They returned ? I must be dreaming.

Also surprised for some guys wanting them to be pardoned. That way any criminal goes home for diwali celebration, return and will be pardoned.

Will we be doing justice to the family of those killed ? Why invite more trouble and give chance for the people of that state to rally against republic of india in case if they are pardoned ?

But yes, i wud have them punished mildly as there was no intention of the murder, but they have committed a mistake for which they should punished, 2 years may be.

Murder is not "non cognisable offence" which means it cannot be withdrawn by any party. So trial will run its full course, plus now it is international matter so they have to follow the procedure strictly.

Two Italian sailors charged with killing two Indian fishermen on Friday lost their Supreme Court bid to be tried on home soil, a victory for New Delhi in a diplomatic tussle over jurisdiction that has strained ties between the two countries.

The sailors, members of a military security team protecting the cargo ship Enrica Lexie, say they mistook the fishermen for pirates off the southern Indian state of Kerala in February 2012.

The Supreme Court ruled that a special court should be set up to try the marines, lawyers who attended the hearing told reporters afterwards.

New Delhi, Jan 18 (IANS) The Supreme Court Friday ruled that the Kerala government has no independent jurisdiction to try two Italian marines for shooting down two Indian fishermen off the Kerala coast last year.

The apex court bench of Chief Justice Altamas Kabir and Justice J. Chelameswar

held that it was only the union of India that had the jurisdiction to hold the trial of the two marines Massimilano Latorre and Salvatore Girone.

However, the court said the central government, in consultation with the chief justice, will set up a special court to hold the trial.

The Italian government will be free to raise the question that it had the jurisdiction to conduct the trial of these two Italian marines in their country.

Upon raising this issue of jurisdiction, the special court will decide the question whether the government of India or the Italian government has the jurisdiction to conduct the trial of the two marines under the Marine time Law.

Two Italian marines, Chief Master Sergeant Massimilano Latorre and Sergeant Salvatore Girone, on board the Italian cargo vessel Enrica Lexie had shot dead two Indian fishermen Feb 15 last year suspecting them to be pirates.

Italy has decided not to send two marines back to India, where they stand accused of shooting two local fisherman, the Foreign Ministry in Rome said on Monday.

"Italy has always held that Indian authorities violated international law" in the case, the ministry said, adding that Foreign Minister Giulio Terzi had instructed Italy's ambassador in New Delhi to deliver a written note to the Indian government.

The case relates to Massimilano Latorre and Salvatore Girone, who are accused of fatally shooting the fisherman off the coast of Kerala, mistaking them for pirates.

India's Supreme Court in February let the two men return to Italy to vote in general elections. However, the court has ruled that India has the jurisdiction to try the two marines.

The two men, who were being held at the Italian Embassy in India and reported to a local police station once a week, were also allowed to return to their families for Christmas.

Italy has long held the case should be transferred to Italy, arguing that the actual shooting had taken place in international waters.

Rome's request that New Delhi agree to pursue a bilateral dialogue to find a diplomatic solution has gone unanswered, Mr. Terzi's office said.

Supreme Court recently ruled that Kerala Court has no exclusive or independent jurisdiction over issue.

It itself meant that if Italian Govt raises their authority of putting marines in Italian court, the plea will be considered & passed most probably.

Italy marines will not return to India

ROME (Reuters) - Two Italian marines charged in India with killing two fishermen while on anti-piracy duty will not return from a special home visit granted to allow them to vote in last month's general election, the Italian foreign ministry said on Monday.

The ministry said that India had not responded to Italian requests to seek a diplomatic solution to the case and there was now a formal dispute between the two countries over the terms of the United Nations Convention of the Law of the Sea.

"Italy has informed the Indian government that, given the formal initiation of an international dispute between the two states, the marines Massimiliano Latorre and Salvatore Girone will not return to India at the end of their home leave."

The Supreme Court on Friday permitted two Italian marines, accused of shooting dead two Indian fishermen off the coast of Kerala, to travel to their country to cast vote in the upcoming elections there.

A bench headed by Chief Justice Altamas Kabir said that the accused marines,


Massimiliano Lattore and Salvatore Girone, would travel to Italy under the control and custody of the ambassador of Italy in India, to cast their ballot in the elections scheduled for February 24 and 25.
The bench also comprising justices AR Dave and Vikramajit Sen allowed the plea of the two marines and the Italian government to allow them to travel for four weeks to Italy.

"We are inclined to allow the prayer," the bench said while asking the Italian ambassador to file an additional affidavit on behalf of the Republic of Italy.

While allowing the plea, the bench noted that under the Italian law, the marines are not entitled to cast their votes through postal ballot.

The bench said that the marines are only allowed to travel to Italy and remain there and will have to return to India.

During the hearing, the court was told that the trial court in Kollam, Kerala, has not handed over the passports of the two marines to Ministry of Home Affairs (MHA) in accordance with the January 18 order of the apex court.

The bench was told that passports have been mailed on February 16 and it has not yet been received by the MHA.

Taking this fact into consideration, the bench permitted that in case the passports are not received, the marines can travel on the temporary documents and the MHA will inform the authorities at IGI Airport and Central Industrial Security Force (CISF) about this order.

The two marines were on board the Italian vessel 'Enrica Lexie', when they had shot dead the two fishermen on February 15, last year.

The apex court also said that the marines before leaving and after arriving back in India shall report to Chanakyapuri Police Station in accordance with the apex court's January 18 order.

On January 18, the apex court had turned down the Italian government's plea that the Indian courts had no jurisdiction in the case and had held that the two marines should be tried by the Centre by constituting a special court to conduct their trial.

"The incident of firing from the Italian vessel on the Indian shipping vessel having occurred within the Contiguous Zone, the Union of India is entitled to prosecute the two Italian marines under the criminal justice system prevalent in the country," the bench had said.

It had directed that the two be shifted to Delhi and would remain under it's 'custody' till the special court is set up.

The court had said that the Kerala government did not have the jurisdiction to prosecute the two foreign marines and it is to be done by the Centre in the special court to be set up after consulting the CJI.

The court had also said that all the conditions imposed on them by the Kerala court, while granting them bail will remain till the special court is set up and the marines will mark their presence at least once a week before Chanakyapuri Police Station.

Section 340 will be on Italian ambassador, by giving his affidavit he has let go his immunity under the International law, SC can virtually shut down their embassy in India, if they fail to do good their undertaking. Let see how this play down now.

Sanio Manio should be sent to Italy on a One Way Ticket and Italian Government should make every effort to avert her from entering India just like the Marines.

Mark my words, These Italians won't come back, We will have the Italian Choppers also which will be rigged to crash on the day chosen like when NAMO is our PM. And all these Choppers will be delivered with full payments with nobody being found guilty. If their is anyone on this site who wants to question my ability or knowledge, I can tell you that every engine controlled by a chip, can be programmed for destrution on a date and time of choice. These Itallion choppers are killer machines which shud be sent to crushers asap and no Indian non congress PM or VVIP shud fly them. We might have ZIa-Ul-Haq being repeated in India.

What you guys still talking about?

SC itself declared that Indian Court has no independent jurisdiction over this trial. Special Court has been setup under that announcement which allows Italy to claim their authority over trial.

The Italian Marines did come back after Christmas, respecting Kerala High Court. After Supreme Court's declaration that Indian Courts do not have independent jurisdiction over this matter, Italy is well within its rights to say the Marines won't return. Why are we not seeing things from the larger perspective?

Alarmist title of the article.
