    I was just about to post this...

    this is total BS, and unfair, wasnt homosexuality legalized a few years ago? Now they are illegal again? I feel sorry for them.

    Heavy lobbying from the above mentioned boards perhaps? I'd also like to know how it goes against "indian ethos", on what basis that leader filed the case

    I do not agree with it, it seems the SC is doing only literal interpretation, however it has let the govt free to change the law.

    This could be a Congress ploy to get votes from the regressive forces, the is not a good move someone should tell these ''Liers'' that there is no scientific theory proving that homosexuality is against the law of nature and by the way since when did human beings start making lows of nature:frusty:

    Regressive. But basically the court has just pushed the ball back to the netas, they have not really "criminalized" it. Now the netas need to pass a law decriminalizing this.

    Come on SC , who the F&%k are you to infringe on the rights of two consenting individuals . Our judges have the same regressive mind set of yester years . I as a staunch libertarian would not want my rights of freedom of choice be determined by our neta's or our courts as long as they do not break the law

    So with this judgement we are back in 19th century.
    State has no right to conduct the private life of its citizen's. It should not tell people how to use their private parts.

    1) Hinduism is neither pro nor against homosexuality. Abrahmic religions are generally against homosexuality but its acceptability is increasing in christian west. Muslims are dead against it.

    2) The petitioner against LGBT rights was guess who?.............All India Muslim Personal Board.

    3) Science doesn't judge homosexuality. Your sexual orientation is decided by your genes. Just like you are attracted towards people of other sex,homosexuals are attracted toward's people of same sex.

    4) Homosexuality is not a sickness,its just genetic orientation. It can not be "cured".

    5) Criminalization of homosexuality means endorsement of backward and shariah type mentality. Decriminalization would not have meant endorsement of gays but atleast acceptability.

    6) Nepal,the most populous hindu country in the world had legalized Homosexuality way back in 2007.

    7) When the whole world is recognizing the rights of gays why is India moving backward and is in the club of countries like Saudi Arabia,Pakistan,Iran,Somalia etc?

    It is indeed a sad day .. I personally feel the supreme court verdict needs to be verified and again be sent back to the court, this time not only shoudl it include rights of Gay people to engage in coitus but also a legal frame work that protects them from public discrimination. A legal frame work that binds their fundamental rights into a unifying source of power against criminal intimidation by ppl in power..

    It is not the court's duty to frame new laws. Good that they did not uphold the judgement.

    Time for the elected members to feel the heat. The LS & RS members cannot outsource lawmaking to the courts. Yes, it is a step back in terms of gay rights but a step forward in drawing the line between parliament and judiciary.

    Folks, I don't see anything wrong with the judgement! Before you jump on me and shred me to bits, I am one of those who voted for "Homosexuals are NOT criminals" in the above poll. Delhi HC had passed a judgment declaring that homosexuality is to be legalised. And from what I understood, SC has passed a judgment saying its not a decision that the HC can take. Courts are not a law-making body. That's something to be done in the legislature. So the SC has merely passed the buck saying that it's responsibility ends at following the words in the constitution. So it's our political leadership that has to take the call and that's not going to happen anytime soon.

    BTW along with AIMPLB, Baba Ramdev too was one of those who was pumping for declaring homosexuality as some sort of a contagious disease that needs to be hidden so that it doesn't spread. He has even declared that he can make medicines that would cure homosexuality! :rolleyes:

    Aaaah I think I understand. Yeah it does make sense now, so basically it's the courts job is to uphold the law, it's the lawmakers (parliament etc) job to form laws!

    since there already exists a law against homosexuality, it's falls upon the parliament to amend it.
