Amnesty International India booked for sedition and rioting over Kashmir event in Bengaluru
Legal provisions invoked include spreading enmity between two groups

Bengaluru police booked human rights advocacy group Amnesty International India on charges of sedition and spreading enmity between two groups on Monday.

The JC Nagar police have booked a case against Amnesty, following a complaint by an ABVP member on August 13, on the day the human rights group organised “Broken Families”, an event on alleged rights violations in Kashmir.

Inspector Ramesh Kumar told The News Minute that no member of Amnesty had been named in the FIR which has been registered under Sections 142, 143 (unlawful assembly), 147 (rioting), 124a (sedition), 153a (promoting enmity) and 149 (common intent) of the IPC. Ramesh said that a call would be taken on arrest only after investigation.

event on Saturday at the United Theological College had invited family members of people who had allegedly been disappeared by the armed forces. Among the panellists were journalist Seema Mustafa, and former journalist RK Mattoo.

While members of the audience listened quietly to the testimonies of people whose family members had disappeared, arguments began when Mattoo said that the Indian Army was very disciplined. Some of the members of the audience took objection to these remarks.

Slogans pro and against the army presence in Kashmir were raised. Later on, people also raised slogans for ‘azaadi’.

In his complaint to the JC Nagar police the ABVP’s Bengaluru City North Organizing Secretary Jayaprakash claimed that the panellists “and Roushan Illahai sang anti-national songs, raised anti-national slogans, made anti-India and anti-national speeches, raised slogans saying India’s Kashmir should go to Pakistan. They (organisers) expressed support for terrorists, Pakistan, and ISI. They organized an anti-India, anti-national program”.

Roushan Illahi is a Kashmiri rapper who goes by the stage name MC Kash. He performed at the event on Saturday.

ABVP demanded the arrest of people who participated in this “anti-national program”. They also claimed that when ABVP workers came forward to stop this (program), they were assaulted.

Karnataka Home Minister had on Sunday said that action would be taken against “anti-nationals”. "Some information is that they may be refugees residing here, but what was their intention, who provoked them, why did they do it, need to be inquired into," he had said.

BJP’s Karnataka state president BS Yeddyurappa had written a letter to Home Minister Rajnath Singh on Sunday, demanding the strict action against people who had organised the “disturbing” event.

Reacting to the FIR, Aakar Patel, Amnesty International India’s Executive Director said in a statement, “Merely organizing an event to defend constitutional values is now being branded ‘anti-India’ and criminalized. Tghe police were invited and present at the event. The filing of a complaint against us now, and the registration of a case of sedition, shows a lack of belief in fundamental rights and freedoms in India.”

Amnesty added that the Bengaluru Police were informed about the event well in advance.

“Amnesty International India as a matter of policy does not take any position in favour of or against demands for self-determination. However, Amnesty International India considers that the right to freedom of expression under international human rights law includes the right to peacefully advocate political solutions, as long as it does not involve incitement to discrimination, hostility or violence. The Supreme Court has ruled that expression can be restricted on grounds of public order only when it involves incitement to imminent violence or disorder. India’s archaic sedition law has been used to harass and persecute activists and others for their peaceful exercise of their right to free expression. Section 124A of the Indian Penal Code defines sedition as any act or attempt “to bring into hatred or contempt, or…excite disaffection towards the government.” Mahatma Gandhi had called the law “the prince among the political sections of the Indian Penal Code designed to suppress the liberty of the citizen.”

briefly - in the early 90s a team of wildlife researchers & Nat'l geographic cameramen who had come to J&k to film the rarely spotted Himalayan snow leopard, were abducted by terrorists in IA uniform. they were held captive for some days, and were told by them to go out & tell AI when freed, that (how) the IA indulges in human-rights violations here. ofc the captives werent ever witness to such a thing.

Some Pandits objected to this and asked for a fruitful discussion on aspects like why youth are taking up stone pelting and such activities in the valley. This was not agreed by event organisers, and continued with the IA bashing agenda. When the rapper had started his songs with anti india sentiments, Pandits started to leave the venue.

