On June 15, 2004, Ishrat and three others — Javed Ghulam Sheikh alias Pranesh Kumar Pillai, Amjad Ali alias Rajkumar Akbar Ali Rana and Jisan Johar Abdul Gani — were gunned down by the Gujarat police who claimed they were linked to Lashkar-e-Tayyeba and were planning to kill Gujarat Chief Minister Narendra Modi.

Magistrate S.P. Tamang, conducting the probe, said the four victims had no links to Lashkar.

The report said the encounter was "planned" and executed "mercilessly" — the victims were shot from a "close range".

The judicial probe has stated that the senior police officers, including then city police commissioner K.R. Kaushik, planned the encounter to impress Modi, get promotion and secure their positions. (With PTI inputs)

When Sayed Khwaja Yunus Sayed Ayub got a job as software engineer in Dubai in 2000, his family had rejoiced. But his parents' dreams were shattered within a year and nine months. Yunus, who had returned to his sleepy town of Parbhani, 200 km from Aurangabad, on November 11, 2002, was branded a


terrorist by the Mumbai Police and arrested on Christmas in 2002 in connection with the Ghatkopar train blast case.
The worst was yet to come.Glancing through old photographs of her 25-year-old son, 65-year-old Hashiya Begum said: "This one is among the last two photographs that I have of Yunus. The remaining have been taken away by the policemen on one pretext or the other who kept visiting my house for nearly six months after Yunus was killed."

So, while the ruling Congress-led coalition lashes out at the Narendra Modi-led Bharatiya Janata Party government in Gujarat for killing Sohrabuddin Sheikh, Kauser Bi and Tulsiram Prajapati as alleged Laskhar-e-Tayyeba operatives, it seems to have forgotten the blotch left by the custodial murder case of Yunus in Maharashtra.

Encounter deaths in Maharashtra have come to be defined by the larger-than-life images that "encounter specialists" enjoy in the state's police force. They were often eulogised by the media and public, with films made in their tribute.

It is another matter, though, that 14 policemen have been charged with involvement. They include seven sub-inspectors, assistant inspectors and inspectors. While the API Sachin Vaze has been suspended, rest have been transferred out of Mumbai limits so that they do not influence the investigation.

For nearly two months, the CID investigated the death on a first information report (FIR) filed by Vaze. It claimed that Yunus had escaped from police custody after the police vehicle in which he was being taken for investigation to Aurangabad turned turtle in the western district of Ahmednagar.

The CID also appealed to the Supreme Court against a Bombay High Court order to file a separate FIR. It was only after the apex court threw the appeal out that the CID filed a separate chargesheet based on the statement of Abdul Mateen, a co-accused in the Ghatkopar blast case, who also told the court about the alleged torture meted out to Yunus in custody.

Individuals may be guilty but what is the evidence that all of them are RSS people? Remember that in 1984, Congress workers wore saffron bandanas to again besmirch mainstream Hindus when they attacked Sikh brothers. And now those who got brainwashed into Khalistani terrorism, think that it was mainstream Hindus who did this even though all these Indic faiths are one. My family was also stopped and accused, of being Muslim, during the '91 riots. When they discovered a scapular, around the neck of one of my aunts they let them off. I also had an uncle working for the police force at that time. The Commissioner was instructed to have his police stand at the side while the RSS and the Shiv Sena, which ran the city at the time, had their cadres run amock. There were RSS shakhas right across the police station on Gokhale road, where petrol bombs were being prepared while the police stood silently mute across.

To boot, most Congress workers are mainstream Hindus. Despite the fact, that it is run by a Christian woman.

And yes, nobody exonerates the Cun*gress from all the bull shit they have done.

It seems like you guys have never seen the organization from the inside. All you have ever witnessed is their 'social work'. Fine, yes they may do social work. But they are also a mad, fascist organization- of the most notorious kind.

Nobody accuses the Hindu of being racist, bigoted, besmirched or anything else.

Nobody wants the Hindu to be "weak, diminutive", "passive", "submissive" or anything else.

