policy and uses nukes to give umbrella to terrorists.

The very day that GOI gave a dossier to Pak, I lost all hope that anything good will come out of this. We need to start striking the imp targets within Pak that are the key in all anti-India activities. The first one is Dawood, he is the lynch pin. He must go, then target some top ISI officials or their families. Create fear. Give them the same tonic and perhaps we can win this proxy-war. Otherwise, with the current tactics, we are doomed.

Islamabad, June 03: The United States on Wednesday chose to stay mum on the issue of Jamaat-ud-Dawah (JuD) chief Hafiz Mohammad Saeed’s release from house arrest, with its special envoy for Af-Pak describing it as a Pakistani government issue.

Addressing a press conference in Islamabad, along with Pakistani President Asif Ali Zardari, Foreign Minister Shah Mehmood Qureshi and Interior Minister Rehman Malik, Richard Holbrooke refused to respond to a reporter’s query on JuD chief’s release Tuesday. “Pakistan has its own laws… it is a Pakistani government issue,” Holbrooke said.

The Lahore High Court had on Tuesday freed Mumbai terror attacks’ prime accused Hafiz Saeed from house arrest, saying there was no concrete evidence to corroborate his involvement in the 26/11 attacks. Within hours of the Lahore HC decision, Prime Minister Yousaf Raza Gilani had linked peace in the region to the resolution of the Kashmir issue.

Reports today claimed that the Pakistani government was unlikely to challenge Hafiz Saeed’s release in the Supreme Court.

Holbrooke had earlier in the day commented on the JuD chief’s release by saying, “It has disturbed us all.”

The US Special Representative for Afghanistan and Pakistan arrived in Islamabad today to review relief work for refugees displaced by ongoing offensive by Pakistani authorities against Taliban forces in the Swat Valley.

He announced that President Barack Obama has asked the US Congress to approve another USD 200 million in humanitarian assistance for refugees Pakistan’s northwest.

“President Obama sent me here to show our concern for the people of Pakistan… to show our concern for the refugees,” the envoy told reporters. “I came here to see the situation on the ground… to see what more assistance can be given,” he added.

If the US Congress approves fresh demand for USD 200 million, the assistance the United States would have given for the humanitarian crisis in Swat so far would total USD 300 million.

“This is more than half the assistance Pakistan has received from the international community to tackle the crisis,” Holbrooke said. He further called on the European Union and Gulf countries to do more.

He also reiterated the US’ commitment of assisting Pakistan in combating the Taliban militants, saying Washington would continue to work closely with Islamabad.

“We are committed to help you fight militants… to support democracy,” he stated, adding “instability in Pakistan was not good for any country in the region”.

Pakistan and the US both have same perception of the threat (from the Taliban and al Qaeda), he said further.

Zardari on his part said that the fight against the Taliban was a war of ideology, adding the extremists were trying to take off the flag of Pakistan from the Swat Valley.

“To say the war has been won or is going well, it’s too soon,” he stated.
