Centre appoints acting CJ of MP High Court, disregards SC Collegium recommendation

    Centre appoints acting CJ of MP High Court, disregards SC Collegium recommendation


    Disregarding the recommendations of the Supreme Court Collegium, the Centre has notified the appointment of Ravi Shanker Jha as the acting Chief Justice of the Madhya Pradesh High Court with effect from June 10.

    On May 10, the Supreme Court Collegium headed by Chief Justice of India Ranjan Gogoi had recommended Justice A.A. Kureshi, currently the senior-most judge at the Gujarat High Court, as the most suitable candidate to be appointed as the Chief Justice of the Madhya Pradesh High Court.

    Regarding Kureshi's appointment, the Supreme Court Collegium had said: "Justice A.A. Kureshi is the senior-most Judge from Gujarat High Court and at present is functioning, on transfer, in Bombay High Court.Having regard to all relevant factors, the Collegium is of the considered view that Justice A.A. Kureshi is suitable in all respects for being appointed as Chief Justice of the Madhya Pradesh High Court. The Collegium resolves to recommend accordingly."

    The Collegium's decision came as the Chief Justice of the Madhya Pradesh High Court Justice Sanjay Kumar Seth was scheduled to retire on June 9.

    Though, the Collegium recommendation is pending, the Centre issued a notification stating, "by the powers conferred by Article 223 of the Constitution of India, the President is pleased to appoint Justice Ravi Shanker Jha, senior-most judge of the Madhya Pradesh High Court, to perform the duties of the office of Chief Justice of that High Court with effect from 10 June, 2019 consequent upon the retirement of Justice Sanjay Kumar Seth, Chief Justice, Madhya Pradesh High Court".

    The Centre is yet to approve the elevation of Justice R S Chauhan, who was recommended by the Collegium to be elevated as Chief Justice of the Telangana High Court.

    Justice Chauhan is the senior-most judge in the Rajasthan High Court and at present is functioning in the Telangana High Court as Acting Chief Justice.

    Similarly, the Centre is also yet to clear the elevation of Justice V Ramasubramanian, the senior-most judge in the Madras High Court, who has been recommended to be elevated as the Chief Justice of the Himachal Pradesh High Court.

    I see this as a very positive development. These bloody people has started interfering in each and every matter of Government and matter of Hindus. It was a high time that they should be shown their place. I am very happy their recommendation is ignored and a massage is given to them. Do not try to cross your limits else we shall cut you to the size.

    May be Modi&Shah personally know about this 'secular judge' that is why they kept him away.:biggrin2:

    Like there is a Lutyan gang doing all dirty work, there is a gang of SC judges worse fathers were politicians or were stooges of some political parties. They started interfering in all administrative decisions of Government and subsequently extend it to even policy matters. Now they have started encroaching our basic rights and they decides how much water should be poured of Mahakal shivlinga, Height of Dahi handi in Bombay, bullock race of Jallikattu, Tuggal flight on kite flying festival of Gujarat, Fire crackers timing and other limits. Now they should be kicked out of the system and until it is done , we need to show them their place and tell these bastards that be in your limit else your dirty @$$ shall be kicked like Jallikattu.

    Prashant Bhushan had rightly said that half of the CJ of supreme court were corrupt. He challenged SC to run a contempt case on him. I do not know what has been done till date. Justice kapadia had directed the government to make stringent provisions for Judiciary without being afraid.

    Wow. Govt must have rattled Judgees to the core. This Collegium needs to broken down urgently. Present form of judiciary is an extended arm of British Raj. Last standing pillar of colonialism.

    Actually their work is to interpret constitution and bring balance but they in themselves has become a vested interest group and has started the encroachment in the rights of Executive and legislature. They must be shown their place. They are trying to marginalize the right of parliament and even president.

    Anyone who knows the inner workings of collegium can vouch for one simple fact - that it is incredibly corrupt & nepotism is rampant.

    That a body like that which is so opaque exists in a democracy is utterly unacceptable.