The reason minorities live in this country is because the Hindu is accepting, accommodating, ambitious and strong minded. The reason they live in this country is because India, this country of 80% Hindus, has a future.

But no, Hindus are not exonerated from all blame and guilt, merely because of their religion. Nor are they incapable of crimes or violence, just as Christians or Muslims or Sikhs are. And yes, they will be prosecuted before the law, just as a Christian, a Muslim or a Sikh may be.

Let us not forget. We may be democratic in our law making, but we are secular in its execution.

The law is Blind before every man.

You don't know the meaning of fascism dude. Congress is the most anti of everything Indian whether faiths or social customs ever. Take a trip to various parts of country where you will find evidences. I am not saying that RSS may be always right. Shastra Pooja is a ritual of theirs and the reason why this country has not become a theocratic lunacy till now despite having more than 10 million potentially armed volunteers of RSS is because they know the difference as an organization between terrorism and nationalism. Otherwise how long do you think it would take 10 million people to dethrone democracy and execute everyone like Communists did? Not even a year.

Congress has a history of direct and indirect atrocities against different faith branches. First it plays politics to appease them, sucks all the juice out of them and throws them to the dogs. It did this with the Sikh brothers and gave rise to Khalistan movement. Then when it became a real problem, made it look like a hero operation and you know the 1984 result. Same way it promised us grants as "minorities" for monasteries and facilities orally and when later we and our Arunachali cousins complained about religion-themed militancy in NE by so-called self-proclaimed groups like Isaak Muivah, they left us for dogs (I have even posted a thread about Arunachalis complaining about this here.. do read it).

This same thing Congress is doing with Muslims and Christians now what it did with Khalistan issue: using them and once their use is over, they will do worse than what RSS is falsely blamed to do with them. I just want people to realize this dirt of the Con-party. Using and abusing the country's different rich communities for their dirty use.

BJP is not a hero and infact it is an idiot in many cases and I agree; but it is anything far better than this. And remember, reducing the devil's status can only be done in a step by step process. If we don't punish the parties' faults in a democracy, then what is the use of a democracy?

The thing is, we educated people get disgusted with politics and don't go for voting. This reduces the threat to such people as Con-party. So they go to the purposely-kept-illiterate very very poor villagers and tribals for vote and hence they come to power.

Ever since booth capturing has stopped, another new tactic has come up; buying off last minute votes.

But then one has to wonder how come that RSS is suddenly under increased pressure when Congress is getting its butt kicked hard for scams,inflation etc its a political game like in any other country blame your opponent to divert attention from your own shortcomings.
I believe RSS will come unscathed from these attacks let's hope it does not backfire on Congress Pundits
Your assertion about political angle might be true and timing may have been calculated by congress but it still doesn't discount the fact that people in rss are involved in terror activities. rss got caught and congress thought lets use this for political benefit but rss still did it. do you understand what im trying to say ? congress is no saint but neither is rss or bjp.

The involvement of some extremists groups like Abhinav Bharat has been ongoing since late 2007 first under ATS chief Hemant Karkare and the arrest of Pragya Singh Thakur and Lt. Col. Purohit.

Assemanand was also arrested back in Novemeber much before the 2G scam and radia tapes or wikileaks story broke out. So it was only a matter of time before his case details would come up in the media.

If it were upto me, I would just get the politicians to just shut up and let the investigative agencies do their job.

It seem's like in a very Bollywood way, Aseemanand had his heart changed due to the kindness of a Muslim accussed in Hyderbad jail. And not only did he confess but wrote to President of India and Pakistan to allow him to meet Hafiz Saeed and other assorted terrorists to change their mind. The letters-which were given to his brother-were not posted. It really has a feel good movie feel to it but I guess only the investigators can get to the bottom of what the facts are.

ON 16 DECEMBER, when Swami Asimananda first appeared before a Delhi Metropolitan Magistrate at Tis Hazari with a request to record his confession, the magistrate was a bit incredulous. He asked the Swami if the CBI was threatening or coercing him into giving a confession. The Swami smiled back and replied, "You really think these cops could force me into doing something I don't want to do? When even Atal and Advani could never dare to put pressure on me, then what chance in the world do these poor fellows have."

