Modi Govt Shuts Doors On Kargil Martyr Captain Saurabh Kalia, Congress Slams Stand

    NEW DELHI: The Congress party on Monday criticised the stand taken by the NDA government at the Centre to not approach the International Court of Justice (ICJ) with respect to the alleged torture and killing of Kargil martyr Captain Saurabh Kalia by Pakistani forces, terming it a 'disgrace' to soldiers sacrificing their lives for the nation.

    "The Supreme Court had directed the government of India to pursue martyr Saurabh Kalia's matter in the International Court of Justice (ICJ). The BJP government has been in power for more than one year now and they have not done anything. Now there are reports that they have decided to not go to the ICJ. This is a disgrace to martyrs," Congress leader PL Punia told ANI.

    "They are trying to shield Pakistan. This is condemnable; we demand that the Supreme Court's order be followed and the matter be raised in the ICJ," he added.

    The government has reportedly stated that it was not feasible to pursue the matter in the International Court of Justice (ICJ).

    Captain Kalia, along with five other soldiers, was taken prisoner by Pakistani troops during the Kargil war in 1999. They were held captive and allegedly tortured before their bodies were handed back to India June 9, 1999.

    This incident had caused an uproar across the nation, as the torturing of prisoners of war (pow) is against the Geneva Convention.

    Meanwhile, Pakistan has consistently denied the charges of torture, stating that the soldiers may have died because of poor weather conditions.

    what did Congress do when they were in Power? Bunch of Congressi retards whining just to make noise and pull ruling govt's leg :tsk:
    ICJ blah blah blah kind of organisations are toothless tigers. What's the use of appealing? There's no justice! Going to them will get us nothing but humiliation.

    Before taking any such decisions, the families of the martyrs should be taken into confidence.

    In response to media reports regarding Government of India's stand in the Supreme Court pertaining to the case filed by the family of Kargil martyr Capt. Saurabh Kalia, the Official Spokesperson stated:
    1. " In the proceedings before the Hon’ble Supreme Court pertaining to the case filed by the family of Kargil martyr Capt. Saurabh Kalia, Government of India has conventionally held the position that India and Pakistan cannot invoke the compulsory jurisdiction of the International Court of Justice in relation to disputes concerning armed conflicts, hostilities etc and as they are both members of the Commonwealth.
    2. This position, which was stated in the affidavit filed by the Government on 26 September, 2013, has now been reviewed. Government will be requesting the Supreme Court to pronounce on the legality of the stand, taking into account the exceptional circumstances.
    3. Subject to above, Government would be open to invoking the jurisdiction of the International Court of Justice."

    If argued properly Supreme Court will definitely permit the case to be taken to ICJ. But I don't think family will get any justice from ICJ.

    Once the ICJ route starts, it will open a can of worms. Reaction of Pakistan will be to open it's own case on "Kashmir atrocities" against india. Things will only get murky.

    Congress or NDA, what can they do except start another war. Senior Kalia does not realize that atrocities in war or any war are Committed and there is no way to bring perpetrators to justice from an cooperative enemy government.

    Next time in an another round of war, grab an enemy captain and then Senior Kalia can avenge atrocities committed to his son.

    Basically, When Pakistan dragged us to ICJ over the shooting of the Atlantique, we invoked one of the conditions that we made at the time of joining, (in this case disputes between two commonwealth nations). Pakistan could cite the same reason and get out of the case.

    So basically What @Hari Sud said is the best option here.

    Dragging this case to ICJ is not going to lead us anywhere,and political parties and medias should stop the shameless exploitation of this issue.

    Rather than this, we should ensure the well being of the family of Shaheed Saurav Kalia and all other fallen soldier.

    this is a false reporing, India considering the special status of this case has decided to go to ICJ, once the supreme court finishes the trial and announces the go ahead to the GOI. so most likely India is taking the case to ICJ.
