Discussion starts fron 24:00. They as usually cry that their case was very strong but because of incompetence
of hired experts and corruption, they lost it. And sad thing is that now they cannot appeal elsewhere. :laugh:
Then they unofficially won the case would have been the right way to report
it in the pakistani media.

Pakistan loses water case against India in COA

KARACHI: Pakistan on Tuesday lost the case of construction of 330 megawatts (MW) Kishanganga Hydro-electric Power (KHEP) project in Indian-held Kashmir (IHK) in the International Court of Arbitration (COA) against India. This loss will reduce more than 20 percent of the power generation capacity of the 975 megawatts (MW) Neelum-Jhelum power project on the same river downstream Muzaffarabad in Azad Kashmir.

Pakistan would to face severe water shortage in the next coming years, water experts said.

The COA accepted the stand over the KHEP project and allowed India to turn the flow of water according to its requirements.

A senior member of Sindh Agriculture Forum said this was sheer in violation of the 1960 Indus Water Treaty (IWT) between the two countries while he expressed dismay over failure of Pakistan's solicitors, as they could not plead the case judiciously.

Indian spree of building dams on water flowing into Pakistan territory will inflict Pakistan to a water-scarce country.

Pakistan is heading towards severe water shortage as the Indian government has decided to build more than seven dams on rivers running into Pakistan from IHK.

Pakistan has absolute rights on these rivers, as their flow is towards Pakistan and under the IWT India is violating the accord.

Throughout the case proceedings Pakistan remained undecided to appoint patriotic and real water management experts to take up its case before COA in violation of the 1960 IWT.

The country is heading towards the worst water shortage in the next couple of years due to insufficient water management practices and storage capacity, he said.

The construction of Nimoo-Bazgo hydropower project since one year, including Baglihar and Kishanganga in violation of the IWT and now completion of one of the highest hydropower projects in the world on Indus River at Ladakh will hurt Pakistan's agriculture and other water needs.

Winning the case will provide India to speed up work on Chuttak hydroelectric project on the River Suru, a tributary of Indus in the Kargil, which is also near completion.

These projects will reduce the flow of Indus River, which would badly damage masses, industry and agriculture of Pakistan.

Pakistan has lost its stand due to poor handling of the case with India as well as in COA, Pakistan could not gain points in favour of its case, only because of a team of jurists, not sincere from the start.

The IWT has now become ineffective as India has continuously been violating all clauses of the treaty and Pakistan was not challenging them at any international forum by tacit approbation.

Under the treaty, three western rivers, Chenab, Jhelum and Indus are allocated to Pakistan and India is not allowed to build storages on them.

A report by the Washington DC-based Woodrow Wilson Centre said Pakistan would face a loss of energy of more than Rs 6 billion every year if it lost Neelum-Jhelum power project case in COA.

The IWT with India remained just on papers. India had diverted Pakistani water and constructed more dams, which would further worsen the water situation in Pakistan.

International Water Expert Engr Bashir Malik who has served United Nations and World Bank as chief technical adviser said the cheapest and environment-friendly solution to water and energy crisis in Pakistan was the Kalabagh Dam, which could only be built by a patriotic and brave leader having the courage to break all the barriers in the best national interest.

Pakistan Commissioner for Indus Waters, Ministry of Water and Power, Ministry of Environment and Ministry of Foreign Affairs remained tight lipped on the issue.