'Who are Atal and Advani?' asked the magistrate. For a moment, he was disoriented by the names uttered with such easy, almost scornful, familiarity by this elderly, shabbily dressed man produced before him as a terror suspect.

"The former prime minister and deputy prime minister," the Swami replied in the same measured tone.

This conversation, which TEHELKA has learned from highly placed sources, provides a rare insight into the man who was once a formidable and doctrinaire ideologue of the Rashtriya Swyamsevak Sangh and inspired both fear and awe even among senior BJP functionaries.

In 2006, when the Swami organised the Shabri Kumbh Mela at his ashram in Dangs, Gujarat, the who's who of the BJP and the RSS congregated to mark their presence. Gujarat Chief Minister Narendra Modi, Madhya Pradesh Chief Minister Shivraj Singh Chauhan and then RSS chief KS Sudarshan were part of the jamboree.

The Swami had devoted his life to the cause of 'Hindutva.' After setting up the Shabri Dham Ashram in 1997, he worked zealously at reconverting tribal Christians into Hinduism. He regularly mobilised violent mobs, attacked Christian missionaries and captured their churches. According to reports, Asimananda had forcibly occupied over two dozen churches in Dangs. At one point he had even refused to listen to the pleas of former prime minister Atal Bihari Vajpayee who had reportedly asked him to refrain from violence and coercion while carrying out the anti-conversion work.

But in a curious twist of fate — and in a development that no investigative agency could ever have anticipated or imagined — this intractable zealot was profoundly transformed by a chance encounter in prison with a courteous young Muslim man, wrongly arrested and tortured for the Mecca Masjid blast — a blast, which in truth, the Swami and his co-conspirators had committed. (See TEHELKA story In the Words of a Zealot, 15 January).

Intensely moved and gripped by a desire for penance, Swami Asimananda apparently requested a confession before a magistrate. "I know I may be served a death sentence for this, but I still want to confess," he told the magistrate. Published by TEHELKA last week, this confession, which is the first legal evidence to show the involvement of RSS pracharaks in the Malegaon 2006 and Samjhauta Express blasts, has had wideranging political and diplomatic impact. But this was not all.

IN AN astonishing gesture, apart from his confession before the magistrate, Swami Asimananda also wrote to the President of India and the President of Pakistan, admitting to his crimes and detailing the encounter with the Muslim boy that changed his heart. "Abdul Kaleem pierced my conscience," he wrote. "After all, he had been made to suffer for my wrong work. I understood that love between two human beings is more powerful than the hatred between two communities."

In these two letters, written in his own handwriting — copies of which are in exclusive possession of TEHELKA — the Swami then goes on to express a desire to meet Lashkar-e-Toiba chief Hafiz Saeed and Taliban leader Mullah Omar and other jihadi terrorists and urges the two presidents to help him get an "opportunity" to transform the jihadis as he himself has been transformed.

The Swami says he had taken to terrorism in retaliation to Islamist terror attacks on temples, but having realised the futility of mindless violence, he would now like to persuade terrorists like Hafiz Saeed to renounce this path as well. He requests "the good office" of the President of India to help him go to Pakistan to do this.

After TEHELKA published Asimananda's confession last week, several Hindutva apologists asserted the confession was coerced out of him. His counsel also belatedly asserted — 20 days after the event had taken place — that the confession was false and would be retracted. But the letters to the Presidents of India and Pakistan give the lie to all that. Swami Asimananda wrote them two days after he made the confession under Section 164 of CRPC. He had given these letters on a jail visit to his brother to post. TEHELKA procured them from him. The tone and tenor of these letters exactly match his confession. However, his lawyer did not mention them last week as part of the CBI's alleged coercion.

These letters present a fresh challenge to those who would deny all that Swami Asimananda has confessed to. TEHELKA wrote to the office of the President of India seeking a confirmation that they had received the letter. At the time of going to press, the President's office had yet not responded.

Terror, it seems, has finally fallen prey to something mightier than it: the power of human conscience.

