The Parliament makes laws

The implementation is LEFT to the state govts

State govts get funds but funds are used for some other purposes

The EXAMPLES are MNREGA NRHM Right to food and RTE
I know ,MNREGA and coming right to food are legal right.

Now you tell me , Is RTE a legal right or Fundamental right ?

Till a CHILD can go the court and demand and GET free education it is JUST a LEGAL Right

What does our constituition say ? Is RTE a legal right or fundamental right ?

Article 21 is a Very broad article

But it doe s not PROVIDE PROTECTION to an INDIVIDUAL like other Fundamental rights

The Govt has DESERTED Both QUALITY Education and Health sectors

All it provides is poor quality schools and poor quality hospitals

Yeah Yeah I know about IIMs and IITs

I am talking of basic school education

And it wants the private sector to pick up the tab

And I have to pay EDUCATION CESS
Actually IIM and IIT are not that good either. They are better than rest in India, but they are not at international standards. Getting into IIT is not difficult if you go to private institutes in Bihar UP for tuitions.

1) The right to go abroad.
(2) The right to privacy.
(3) The right against solitary confinement.
(4) The right against hand cuffing.
(5) The right against delayed execution.
(6) The right to shelter.
(7) The right against custodial death.
(8) The right against public hanging.
(9) Doctors assistance.

These are SOME other Rights CONFERRED by your Article 21

Now RTE is not mere extension of Right to life and personal dignity that Article 21.

RTE has a separate article 21(A) by 86th constitutional amendment act.

Now eat your words back and tell your answer : Is RTE a legal right or constitutional right ?

RTE is now a fundamental right under right to freedom. But then tell me about one right that has been in place in true spirit.

For me, the implementation is wrong not the idea. Education is key to solve a lot of problems. But then it cannot be at the expense of others.

We are not building institutions. Mere subsidies will not help.

Article 21 and Article 21(A) are two separate articles.

Read 86th constitutional amendment act and then eat your words back.

Now answer it if you have guts : Is RTE a legal right or fundamental right ?

I am deliberating reposting my earlier post because this Bachchu is SELECTIVELY replying
to my posts and has conveniently left out my earlier post which proves the HOLLOWNESS

I know about article 21 . Earlier RTE was a inferred right under right to life ,that is article 21 . In 2002 , by 86th amendment Act government has introduced another article in in Part 3 of constitution. that is article 21(A).

And Now answer it .

Read the FINAL ACT that was passed in 2009 by the Parliament

Don't be another supreme court. Today itself Supreme court has validated article 21 A

I'm not asking how Article 21 A perform. Even almost all the fundamental right is an extension of Article 21.

I'm asking ? Is RTE a legal right or fundamental right ? ANSWER this.
