New Indian Govt. Eases Standards on Company Blacklisting

NEW DELHI — India's newly elected government will not cancel defense contracts or blacklist overseas defense companies until charges leveled against them are proved by the Central Bureau of Investigation (CBI), a Defence Ministry source said.

That decision came in the form of a directive from Indian Defence Minister Arun Jaitley during a recent meeting of senior MoD officials.

Between 2005 and 2009, the ousted United Progressive Alliance government had barred Singapore Technologies Kinetics, Israel Military Industries (IMI), Zurich-based Rheinmetall Air Defense, Corporation Defense Russia and South African company Denel from doing defense business in India for the next 10 years.

While the CBI recommended barring these companies, none of the charges that they received kickbacks have been proved.

Even the chiefs of the Indian Army, Air Force and Navy who had met Jaitley criticized the blanket blacklisting and cancellation of orders of some overseas defense companies, the MoD source added.

In addition to blacklisting, outgoing Defence Minister A.K. Antony had sent about 100 complaints to the investigating agencies.

A majority of the charges against overseas defense companies were leveled by competitors during the procurement process, and Antony would halt the entire program and forward the complaints to the investigating agencies, the MoD source said.

"There will be no immediate impact on any ongoing weapons procurement program due to the directive by the new government not to rush to blacklist overseas defense companies," said Nitin Mehta, a defense analyst based here.

A New Delhi-based executive of an overseas defense company said that "overseas companies are greatly relieved from the threat of being blacklisted."

The MoD is identifying measures that can be initiated in the next few months to remove bottlenecks in weapon procurement and boost defense preparedness. The exercise is being undertaken by the ministry at the directive of the prime minister's office, the source added.

In addition to the decision about blacklisting companies, the MoD is considering what kind of inducements to offer — possibly in the form of tax incentives — to encourage overseas defense companies to bring sophisticated technology into tie-ups with domestic defense companies, the sources said.

The prime minister's office has also asked the MoD to make a list of defense projects that have been pending for more than five years.

Blacklisting has contributed to shortages of ammunition and affected the purchase of a variety of howitzers.

In 2009, IMI won a $300 million contract to build a chain of ordnance factories in the state of Bihar to manufacture ammunition for Bofors 155mm guns — until blacklisting halted the program.

The blacklisting of Rheinmetall led to cancellation of the tender for wheeled 155mm/52 caliber guns for Indian Army artillery, in which Konstrukta of Slovakia and Rheinmetall of Germany were competing.

In 2005, the blacklisting of Denel on charges of paying bribes and kickbacks ended India's tender to purchase 155mm/52 caliber towed guns. Denel had been the front runner. â–

NEW DELHI — India has removed South Africa's Denel from a blacklist, allowing the company to again do business here after nine years of investigations failed to prove corruption charges related to a rifle purchase.

The Indian Ministry of Defence sent a letter Aug. 12 to Denel lifting the ban, said a source in the MoD.

An executive of Denel, who requested not to be named, said they received a communication from MoD saying the ban had been lifted, but gave no details of the contents of the MoD letter.

"The decision to de-blacklist Denel and allow it to do business in India will send a positive signal to overseas defense companies to do business in India," said an executive of an overseas defense major based in New Delhi.

Denel was banned by the outgoing United Progressive Alliance (UPA) government after allegations that it paid kickbacks to secure a deal with the Indian Army in 2002 to sell 1,000 NTW-20 anti-material rifles along with 398,000 rounds of ammunition.

Under the deal, 700 rifles were to have been purchased directly and the remaining 300 licensed-produced in one of the factories of India's state-owned Ordnance Factory Board. Only 400 rifles had been inducted into the Indian Army and the remainder put on hold after the 2005 blacklisting and investigation by the anti-fraud agency, the Central Bureau of Investigation (CBI).

Charges were filed by the CBI against Denel and the UK-based consulting firm Varas Associates, which allegedly rerouted part of the commission to unnamed officials of Denel and the MoD in India. Varas was not banned along with Denel. None of the charges have been proved by CBI, the MoD said.

The purchase of the anti-material rifles was made during the tenure of the National Democratic Alliance (NDA) government, which was in power from 1999-2004, and returned to power in May. The blacklisting was done under the outgoing UPA government within a year of it coming into power in 2004.

The blacklisting of Denel stalled several Indian Army projects, including the purchase of 155mm/52 caliber artillery guns as Denel was the front runner in that program, which was then canceled.

The blacklisting also delayed the homegrown effort, "Bhim Artillery Project," under which Denel had proposed to install its 155mm artillery gun on an Indian-made Arjun tank chassis.

"Denel will now emerge as a keen competitor in India's $4 billion variety of 155mm/52 caliber artillery gun projects," said defense analyst Nitin Mehta, adding that the South African company may forge tie ups with domestic defense companies to compete in these programs. â–

But new RFQ will be floated for BHIM and by the time the deal is struck the financial bid time will be over and we will be in no suituation to make decision and end up sending RFQ again the process goes on and on:taunt:

Fast track BHIM ASAP with Denel L52 gun instead of carrying on the Antony stubborn era of military aquisition

Our Miyan and our biwi is razi toh kya karega MoD. ;)


They should send confirm order if army is happy with Bhim SPG.

DRDO is our own PSU anyway.

Instead of mounting the 130 mm khataara on Arjun chassis, we shd've absorbed the T5 technology & designed an 'indigenous' L52 SPH. Just like Vidhwansak AMR.