4. I request you to use your good office to help me to go there and meet these jihadi leaders and transform them or you can ask the Pakistan President to send them to me in jail.

Probe into terror attacks is mired in vagueness as various persons have admitted to same crime

With investigation so far linking the banned SIMI, Swami Aseemanand and associates, and David Headley with Samjhauta Express and some other blasts, the probe into the case is mired in a maze of confusion.

Top SIMI commanders Safdar Nagori, Kamruddin Nagori and Aamil Parvez had, in their narco test, ruled out involvement of Lt Col Srikant Purohit or Pragya Singh Thakur in the Malegaon blasts and owned up to the Samjhauta Express explosion.

However, Aseemanand has reportedly claimed that he and his associates — Riteshwar, Sadhvi Pragya and Sunil Joshi — met at Riteshwar's house in Valsad in June 2006 to target Muslim localities with a view to avenge spiralling terror strikes by jihadi groups in the country.

"I told everybody that bomb ka jawab bomb se dena chahiye, (I told everyone we should answer bombs with bombs). At that meeting, it was also decided to target Samjhauta Express," if Aseemanand's confessions are to be believed.

Further muddying the picture is well-known disclosure by Faiza Outalha, former wife of David Coleman Headley, about his role in Samjhauta bombing.

Even before the investigators came to know about Headley's link and zeroed in on the Hindu outfits, top SIMI leaders had admitted the involvement of SIMI and jihadi elements in the Samjhauta train carnage and Malegaon blasts of 2006. Apart from the Samjhauta Express and Malegaon blasts, Nagori and his associates have also confessed to SIMI's role and involvement of Muslims in terror attacks in Mumbai, Aurangabad, Hyderabad, Ajmer and the shootout at the American consulate in Kolkata.

Nagori told a team of doctors of FSL, Bangalore, "In the Samjhauta Express blasts, some persons from Pakistan had come and they had purchased the suitcase cover at Kataria Market, Indore. One person (from SIMI) Tanzeem had helped them to get the suitcase cover stitched. SIMI leader Abdul Razak had helped Pakistanis in the Samjhauta Express blasts."

The banned outfit's commander revealed that meetings were held by SIMI at Kurla, Kapadia Nagar and Mira Road in Mumbai for executing the terror attacks on Samjhauta Express and other blasts in the country.

During the drug interrogation, Nagori revealed that SIMI has a strong presence in Maharashtra, including Malegaon, and he was "aware of the complicity of Muslims in the 2006 Malegaon blasts".

The 32-page narco analysis test report of Safdar Nagori, Kamruddin and Aamil Parvez (a copy of the FSL report is with The Pioneer) quotes Nagori as having said, "In the Malegaon blasts (2006), some of the Muslim members were involved and that he (Nagori) was aware of it. SIMI members were involved in the Samjhauta Express train blasts."

Interestingly, the narco analysis test reports of the trio were studied by the ATS, Mumbai, which had subsequently questioned them.

The Madhya Pradesh Police had arrested the top SIMI commanders, including the Nagoris and Parvez in March 2008.

Nagori also revealed during the narco test that Razak (who had helped the Pakistanis in Samjhauta train blasts) had informed him beforehand about the Samjhauta Express blasts. Razak had sought the help of West Bengal SIMI president Misbah-ul-Islam for the Samjhauta explosions. Razak has a number of relatives in Pakistan, according to Nagori's revelations. Kamruddin Nagori also concurred with Razak's involvement in the Samjhauta Express blasts.

Narco analysis, brain mapping and similar tests are not considered as part of evidence and can only be used for "investigative" purpose after cosent of the accused. The Supreme Court considers this as unconstitutional and forced tests are illegal and can't be submitted in court as evidence. Supreme Court makes narco, lie detector, brain mapping tests illegal


Coupling this with the fact that cases of tortured innocent youths which were released by courts due to lack of evidence are coming out (check this out ) There is no wonder that there is confusion with the narrative of what is right. The invesitgative agencies will have to come out with a final story ofcourse and present it incourt and only then the truth will come out

What is the credibility of the govt and its investigation agencies consideringhr variety of people who have been accused of perpetrating various acts of terror in this country.The central govt first blamed Pakistani terror outfit LET and their co Islamic terrorists based in indian and B'desh,the HuJi,this was declared so by the govt on the floor of the parliament,so much so even the United nations report quotes the govt on the same,and now we have the govt agencies coming up with a whole new set of candidates.If the samjhauta was carried out by Hindu groups,why did they blame LeT or HuJi,on what basis and evidence.

