Watching Porn - Non-Bailable Offence

    The Supreme Court on Monday issued notices to various ministries of the central government on a PIL seeking modification of internet laws to make watching pornography a non-bailable offence.

    A bench of Chief Justice Altamas Kabir and Justices A R Dave and Vikramjit Sen issued notice on Kamlesh Vaswani's petition saying existing laws had failed to prohibit proliferation of internet pornography and alleged that it was affecting the younger generation and resulting in increasing sexual assaults on women.

    Appearing for the petitioner, senior advocate M N Krishnamani said the government urgently needed to take pro-active steps to block all pornographic websites as they were affecting the "peace of mind, health and wellness, happiness and human potential".

    "Absence of internet laws encourages watching porn videos since it is not an offence. This has led to a situation where more than 20 crore porn videos/porn clippings are available in the Indian market, which have been downloaded from the internet," the petitioner said through counsel Virag Gupta.

    Interestingly, many lawyers stood up before the bench in support of the petition, with one of them, Vijay Panjwani, saying the Information and Technology Act was ineffective to deal with the potentially explosive situation created by free availability of pornography, including child pornography, as only a government servant could be a complainant for action against service providers.

    The petitioner said, "Porn is always on demand and watching brutal form of porn increases the viewer's appetite for similar actions within society. Pornographic literature seeks to confirm that people are objects who can be sold and bought in the market. It treats sex as a commodity and exploits it commercially. When exploitation of sex is accepted in society, then all characteristics attributable to commercial exploitation also become acceptable which is to maximize profit."

    Vaswani sought a direction from the court to the Centre to formulate a national policy, action plan and draft a separate law to counter the proliferation of pornography on the internet.

    Just curious how would they enforce such a law. Prosecution: My lord, that person was watching porn. Judge: How do you know it was porn? Prosecution: I saw the clip. Judge: Arrest the prosecution Lawyer!! Judge :(to defense lawyer) Did you see the clip? Defense: Yes, but it wasn't porn. You can see it for yourself Sir.. Judge (after seeing clip): Oh yeah, Oh Yeah, it is porn. Convict: Arrest the Judge too!!!!! Judge: and arrest the defense lawyer for obstruction of justice.

    There should also be a ban on masturbation. Many of the ill thoughts come from fantasies. There should be a sensor on everyones genitals. :rofl:

    Now we need a commission to decide which of them are classified "brutal" and otherwise.
    Hope that there will be a "Late Night" disccusion about this on some awesome News channels.

    Is that mean one can not watch oneself nude in mirror or one's spouse naked as well?

    This is insane. People have no work to do except banning the freedom of people. The PIL people want to show themselves as some sort of Messiah or Saint and get attention. If you can not enforce the existing LAWs even to a least efficient manner, what is the fun in making more & more LAWs.

    Rapes will not stop with this kind of Laws, even more perverts of different kind shall generate out of suffocation/ guilt.

    one onside we don't keep a check on brothels, give permission to the A movies :) and on the other-side we ban internet porn , after a deep pornographic analysis :becky: it like saying stop internet porn and but to the theaters

    How is it going to be implemented?
    They can't monitor that much of traffic on various sites where porn is available for download.
    If they ban any site, there's always proxy.

    One dialogue from The West Wing comes to mind.

    See Guys even looking at well curved female with decent clothes like Sari can invoke unholy thoughts and may be followed by unholy actions?

    Now there are three options 1. females should be fully covered or 2. Females should be banned to visit public places or 3. all men should be removed of their member.

    These PIL saints shall convert entire republic of India in to Holy saudi Arebia/ Holy Vetican church/ Holy Hanuman Ji temple.

    IDIOTIC idea of "banning porn" :dude:

    If this gets implemented then all the males would be behind the bars including the SC Judge proposes/passes this "law". :lol:

    Now that the police have wiped out all crimes across India including terrorism, drugs, illicit liquor trade, traffic violations ... etc etc... now they can peacefully start policing what one does behind closed doors!!

    If watching porn on the internet is crime then anyone who has spent more than few hours online is a criminal. :rofl: The whole legal system seems to be confused over the morality issues. They promote women in skimpy clothes as 'progressive', item numbers in the movies are legal, live-in relationship is ok, but watching porn is crime?