ISLAMABAD - With the award announced in the Kishanganga dispute by The Hague-based Court of Arbitration to divert only a minimum flow of water from the Neelum/Kishanganga River for power generation, the 969MW Neelum-Jhelum Hydropower Project would be badly affected and would have to be redesigned.
Background interviews and discussion with energy experts show that with the verdict of International Court of Arbitration, Pakistan would have to face around 150 billion annual loss as the designed capacity of 969MW Neelum-Jhelum Hydropower Project will be reduced by 150MW. The verdict has an ultimate impact on Pakistan as it will reduce water flow in the River Neelum, leaving very little water for Pakistan. They were of the view that the International Court of Arbitration ruled in favour of India on the diversion of Neelum (Kishanganga) water, setting aside objections by Pakistan that halted work on the 330MW Kishanganga Hydropower Project in Indian Held Kashmir. A detailed order in the shape of the fine print will be made public soon.
They were of the view that the verdict is a clear green signal for the Kishanganga project because Indian spokesperson Syed Akbaruddin, announcing the decision on Monday late night, asked Indians to celebrate the coming Sunday as a celebration day.
Official sources, on the condition of anonymity, held Special Assistant to Prime Minister on Water Resources and Agriculture Kamal Majidullah responsible for the defeat in the legal battle over the Kishanganga hydropower project. Giving the reasons for this debacle, they said the team leader had no knowledge about trans-boundary water management. In addition, an undue delay was made by the government of Pakistan in the launch of Neelum-Jhelum Hydropower Plant, which was approved in 1989 and was to begin in 2002. "This vital point gave an edge to India that started Kishanganga in June 2006, while in Pakistan, On July 7, 2007, the Chinese consortium, CGGC-CMEC (Gezhouba Group and China National Machinery Import and Export Corporation) were awarded the contract to construct the dam and a power station, said an official in the water and power ministry, on the condition of anonymity.
Arshad H Abbasi, a water expert, when contacted, made it clear that with the ICA verdict, Pakistan would have to redesign the 969MW Neelum-Jhelum Hydropower Project and it would also cause reduction in hydel power. He said due to the disputed Kishanganga Dam, work on the Neelum-Jhelum Hydropower Project had already been badly affected. At present, Pakistan is facing financial hardship in implementing the Neelum-Jhelum project. The Water and Power Development Authority (Wapda) is also facing internal problems in generating funds for the project and the Finance Ministry is reportedly not providing funds, he added.
In 1960, Pakistan and India hammered out the Indus Water Treaty, which governs the sharing of water on rivers heading downstream from India to Pakistan. However, India had been racing to complete the 330MW Kishanganga project which would divert the River Neelam to Wullar Lake, leaving very little water for the Pakistani project, which is just 70 kilometres downstream from Kishanganga, thus reducing the power generation capacity of the 969MW Neelum-Jhelum plant by about 11 percent. On May 17, 2010, Pakistan instituted arbitral proceedings against India under the Indus Waters Treaty 1960 and approached the International Court of Arbitration (ICA) against the violation of the treaty.
The arbitration went through tumultuous phases after New Delhi and Islamabad failed to agree on the nomination of three neutral judges. Both sides invoked a provision in the treaty under which UN Secretary General Ban Ki-moon had to nominate Stephen M Schwebel, a former president of the International Court of Justice, as the head of the seven-member arbitration bench. The bench for which the two countries nominated two members each visited both sides of the LoC before beginning a detailed hearing which concluded on August 31 last year.
The seven-member International Court of Arbitration (ICA) barred India from undertaking any permanent works above the riverbed level at the Gurez site of the Kishanganga hydel project dam. Due to the effect of the stay order, work remained suspended for more than one year.
An official of Wand Power Ministry told this scribe that Pakistan needs Rs2 billion on a monthly basis to continue work on the Neelum Jhelum project. Due to the undue delay in the proper commencement of the Neelum Jhelum project, the cost of the project has ballooned from 84.5 billion to a staggering Rs 274.8 billion, which might result in an exorbitant power generation cost of over Rs 10 per unit, against the existing hydroelectric generation cost of 16 paisa per unit.
The burden of the costs arising out of delays and inefficiency is also expected to be transferred to consumers, as the government has decided to arrange 40 per cent of the required funds through a levy on consumed energy imposed by the Government of Pakistan
It is a matter of deep concern that a permanent works above the riverbed is not allowed. But India went ahead with the construction of a powerhouse, tunnelling works, constructing cofferdams, temporary bypass tunnel and concretisation under the riverbed for the dam. And the controversy owes its genesis to India's plan to build a 330-megawatt hydropower plant in Held Kashmir across the Jhelum River.
The dam site is located 160 km upstream from Muzaffarabad and involves the diversion of Kishanganga River (called the Neelum River in Pakistan) to a tributary named Bunar Madumati Nullah of Jhelum near Bunkot. The diversion will change the course of the Neelum by about 100km, which will then join the Jhelum through Wullar Lake near the town of Bandipur in Baramula district. As a result of this diversion, the Neelum and Jhelum rivers which at present join each other near Muzaffarabad at Domail will meet in *** Kashmir.