In the wake of this new allegation,what is going to be left govt credibility over its accusation that Pakistani terrorists carried out the Mumbai attacks,who is going to believe them and why,why would Pakistan carry forward a trial,who entire premise is base don evidence provided by the Indian govt,which thanks to the central govts flip flops will now come under a cloud of suspicion.

Has Ajmal Kasab confessed to his role in the Mumbai attack yet,or we are going to see some swami or sadhvi 'confessing' for the same.
It's evident that the police screwed up being the lazy ass they are. Instead of doing proper investigation they shifted the blame to Islamist terrorists as they had been involved number of times in various terror acts in India. Also Islamic terror groups make it no secret that they have ties with ISI.

However in light of new evidences they did a commendable job by re-investigating the case properly and arresting those who are responsible. Come to think of it, it was only matter of days before a Hindu group plays the same terror card as a retaliatory act, and RSS fits the bill perfectly as their version of Hinduism is compatible to their peers in hard-line Islamist sects.

Speaking of Ajmal Kasab, didn't a leading Pakistani English daily already run a story digging out his families etc native to Pakistan.

I have better suggestion to end this quandary,it should be settled through a toss of coin,heads Islamic terrorist,tails Hindu terrorists.PC should flip the coin really,it has more credibility than his agencies investigative skills.




P.S:I get it,when police screw up they blame Muslims,but when they a do a thorough investigation and no screw up,by default a Hindu hand should merge.

Its more than just laziness . Lets presume what they are saying now is correct . Then what about all claims about neighbors involvements and name of many people take by CBI . now its clear that they were falsely implicated in the case . this certainly creates serious doubt over credibility of CBI and whatever they say will always be viewed with suspicion by almost everyone.

Yes it does affect the credibility but don't you think it's better that the Indian investigation agencies unearthing the true perpetrator instead of foreign agencies?

About the neighbour's involvement, various terror agencies made it no secret that they have sympathisers in neighbourhood, so the perpetual suspicion to the neighbour will be there to stay and in any case of terror act those guys will feel the heat first who might have a connection with foreign based terror groups. It's only but normal.

However after this case RSS and other fringe groups attached to it will be in radar of agencies for sure(although it depends on who are in the helm of Dilli).

Its a compulsive attitude a section of the indian ruling dispensation to blame all acts of terror and violence on ISI and Pakistanis,conveniently ignoring or preferring to obfuscate the fact that there is fifth column within this country that is more than keen to play its role.So far as organzation that need to put under radar of suspicion for anti national activities,Congress should at the top of the list,one of its ex minister was even convicted for acts of terrorism
Ex-minister gets life term in 1993 Surat blast case
Surat: A TADA court on Saturday convicted former Gujarat fisheries minister Mohammed Surti in the 1993 Surat bomb blasts case and sentenced him to 20 years in jail.
Special Tada Court Judge RP Dholadia justified the life term of 20 years for Surti describing the case as rarest of the rare crime. The court also found 11 others guilty in the case.
A school girl was killed and 16 others injured in the bomb blasts on January 18, 1993. The blasts, which followed the demolition of Babri Masjid in Ayodhya on December 6, 1992, took place at the Surat Railway station and at Varachha.

The blast at Varachha had claimed the life of a girl, Alpa Patel, and injured 11 others, while that on the railway station had wounded around 20 people.

Surti, was a minister in the Congress government in the 1980s, was linked with some of the accused who came from a relief camp set up for post-Barbri Masjid riot victims.

He was arrested after his role in the conspiracy behind the bomb blasts came to light.

However, six other accused were acquitted in the case. Around 160 witnesses deposed in the case.
