US court permits Sikh group to summon Manmohan Singh

NEW YORK: A US federal judge in Washington has granted a Sikh rights group's plea to serve summons on Indian Prime Minister Manmohan Singh in a case of alleged violation of human rights during his tenure.

The 1965 Hague Service Convention allows the process of judicial documents from one signatory state to another without the use of consular and diplomatic channels.

A Washington federal court had issued summons against Manmohan Singh during his September 2013 visit to Washington on a plea by Sikhs For Justice (SFJ) accusing him of "funding crimes against humanity perpetrated upon the Sikh community in India."

In response to SFJ's plea for extension of time to serve summons on Manmohan Singh in India, Judge James E Boasberg on Friday ordered that "plaintiffs shall by April 14, 2014, either file proof of service or file a status report updating the court on their progress in effecting service."

SFJ had filed a motion with the court requesting extension of time.

In support of its motion, SFJ submitted a copy of the engagement letter retaining Process Forwarding Internationala (PFI), a Washington-based firm to serve summons on Manmohan Singh in India as per Hague Service Convention.

Gurpatwant Singh Pannun, legal adviser to SFJ cited the US state department's recent Human Rights Report in support of SFJ allegations of "widespread torture, extrajudicial killings and security force abuses" during Manmohan Singh's tenure.

SFJ has also alleged that Manmohan Singh, as finance minister of India, funded several counter insurgency operations in Punjab during the 1990s resulting in more than hundred thousand Sikhs being killed extra judicially by Indian security forces.

Under Alien Tort Claims Act (ATCA) and Torture Victim Protection Act (TVPA), US federal courts have jurisdiction over cases of human rights violations even if they have occurred on foreign soils as in this case, Pannun said.

Good thing is that PM Manmohan Singh can't settle in USA after his term expires after this general election in India. That's one destination less.

I know it's not funny, but in a way serves them right.

Should have thought this before deriving political benefit from the visa ban on a Chief Minister of a state in India.

Do you remember 65 MP's wrote a letter to USA to not reconsider visa ban on Modi ( heck the letter had some counterfeit signatures of some MP's).
No, investigation took place into the letter and no objection on the visa ban.

Even, this case is not new. The group tried to give the summon to PM Singh when he was in NY for UNGA. But couldn't due to security cordon.
They tried to deliver the summon to Sonia Gandhi when she was being treated in a hospital in USA. She then had to file a representation in court that she didn't get the summon, through her lawyer.

Even some issues were there when Kamal Nath was to visit USA on official business.

So, the action isn't funny but the reaction is.

This american, Canadian and British Sikhs are crossing their limits, I blame Indian Government's loose emigration policy, thousands of Sikhs settled in US, they always criticize India and talk about 1984 riot, compare Bhindranewala as saint, terrorists as liberation fighters. :tsk: :tsk:

Extra judiciary killings? Yes they are condemnable, but what about killing of Hindu people by terrorists? what about killing of non-Khalistani Sikhs by terrorists? When warfare happens a number of people are bound to be killed in crossfire whether they are innocent or not. I am not justifying 1984 riot but these are inevitable in armed resurrection. Some thing cant be avoided.

Police in similarly brutal way, suppressed Naxal movement in WB in 1970's.

Who the hell is US Government to say us what to do or not? What the heck US Sikhs did to India that they cry about humanity now? Instead of doing this, if they came to Indian Punjab, helped drug addicted youth, then they would have been real Sikh.

This should be quite easy, get some random muslim group here to file a case on Obama about the 6672631412 odd "human rights violations" that have occured during his time, tit for tat achieved.
It seems they want to be seen as the saviour of Khalistani sikhs and other nonsense, quite hard when they keep targeting Sikhs in hate crimes and calling them terrorists and vandalizing gurudwaras.

Till we Indians try to use them to put each other down they'll act like this only. Make no mistake some Indians are pleased at this news, similarly some Indians will be pleased if the same happens to modi while forgetting its an insult to India.

There are only a few Sikhs in USA who are anti-India...believe me..most Sikhs in USA are not Anti India. The paid and bought media exaggerates these negligible number of Anti-India 'gaddars" Most Indians living in USA still love India and want the best for their great native land.
They feel happy when India stands tall and is not afraid of hegemonistic powers who have historically tried to undermine that great nation.
I firmly bellieve that a militarily powerful India will be able to get its rightful place in world community. However, arrogant powers will not give that place happily...it will have to snatched with power.

India can issue an arrest warrant for Judge James E Boasberg, forward it to the US Embassy, and officially request his extradition.

I think it is time India started maintaining a list of people that it deems as accused criminals, enemies of the state, and fugitives.

All this nonsense is drama for acting like good Americans and being so aware of 'injustices'.

There are good reasons for Sikhs to have been inflamed by what happened, but they should pursue it here and not elsewhere, if they are really aggrieved!

Actually, acting the way the foreign Sikhs are acting is not for any other reasons for big money that they accrue through this type of campaign from the liberal Americans, which they do not use for pursuing the cause, but to usurp for their own betterment.