As they were going out , anti india slogans were started by Kashmiri students (these Kashmiri students are studying in Bangalore on govt scholarships).

ABVP submitted a written complaint along with video evidence. FIR lodged and no arrests made.

This is the story so far based on news reports.

am glad that these are NEWS reports. otherwise the trend these days is such that this would've been dubbed a cultural fest & KPs + ABVP declared the hooligans among peacephools in the show.

Not Sushil pandit , Arnab should call RK mattoo. He was present at the event. RK mattoo is a SR journalist based out of Bangalore I think.

Mattoo also alleged that Amnesty had no authentication for the claims of the families featured in the 'Broken Families' campaign.



Following protests and an FIR against Amnesty International India on Monday, RK Mattoo, president of the Kashmiri Pandits Association in Bengaluru, said that he was "100% in support" of the charges against the human rights advocacy group.

"The event was organised just to malign India's armed forces," Mattoo alleged. "You cannot just organise an event in Bengaluru against the country and get away with it," he said.

Mattoo recalls that they weren't invited to the event initially. He only came to know about the event through a colleague and then contacted Amnesty so that they could talk about the issues of Kashmiri pandits also.

"We were butchered in 1990s and now we are living like refugees in our own country. Being a human rights organisation, why is Amnesty silent on this?" questions Mattoo, adding that the people responsible for their plight are still roaming free today.

According to Mattoo, though the event 'Broken families' was designated to start at 7 pm on August 13, till 4 pm, Amnesty's Tara Rao and Aakar Patel, were still speaking to him about what he could talk about.

Then, when Mattoo said during a panel discussion that the India's armed forces are one of the "most disciplined" in the world, anti-army slogans were raised by many. However, Mattoo stands by his statement and says that if there have been excesses, armed forces personnel have been tried in court martial courts and punished.

"Why are you targeting the army? Why are you silent on the terrorism that happens there? The army is protecting us from that!" says Mattoo.Mattoo also alleged that Amnesty had no authentication for the families featured in the campaign. "They (Amnesty) told me that if someone comes to them for human rights violation, they give them a platform. But they should be asking why were these boys picked up by the army in the first place," Mattoo says.

Mattoo added that clarified that his support for the complaint against Amnesty was not reflective of any political affiliations but simply a regard for the country.

"It's a matter of India's security and sovereignty. It has to be taken seriously," he asserted.

I have no opinion on who is better, but mattoo's presence there at the event definitely ensured that the right narrative came out of this episode. If some NDTV journo was there, pretty sure the correct story would not have come out.

Why cant we have more like Mr. Mattoo, who attend such seminars on the pretext of being sympathetic & contributory to the 'causes', and then apprise the authorities and the country of what transpired there, secretly or openly?! The organisers will have more number of panelists (& if someone who is generally considered to be from the 'other spectrum' but shows/feigns interest to participate in a conference baiting them that s/he would also lend ears as well as contribute, then all the more good!), the countrymen wiser about all the games being played, the authorities will have inputs, & internet-warriors will get more anti-propaganda ammo! Benefits all.

Yup, was about to post on similar lines.

Times have changed, vocal rhetorics no longer works in the age of "fast moving news" age. Words and speeches on TV channels have limited influence.

Pictures speak a thousand words, in this case videos speak a million words.

Our word against theirs is no longer working. Once public see visuals for themselves, few words are required for convincing them of anti-india activities happening in the country in the guise of FoE.

Having said this, individuals alone cannot manage such a large program. Only an dedicated nationalistic fully funded NGO can manage this operation. I say an NGO should be created with sufficient funds who track such meetings/seminars and video record these events. Keep filing cases when ever a proof of anti-India activities are recorded. And more importantly funding should not come from any RW political party.

NGO vs NGO is the only way out of this mess. Govt should not get into this, only police and judiciary should.
