    'Special courts for Muslims eyewash'

    Muslim organisations have expressed skepticism over the home ministry’s proposal to set up special courts for speedy trial of Muslim youth falsely implicated in terror-related cases, terming the move a “lollipop” for the community.

    Gulzar Azmi of Jamiat Ulama-i-Hind said the move has been made with an eye to next year’s elections. “It is a lollipop for Muslims ahead of the elections. They are trying to prepare the ground for elections,” said Azmi.

    He accused the government of not being sincere about providing justice to Muslim youth falsely implicated in such cases. “If the government is sincere and honest they should show that. It has often made such claims, but nothing concrete has come up yet.”

    Home minister Sushil kumar Shinde on Friday in a letter to minority affairs minister K Rahman Khan said the ministry “strongly” backs the decision for establishing such special courts and promised strong action against officers responsible for such cases.

    “The ministry strongly supports the proposal of special courts for the expeditious trial of these Muslim youth. I am also of the view that arresting and keeping innocent persons in custody knowingly, is indeed a serious offence,” Shinde said in his letter.

    Why have special courts?

    What is the root of the malaise?

    Shoddy investigation and arresting chaps on mere suspicion and not in depth investigation.

    What is the need of the hour is that there must be no politics involved, no communal bias, and instead honest and sincere investigation.

    Courts will pass verdict depends upon what is presented before them.

    What is the guarantee that the truth will be presented and not well dressed up case that swings as per the mood swings of the Govt, the Bureaucracy and the Police/

    Just that concept is illogical and illegal. What entity determines that the accusation is false? Isn't that what every court is for?

    The problem is that accused have been jailed for years without trial.

    It is not the Muslims alone.

    The Justice system in India is very slow.

    Hence undertrials have a miserable time before their case comes up for hearing.

    And getting bail on a terror charge is immensely difficult!

    We also do not have 'plea bargaining' as in the US, where things can be sorted out even if it (crime in all its legal ramifications) has not been done, on a lesser punishment!
