NEW DELHI: Police on Tuesday arrested five activists during simultaneous multi-city raids that began early in the day, in Mumbai, Thane, Hyderabad, Ranchi, Delhi and Faridabad. Police alleged these activists have links with the banned Communist Party of India (Maoist). The five arrested are activist-lawyer

(Faridabad), human rights activist-lawyer

Arun Ferreira
(Thane), lawyer Vernon Gonsalves (Mumbai), human rights activist Gautam Navlakha (Delhi) and revolutionary writer P Varavara Rao (Hyderabad).


Here are more details on the five people arrested:


Sudha Bharadwaj
: She's a human rights lawyer and activist who's a member of and office bearer (national secretary) at the People's Union for Civil Liberties (PUCL). Bharadwaj has worked in Chhattisgarh for close to three decades, as an advocate for the civil and human rights of Dalits, farmers, labourers and tribals; she also works against land acquisition on behalf of these groups.


Bhardwaj actually became a lawyer as late as in 2000. Since, she's been practicing in the Chhattisgarh high court. She is also a visiting professor at the National Law University, Delhi.


Bhardwaj is also associated with the Chhattisgarh Mukti Morcha (Chhattisgarh Liberation Front) party founded by the later Shankar Guha Niyogi to fight for the cultural identity of the region and for the upliftment of workers and peasants.


In the past months, not only has she been accused of being sympathetic to the Maoists and their allegedly violent insurgency, she's also been targeted for allegedly receiving money from them.


Bharadwaj has consistently denied this. In a post she wrote in January for the website Sanhati, she described her work.


"As a human rights lawyer I have appeared in cases of habeas corpus and fake encounters of adivasis in the High Court of Chhattisgarh and also made representations to the National Human Rights Commission (NHTC) in the defence of many human rights defenders. Recently the NHRC had sought my assistance in investigating a case in Village Kondasawali (Sukma, Chhattisgarh). In all these cases I have acted with the professional integrity and courage expected of a human rights lawyer," wrote the activist.
Bharadwaj was arrested Tuesday from Faridabad.


Arun Ferreira:

He is Mumbai-based human rights activist-lawyer and an alumnus of St Xavier's College, Mumbai.


Ferreira has been arrested before, in 2007, on charges of being a Naxal operative in 2007. He was eventually acquitted of all charges. The social work he did for an NGO, Navjawan Bharat Sabha was deemed "covert Naxalite activity". Over the four years after his arrest and imprisonment, 11 cases were filed against him variously under the Unlawful Activities Prevention Act and the Arms Act; he was also charged with sedition, reported Mumbai Mirror. After his acquittal in 2011, as soon as he was released, Ferreira was arrested again and later granted bail later.


Following that, Ferreira completed his degree from Siddharth Law College and began working as a lawyer in December 2016 with another advocate Suresh Rajeshwar. Along with Rajeshwar, he became part of the 'Indian Association of People's Lawyers and the Committee for Protection of Democratic Rights.


"There was a time in my life when I thought it would be impossible to get out of jail, and yet, here I am, a degree in my hand and responsibility on my shoulder," he said to Mumbai Mirror in January 2016.


Ferreira was arrested on Tuesday from his Thane residence in Mumbai.


Vernon Gonsalves

: Like Ferreira, Gonsalves was also arrested in 2007 after being accused of having links to banned Naxalite outfits. Gonsalves was convicted in June 2013 under various sections of Unlawful Activities (Preventions) Act and Arms Act. He had already undergone incarceration for the period he was sentenced for, so he was released immediately.


A former professor of business organization at a prominent Mumbai college, Gonsalves was labelled an ex-central committee member and former secretary of Maharashtra State Rajya Committee of the Naxalites by security agencies. He was charged in around 20 cases. Gonsalves was acquitted in 17 cases as the prosecution.
"It is for the society to decide what I am. But, I am certainly not a terrorist," said an overwhelmed Gonsalves immediately after his release in 2013. He also said that he intends to read the 251-page judgment before commenting on the long-drawn criminal justice system he told TOI back then.


