(Geneva) – The United Nations Human Rights Council should act on the recommendations in a report commissioned by the UN Secretary-General detailing grave abuses during the final months of Sri Lanka's armed conflict, Human Rights Watch said today. UN Secretary-General Ban Ki-moon sent the report to the council on September 12, 2011. Ban has said that he would welcome a mandate to establish an international investigation mechanism, the main recommendation of his Panel of Experts report.

In May 2010, Ban commissioned a three-member Panel of Experts to advise him on accountability in Sri Lanka after President Mahinda Rajapaksa failed to investigate alleged laws-of-war violations during the conflict, which ended in 2009. The panel's report, published on April 25, concluded that government forces and the separatist Liberation Tigers of Tamil Eelam (LTTE) conducted military operations "with flagrant disregard for the protection, rights, welfare and lives of civilians and failed to respect the norms of international law." The report also said that tens of thousands of civilians might have been killed during the last five months of the war, the majority by government shelling.

"When a UN Panel of Experts report concludes up to 40,000 civilians died amid war crimes, the Human Rights Council should feel compelled to act," said Brad Adams, Asia director at Human Rights Watch. "The council should order a full international investigation – anything less would be a shameful abdication of responsibility."

The Panel of Experts examined "reports, documents and other written accounts" by UN and inter-governmental organizations, nongovernmental groups and journalists and experts on Sri Lanka," as well as satellite imagery, photographs, and video materials. It reviewed submissions received in response to requests on the UN website, and consulted individuals with expertise or experience related to the armed conflict. The panel included allegations as credible "when based on primary sources that the Panel deemed relevant and trustworthy. These primary sources were corroborated by other kinds of information, both direct and indirect."

The panel recommended that Sri Lanka conduct genuine investigations into the allegations alongside the international investigation, but it also found that "Sri Lanka's efforts, nearly two years after the end of the war, fall dramatically short of international standards on accountability and fail to satisfy either the joint commitment of the President of Sri Lanka and the Secretary-General, or Sri Lanka's legal duties."

Instead of responding to the report seriously, the Sri Lankan government launched an aggressive public relations offensive against both the report and panel. The government's official news portal stated that it "strongly rejected" the report, calling it "illegal," as well as "biased, baseless and unilateral."

"The Sri Lankan government has stone-walled allegations of abuse for more than two years, making ridiculous claims about global conspiracies and faked evidence," Adams said. "The Human Rights Council should tell the government that time is running out. If the Sri Lankan government won't provide justice for victims, the international community will."

UN panel of report never came to Sri Lanka! How they know hoe many died??? Human right watch always biased towards LTTE! you shouldn't have known it because u weren't in Sri Lanka! By the way they never listen to our plea to stop until our own investigation comitee report published

AFAIK, There are 2,00,000 SL tamil living in Canada and helping the SL economy with lots of remittance.

TAMIL =/= LTTE

BTW, LTTE is SriLankan terrorist group. What India has to to do with this ??

india,pakistan,china,israel,russia,srilanka,cuba,venezuela,iraq(gadafi) but mainly india ,pakistan ,china ,israel and russians provided lot of weapons ,most of them cheaply and indian raw worked around lanka gathering information and postions of ltte,indian navy destroyed many supply ships to ltte.
So if srilanka faces alone it would have be defeated.

Well what about LTTE??? USA, England, France, Germany, Switzerland, Norway, Canda, Japan, Australia they all helped LTTE by not stop Tamil Diaspora sending money to LTTE and never prosecuted any LTTE sympathizer even though LTTE banned in those countries!

If what was done to him, some may say much less would have made Rajapakse squeal equally loudly in true classy porcine manner.

Therefore, could I request you to be a little more diplomatic since it may inflame passions that I would find very difficult to handle and delete or warn people.

So if srilanka faces alone it would have be defeated.
We assisted Lanka demolish the LTTE and in the process help ethnically cleanse ten of thousands of Tamils, and what good did it do to us, only to have the Sinhalese come here and taunt us.

The only way we can redeem ourselves is to help the Tamils in north and east carve out a Tamil Elam for themselves. its to our strategic advantage.

It is obvious there would be areas of discord and it would seriously irk you.

We can discuss that, but it is preferred that one should do so with facts and civility.

I personally appreciate your input except the use of rather 'exotic' imagery!

I am sure you must have watched this video numerous time to celebrate victory of great sinhalese soilders . I have only one question for you . how would you react if tamlians at the end are replaced by sinhalese.

I don't think that India should embark on any Freedom and Democracy movements.

There is no doubt that the Tamils of SL has had a bad bargain, but I am sure they will be able to fend for themselves since they are an intelligent lot.

I am sure the Buddhist Sri Lankans will also rise to the occasion and display statesmanship and camaraderie for their own citizens.

The reason for his fear is justified by the way India handled the LTTE issue in Indira regime.... thats why Jajeev got the chance to see the rifle but on his head!

Why no country ever said anything about the LTTE breaking ceasefire or force them to behave properly?? why suddenly u people got fond of their cause??? Are you ppl evan aware what is the root cause of the problem??? don't take Tamils granted because their your ppl!!!

There is no way Indian can remain aloof to the unfolding tragedy, with the bogey of 'terrorist LTTE' gone India has the freedom to venture further than it has done in past decade without having to look over her shoulder. the devotion of power to a federal Tamil state in the north east one of the principal terms of the Indo-lanka accord has been put in the back burner, the merging of the Northern and Eastern Lanka into a single autonomous administrative unit, another principle enshrined in the 1987 accord, has also now been dissolved.

Sri Lanka has cocked a snook at India and it has done so without eliciting a shrug from the regional super power. India must intervene decisively to restore its international credibility.

WTF you talking about are you even know about Sri Lankan history??? 13th amendment was forced on us and even Tamils are not satisfied with provincial states! In '82 SL govenrment gave Tamils the autonomy govern their regions but that didn't work! then the province! Even that didn't work they won't a seperate home and we aren't going to give them any!
