NEW DELHI: A Supreme Court-appointed Special Investigation Team (SIT) has cleared Gujarat CM Narendra Modi of the charge that he failed to discharge his constitutional duty to intervene swiftly and stop the communal riots that engulfed the state in 2002.

Sources said the SIT found "no substantial incriminating evidence" against Narendra Modi who was accused by Zakia Jafri of deliberately letting the rioters run rampage. Jafri's husband, former Congress MP Ahesan Jafri, was brutally killed by a mob of rioters whom the police, allegedly, did not stop from attacking the Gulbarg Society housing complex.

The SC on April 27 last year had asked the SIT headed by former CBI director R K Raghavan to investigate Jafri's complaint. Subsequently, the probe team had questioned Modi for hours.

The SIT submitted its status report to the apex court six days ago in a sealed envelope. The contents given to a Bench comprising Justices D K Jain, P Sathasivam and Aftab Alam, therefore, was not known. Now TOI learns that the SIT said the investigations into Jafri's complaint have been completed and it had found no substantial incriminating evidence against the CM.

Jafri's complaint had given details of how, as part of a plan, communal riots were allowed to go on in the state with the CM, cabinet ministers, police and bureaucracy abdicating their constitutional duty to protect life and property of citizens irrespective of their caste and religion.

Her charge against Modi read: "The constitutionally elected head of the state and responsible for fundamental rights, right to life and property of all citizens regardless of caste, community and gender, alleged to be architect of a criminal conspiracy to subvert constitutional governance and the rule of law; unleash unlawful and illegal practices during the mass carnage and thereafter protecting the accused who played direct as well as indirect role and abetted commission of the crime."

After investigating the complaint and related files, the SIT had to seek a direction from the apex court to a reluctant Gujarat government for handing over of all alleged "hate-speeches" in and around the time of riots. The SC had criticised the state government and asked it to hand over the documents sought by the SIT. The investigation also saw Modi being quizzed by sleuths over his role during the riots, which left more than 2,000 dead.

The SIT was set up earlier by the SC to look into the charge of National Human Rights Commission (NHRC) that the state police inquiry into several key riot cases was shoddy and unreliable.

Jafri's complaint had identical charges against 15 cabinet ministers and MLAs. It said they, despite being under oath to defend and protect the lives and property of all citizens, allegedly used "political influence to prevent administration and the law and order machinery from carrying out their constitutionally bound duty to prevent violence and protect the citizens".

Apart from alleging grave derelection of duty against Modi and 62 others including the collectors and SPs of every riot affected district, Jafri said there had been "deliberate attempts to scuttle most of the cases".
Basing her complaint on extracts of affidavits given by senior police officials throwing light on alleged deliberate lethargy on the part of the administration to control the rampaging mobs, Jafri had alleged that terror reigned in the state and that key witnesses were being cowered into silence.

The bigger question is "Now What"?

Will the US now give him a Visa and will the other political parties now stop harassing the best performing Civil Servant in the country and eat humble pie and retract their vitriol?

Is Modi now going to be transformed from a regional context to the national context by BJP as they have legal backing now or is NDA still in search of a Nitish like socialist man with spotless image?

We have to wait and see what is going to play out in the coming months.

I don't think this is an official exoneration yet,since the SC has not officially released the SIT report,which perhaps is unlikely to be any different from what the source told times.Notwithstanding this there will be change in the fact that Narendra Modi will be the favorite whipping boy for the anti Modi entities,how can you let go of something so convenient.

Well the result is quite predictable. I dont think Modi would every be convicted though there is a lot of evidence and phone records etc. But i think a lot would have been destroyed. There will never be any conclusive evidence against Modi. There would always be the fall guy.

Yusuf Rajiv gandhi was not convicted for the sikh riots in 1984.Lalu was not convicted for the bhagalpur riots in 1989 (the casualities then were 8000-9000) were the casualities then.In Indian history no leader was indicted in a riot Yusuf

Yes pretty much it. Thats why i said Modi will never be convicted. They will wriggle out of it on technicalities and find someone else to take the blame.

It will take the country's mind of the Congress Govt's Scam a Day expose!

Congress will breathe a sigh of relief as much as the BJP!

Yusuf my two cents They tried seriously to grill modi but the guy is a spring the accusations made him to much better adminstration than usual so that he is acceptable and in a very perverse manner way these riots helped him

Not that I am a Modi fan, but the cases that you mentioned were not investigated by an SIT under supervision of the Supreme Court.

CBI investigated and they are as rotten as stinking rotten fish!

Imagine the state of the country. The CBI was raised to be independent in investigation and today, they are as good as Pandu Havildar!


If you have a corrupt man as the CVC and then gloat and justify about his appointment, then you will also have the state of the country as it is today!

I personally am very sceptical about the truth that surfaces since everything in this country appears to be politically conjured to suit the convenience!

if it were the CBI investigating then Modi would have been booked.

Now that it was a Supreme Court monitored probe, it has some veneer.

But then, do I hear of it being fishy?

Possibly!

But who am I to contest?

I am but a citizen of this country and everything is decided by powers that be!

While the riots were unfortunate,the whole campaign to turn this into a political road show centered around the thesis that the riots were choreographed and orchestrated by small coterie of BJP leaders led by Narendra Modi(La Nazi style) smacks of politicking than any real concern for the the riot victims or rendering them justice.Any large scale violence is usually a result of unfortunate collapse of administrative mechanism,as the head of the such a administration, Modi deserved the brickbats that were hurled at him.His detractors did not stop at that and went to the town their political agenda and inadvertently helped overwhelm those brickbats with an outpouring bouquets.All Narendra Modi had to do was sit back and reap the windfall.

Modi baiting has lost its political luster and Gujarat remarkable progress under his stewardship has rendered any such political campaign asunder.Political parties aside,NGO's sponsored by vested interests will continue to carry on their anti Modi campaign.Teesta Setalvad,probably well aware of the outcome,has already accused SIT of carrying out a witch hunt against her and in all probability will call the eventual publication of the SIT report as politically motivated or dismiss it entirely.

That is the point,

The riots were not unfortunate.

It was disgraceful.

Instead of catching the culprits in Godra and thereafter the rioters and their leaders all over Gujarat, political brownie points were being run after.

Apparently paid up Charlatans surfaced to hog the limelight in addition to the political obfuscations that followed.

The political jester Laloo added to the circus.

Everything was lost. The crimes got buried.

And the whole issue became so labyrinthinian and murky that out of the garbage nothing cogent emerged.

Victims suffered and continue to do so, but the politics marches resolute.

A sad commentary of India and the depth to which political parties play with the lives and aspiration of the people!

Given this TV debate, what does this Teesta Steletvad has to say?

She is such an idiot that today because of her and that Harsh Mander man, who quit the IAS to join a lucrative NGO payroll, the riots remain vague.

And one really still does not know what is the truth!

Arnab is quite tough in his questioning.

Now that the SIT is given a clean chit so to say, one wonders what is the reality!

Congress in past (in order to keep its vote bank intact) has done everything to make sure that Shri Narendra Modi remain synonymous to post Godhra riots or least an anti-muslim face. So, it doesn't matter if SIT gives Shri Narendra Modi a clean chit or anything, the motives behind these repeated allegations have served its purpose very well. Nothing is going end here, Congress will always come up with peoples like Zahira Sheikh, , Teesta Setalvad, Vrinda Grover to hunt down Shri Narendra Modi with an clear cut objective to blame, creating hype and inducing fear psychosis among muslims but not getting him accused. How can congress let golden hen fly away?