Gautam Navlakha

: He is a journalist, civil liberties, democratic, and human rights and has long been associated with the People's Union for Democratic Right. He was once also an editor at the Economic and Political Weekly, a quasi-academic journal.
Navlakha has travelled to Kashmir several times and written about alleged rights violations in the troubled state. He is also a convenor of the International People's Tribunal on Human Rights and Justice in Kashmir. In 2011, he was stopped at Srinagar Airport and prevented from entering the state and turned back to Delhi. He was charged with Section 144 of the Indian Penal Code which is imposed against an individual or group for unlawful assembly with an intent to disrupt the peace.


Navlakha was arrested Tuesday in Delhi.


P Varavara Rao:

Revolutionary writer, poet and critic Varavara Rao (78), has been a thorn in the flesh of successive governments in Andhra Pradesh and Telangana. Jailed many times, including during the Emergency, he was acquitted in several cases. He has been active on human rights.


Rao was arrested from his Hyderabad residence on Tuesday.

A day after pan India raids, conducted by Pune Police, the Supreme Court on Wednesday ruled that all the accused will be put under house arrest till September 6, which is the next hearing in the case.

However, in a press briefing right after the Supreme Court’s ruling, the Pune police alleged that the “analysis of seized documents reveals the conspiracy is hatched by the CPI (Maoist) party, adding evidence procured by them “points to the role of Varavara Rao, Gautam Navlakha, Arun Ferreira and Vernon Gonsalves”.

The Pune police also alleged that they have concrete evidence of Maoist link in the case.

Earlier in the day, the Maharashtra government while reacting to NHRC’s notice alleging human rights violation through the detention, had said that they have “enough evidence” against those detained.

“We have arrested these accused because we got evidence against them,” said the Maharashtra government.

The NHRC while taking suo-moto cognizance of the detentions had accused the police authorities of not following the standard operating procedures, which it said, was the violation of their human rights.

The five people, namely, Gautam Navlakha, Sudha Bharadwaj, Varavara Rao, Arun Ferreira and Vernon Gonsalves were detained on Tuesday by the Pune police in connection with the Bhima-Koregaon violence.

All search warrants and detentions were carried out under anti-terror UAPA law and IPC sections 153A, 505(1)(b), 117, 120(b) and 34.

Earlier in June this year, as a part of the probe in the Bhima-Koregaon violence, Pune police had arrested 5 people, namely, Surendra Gadling, Sudhir Dhawale, Rona Wilson, Shoma Sen, Mahesh Raut and Rana Jacob, in June, for allegedly delivering hate speeches and distributing disputed pamphlets. Later in June itself, while addressing a press briefing, Ravindra Kadam, Joint CP, Pune, had confirmed that the 5 accused persons have links with Naxals.

During the briefing, Kadam had said that their Naxal links were confirmed following the information and material ascertained from them. Kadam also said that a some among the arrested have been booked earlier for their Naxal links. After the arrests, the police have also recovered a letter containing the plan of a Rajiv Gandhi type assassination plot for Prime Minister Modi.

The recent detentions by the Pune police were seen as the outcome of the arrests of the 5 people in June and information ascertained from them.

The letter accessed by Republic TV talks at length about the meeting that took place on March 19, 2017 in Nagpur. As instructed by you, research fellows from JNU and TISS (Mumbai) have to be sent to interiors and I need immediate monetary aid for it. Please provide the funds immediately. After Comrade Advocate Prashant's arrest, I have stopped receiving funds. In the Nagpur meeting, comrade Surendra refused to give me funds. I spoke to Comrade Sten Swamy who has been elected by Comrade Prashant for PPS work, but he did not commit on providing funds.

The JNU link has also emerged, with Comrade Sudha elaborating about the desire to send research fellows to interior areas.

Republic TV did get in touch with Sudha Bhardwaj who refused to comment on the letter. Comrade Shoma Sen's daughter Koel Sen raised questions about the authenticity of letter. "How can anyone believe in such a letter. In today's time anyone can digitally insert such letters into the hard disk and this is nothing but a clear plant by the agencies," said Koel Sen

Meanwhile, Gautam Navlakha has been put under house arrest after Delhi High Court stayed his detention.