Pakistan needs to do a lot of homework , not just with its water, but on all fronts if it has to improve and survive. The problem is too much of Inshallah and when nothing works it's more Inshallah. As they say Pakistan Is in no hurry to get anywhere.

This bomb shell of a judgement couldn't come at the worst time for the pakis as the elections are fast approaching and Zardari's arse is about to be whippded by that launda Imran khan. Again this is far more damaging to Zardari's dream of creating a ruling dynasty as the Gandhi family have done quite successfully just across the boarder. What effect will this have on young Blabal bhutto's dream of becoming the next President of Pakiland is anybody's guess. From the average paki's point of view, this judgement may bring changes in pakiland that would have been impossible under the very corrupt government. Imran Khan, who (hopefully ) is likely to win the next general elections , has promised to fight corruption and to eleviate poverty. Let us hope Zardari & co. is driven out of pakiland and people of pakiland can have a better future. All this possible simply because pakis lost this Krishna Ganga case.Now that can't be bad.Oh! u pakis have a nice day

How can water from Krishna Ganga go to the land of sinners? How can prokis use it as it carry name of Hindu Gods? Let them die until and unless they start worshipping Lord Krishna and Ganga!!!!! haa haa.

The central point of Pakistani intentions was to claim exclusive rights over the Western rivers and claim that India has no rights over those rivers.

That spirit stands rejected.
Rest all are technicalloties.
When where and how the flow of the rivers will be utilised and controlled would depend on usage, time and emergencies.

India will have dams before Pakistan have those downstream. That is an advantage. Emergencies and exegencies can be created.

Pakistan is a military and security state. There main fear appears to be not the water but ability to use water for security purposes.

Most of the water channels and canals that exist in Shakkargarh and Sialkot sectors are fed by rivers coming form J&K. Control over the flow of water will give India control over the flow of water in these canals and also ability to flood border araes selectively. That has security hezard for Pakistani defensive and offensive plans.

In 1965 one of the Pakistan thrust by one Armed Brigade of pattons was stopped dead by India in Khem Karan by flooding these areas. That became grave yard of Pattons. Since then water, its storrage and flooding have become militray tools.

The court judgement is reitration of the basic principle that India has rights over the uses of Western rivers and Pakisatn can not cry over it. Technicalities can be negotiated. Hence it is a sort of victory for India.

guys we understand pakistan problem , but pakistan was wtong on his claim , do you know population of india.


I wish now pakistan stop antiindia becuase thats the main reason of pakistan failure.

I am no expert and I got confused while listening to this debate. Can you guys dissect this issue based on the above
discussion.
They have lost the case, simple and straight. When ever Paki's squabble :argue: in this manner in debates, the final conclusion can be that they have lost the case the lawyers have a different understanding of the judgment and the Engineers have a different one.

I have not seen judgment or facts of the case, not even this video, but the point which i want to make is that Pak has long history of successfully selling its people lost wars, as wins. So i wont be surprised if they are saying they have won..............:rofl:

Different sources are throwing different numbers about homw many dams india is planning to build..

Can some one tell me with the reference of indian source, how many dams we have already built, and how many more are planned.

Ok I got it, these con artists recognise that India has respected IWT so far but they are worried that we will be able to control the water taps, since they want to continue with their terrorism and cutting India into 1000s of cuts which they have been doing since 2 decades now India with such a comprehensive control we will be able to punish them at whim.

These all clowns are ranting hot and cold because army have been trying to create pressure on India and build public opinion. Their usual logic that there is harm to bully timid hindus, eat food to their fullest and call our names at the same time.
