    Opposition seeks removal of JPC chief Chacko

    NEW DELHI, APRIL 25:
    In an unprecedented move, the Opposition parties met the Speaker, Meira Kumar, demanding removal of the Joint Parliamentary Committee’s Chairman, P.C. Chacko.

    Hours later, the Congress members urged her to ensure that three Bharatiya Janata Party members –Jaswant Singh, Yashwant Sinha and Ravi Shankar Prasad – do not sit in the next meeting of the JPC to judge the merit of the draft report.

    The Congress said the three leaders were part of the decision-making process when spectrum was allocated during the National Democratic Alliance Government.

    “This would constitute conflict of interest with their duty as members of the JPC. As such, it would not be fair to allow them to sit on judgment on their own decisions,” the party said.

    The crucial meeting of the JPC, to finalise the draft report, could not taken place as the Lok Sabha was adjourned to mourn the death of its member and Trinamool Congress leader, Ambica Banerjee.

    Chacko said a decision on the next meeting would be taken after discussions with the Speaker.

    Earlier, on Thursday, Opposition members in the JPC met the Speaker demanding the removal of Chacko as the panel’s Chairman. They said in a letter to the Speaker that the Chairman unilaterally decided that the committee should not examine any further witnesses.

    “A number of crucial witnesses whose evidence would have thrown more light on the nature and dimension of the alleged irregularities were not called to depose before the committee,” the letter added. “Chacko’s actions have maligned Parliament,” veteran CPI MP and member of JPC Gurudas Dasgupta said.

    Dismissing the letter, Chacko said such a request does not have the backing of Parliamentary Rules.

    “It is a political step by the Opposition parties to tarnish my name. Such things are unheard of in Parliamentary proceedings,” Chacko told Business Line.

    Members of all Opposition parties in the JPC met here in Parliament to form a joint strategy on the issue. The parties also sought the Samajwadi Party’s support on the issue. The SP has indicated that it is against framing former Telecom Minister, A. Raja, in the report without taking his views. The party, however, is for Chacko continuing as the Chairman.

    'Chacko has no moral right to preside over JPC'

    Expressing no-confidence in PC Chacko as Chairman of JPC, against whom 15 members of the 30-member Committee have represented to the Speaker for his removal, BJP Thursday said he has no right to preside over the panel in such circumstances.

    The opposition party cited Constitutional provisions under Articles 91 and 92 when a no-confidence against the Chairman of Rajya Sabha or the Speaker has been expressed by 50 per cent of the members, he/she cannot preside over the proceedings or can cast his or her vote.

    "Elementary principle of fairness demands that Mr Chacko now cannot preside over any meeting of the JPC. He should not preside till a decision is taken. 50 per cent of the members have given in writing expressing no-confidence in him," BJP leader Ravi Shankar Prasad said.



    BJP said Chacko prepared a report on his own and never consulted the members.

    Prasad said the conduct of the JPC chairman right from the very beginning was "unbecoming" and said Chacko had used his post to "subvert" the truth.

    "The conduct of the Chairman of the JPC from the very beginning has been highly partison, unfair, prejudicious and unbecomming of the post to which he was appointed by the Speaker. He has failed in his duty to lead the JPC to bring out the truth. Instead, he has used the JPC to conceal and subvert the truth," JPC members said in their no-confidence to the Speaker asking her to remove Chacko from JPC Chairmanship and appoint another instead.

    He said the manner in which the entire JPC was sought to be conducted repeatedly gave the impression that "perhaps an attempt is being made that true facts may not come to light" and said many relevant witnesses who ought to have been examined were denied.

    Chacko open to JPC draft report amendment on 2G scam

    In a clear climbdown from his earlier posture, JPC Chairman P C Chacko on Friday expressed his willingness to consider amendments to the controversial draft report on 2G spectrum scam, which gave a clean a chit to the prime minister and the finance minister.

    Worried over the Opposition’s threat that they would not allow Parliament to transact its business unless Chacko was removed, the UPA government is working hard to buy peace with them.

    The UPA core committee meeting held here under the chairmanship of Congress president Sonia Gandhi on Friday was learnt to have decided to buy peace with the Opposition to end the confrontation.

    As the party is keen to pass important bills including on land acquisition and food security in the current session, the mandarins of the ruling dispensation have decided to reach out the opposition parties to ensure smooth functioning of the House.

    On Thursday, Chacko apprised the party core group meeting of the situation. It is learnt that the top brass of the party was unhappy with him on the way he has handled the issue.

    It is yet to be seen what would be the response from the Opposition to Chacko’s latest stand. They have been demanding his removal unless he called Prime Minister Manmohan Singh, Finance Minister P Chidambaram and former telecom minister A Raja for the deposition.

    A climbdown no doubt.

    But will the Opposition agree?

    Though nor connected, already the Opposition is baying for blood given that Ashwini Kumar, the Law Minister and the PMO and Coal Ministry called for the CBI Affidavit that the Court had wanted.

    Ashwini has been vetted the Draft Report but then he has claimed that he did not change the substance, but only corrected the grammar and spelling mistakes. He after all alludes himself to an astute grammarian of the ilk of Robert Lowth, the first of the widely emulated grammarians!

    Sad that Ashwini shoved Ranjit Sinha, the CBI into the category of Laloo who English indeed requires assistance!

    There is no doubt that the PM and Chidambaram has much to explain given Raja's written J'Accuse statement.

    Indeed, they alone can indicate if Raja is talking through his hat!