All search warrants and detentions were carried out under anti-terror UAPA law and IPC sections 153A, 505(1)(b), 117, 120(b) and 34.

Top police sources have told Republic TV all those detained “are members of the core committee group of urban Naxals and that they were involved in almost all the Naxal activities happened in the recent times”. The top Pune police sources have also told Republic TV that Rona Wilson and other accused in the month of June were used to report to these people.

The said people were detained following a raid carried out by the Pune police on the residences of people suspected to have Maoist links. The raids were in connection with the Bhima-Koregaon violence.


BHIMA-KOREGAON VIOLENCE
Violent clashes had broken out in Bhima-Koregaon village in Pune district on January 2, leaving one dead and injuring several others. The violence started at an event of Elgar Parishad, attended by a huge crowd of Dalits at Perne village on the Pune-Ahmednagar Road to mark the 200th year of the Battle of Bhima Koregaon.

The Battle of Koregaon was fought between the British East India Company and Pesha faction at Koregaon Bhima on January 1, 1818. After defending their position for nearly 12 hours, the British East India Company had defeated the Peshwas. To commemorate the battle, a “victory pillar” was erected in Koregaon.

The battle and the victory of the British East India Company is significant to the Dalits as the victory pillar features names of 29 Dalits among other soldiers, who were a part of the East India Company. Soon, the obelisk became a memorial for the Dalits for defeating the high-caste oppression. Later in January 1, 1927, BR Ambedkar visited the site, following which his followers started to visit the memorial every year to mark his visit.

WHAT IS THE CASE ABOUT?
Earlier this year, the unfortunate turn of events during the commemoration of the Battle of Bhima-Koregaon, led to caste-based clashes in various regions of Maharashtra, including Mumbai.

After the PM Modi assassination plot letter surfaced, Republic TV accessed another letter, detailing Maoist attacks carried out by them "in the guidance of Naxal sympathiser Varavara Rao and comrade Surendra Gadling, which have gotten them national-level fame".

However, after the 5 arrests, Arun Ferreira, the lawyer of Surendra Gadling had accused the police of fabricating the papers, recovered during the raids to link the incident with Maoists, instead of finding the real cause behind the Bhima-Koregaon violence.

Now, the recent detentions by the Pune police are being seen as the outcome of the arrests of the 5 people in June and information ascertained from them.

WHO HAVE BEEN DETAINED NOW FOLLOWING THE POLICE RAIDS & WHY?

VARAVARA RAO
Maoist sympathiser and writer Varavara Rao has been detained in Hyderabad under UAPA or Unlawful Activities (Prevention) Act. Rao is one of the founders of Virasam, the popular acronym for Viplava Rachayitala Sangam (Revolutionary Writers' Association). The association is infamous for supporting and propagating Naxal ideology.

SUDHA BHARADWAJ
Sudha Bharadwaj has been detained under UAPA, whose letter to one comrade Prakash was exposed by Republic TV on July 4. The accessed letter allegedly established a link between urban Naxals and Kashmiri separatists. Sudha Bharadwaj, who is living in Chhattisgarh for 29 years now is a representative of multiple organisations, including Jagdalpur Legal Aid and Bastar Solidarity Network.

GAUTAM NAVLAKHA
Human rights activist Gautam Navlakha has been put under house arrest in Delhi under anti-terror act. Navlakha, who had in past in Kashmir, was currently focussing his area of work in Chhattisgarh, whose large parts are under Maoists’ influence.

VERNON GONSALVES
Vernon Gonsalves has been detained in Mumbai. In past, too, he had spent time in jail for his alleged links with banned Maoist groups. He was picked up by Maharashtra ATS on August 19, 2007, on charges of having Naxal links and for possessing explosives.

ARUN FERREIRA
Arun Ferreira was detained in Mumbai. He is a human rights activist, who has been accused of having alleged links with Maoists. He was also the lawyer of Sudhir Dhawale and had accused the Pune police of fabricating papers to link Bhima-Koregaon incident with Maoists.

'URBANNAXALS PROVIDE COVER TO NAXAL OPs'
Hitting out at the ‘Urban Naxals’ for providing cover to Naxals and their operations, Major Gaurav Arya (Retd.) said:

“Now, this is a very well-oiled and well-formed nexus. It is supported by certain intellectuals and NGOs and lawyers and the Naxals carry out their operations under the cover of these so-called Urban Naxals.”

Major Arya (Retd.) also lauded the crackdown of the Pune police, saying it is the right thing to do as by “cutting off the oxygen” itself, can the untoward incidents carried out by the Naxals be brought down.

“The tracking down of these Urban Naxals are the right thing to do as they’re the oxygen that actual Naxals need to carry out their operations. Once, you cut this oxygen, it is exactly what the NIA raids did to the stone pelters in Kashmir. Stone pelting has come down in Kashmir because they cut off the funding sources. This is what exactly must be done to the Urban Naxals,” said Major Gaurav Arya (Retd.).

NHRC ACCUSES POLICE OF VIOLATING HUMAN RIGHTS
A press release of the NHRC accused the police authorities of not properly following the “standard operating procedure in connection with these arrests,” adding, “which may amount to violation of their human rights.”

The Maharashtra government has reacted to the NHRC notice, ensuring a response and saying, “We have arrested these accused because we got evidence against them”.

Also, the Maharashtra Chief Secretary has briefed the Ministry of Home Affairs (MHA) over the crackdown, assuring to have strong evidence against those raided and detained.

Meanwhile, even as Gautam Navlakha and Sudha Bharadwaj have been put under house arrest, the other three detained by the Pune police, namely, Varavara Rao, Arun Ferreira, and Vernon Gonsalves will be produced before a Pune court.

The five people were detained on Tuesday by the Pune police in connection with the Bhima-Koregaon violence

Can someone blow up Varava Rao's shitty head into pieces and help AP getting rid of him. Last time in Vizag , he said " Naxals must keep killing police officer". Spouses of slain greyhound officers trashed him with chappals and still no shame in him.

Like it or not Congress had vision, strategy and power do what it wanted, Had they arrested BJP walas they would have rotten in Jail of years.. ASJ Tushar mehta might be a decent lawyer but.. GOI/BJP needs elite predators..they(GOI/BJP) will continue to be beaten till the time they do not get rid of like of Arun Jaitley, Rajnath singh etc etc etc..

We support nationalistic aspirations. Only those princely states that were under Delhi till 1947 and those who agreed to join the Indian Union should be in India. Nehru had even taken the Kashmir issue to the United Nations. If Kashmir was like any other state after 1950, then what is the need for Article 370? If it is a part of the Indian Union, why do you have to send the army? Why do you have AFSPA? From Nehru to Vajpayee, there have been talks on Kashmir with Pakistan, because the government knows it is a disputed issue.

The right to secede is recognised by the Geneva Convention. Many countries have attained independence through plebiscite. It is not unconstitutional. I believe the only way forward for Kashmir is azadi.

What about the views of the Kashmiri Pandits? They even protested at the conference.

There were around 700 people at the conference, most of them supporting azadi. Around 200 of them were Kashmiris. The Sangh Parivar people, including Kashmiri Pandits, were not more than 70. That means the people of Kashmir are not alone in their struggle. Delhi is the common enemy of Kashmir and the struggling people of this country. Those people even threw shoes. What kind of culture is this? This is nothing but Hindu fascism.

What about tie-ups between the Maoists and the separatists?

Right from the days of Charu Mazumdar, we have supported the struggle for azadi in Kashmir and the Northeast. That support remains.

Will the Maoist movement expand into Kashmir?

I can’t say. It all depends on the strength of the Maoists. We will support their nationalist movement as we see it as an anti-imperialist movement. Delhi, like I said, is the common enemy.
