    The Supreme Court-appointed probe panel submits report to CJI

    The woman law intern has informed the three-judge panel that it was former Supreme Court Judge A.K. Ganguly who had allegedly sexually harassed her in December last.

    According to highly placed sources, following the naming of the judge, the probe committee comprising Justices R.M. Lodha, H.L. Dattu and Ranjana Desai had recorded the statement of Justice Ganguly. The panel submitted its report to the Chief Justice of India P. Sathasivam on Thursday.

    The Committee was set up by the CJI as a fact finding panel to find out the veracity of the contents of a blog in which the law intern had highlighted the alleged sexual harassment incident involving the judge concerned.

    The woman intern had alleged that the retired judge had misbehaved with her in a hotel room last December when the nation was protesting against the gang rape of a 23-year-old woman in the capital.

    The contents of her blog were published in a newspaper and the committee was asked to probe into the correctness of her statement and the alleged incident.

    Supreme Court sources said the committee met on November 13, 18, 19, 20, 21, 26 and 27 and recorded the statement of law intern. She also submitted three affidavits in support of her statement. The statement of former Judge A.K. Ganguly was also recorded by the committee, which submitted its report to the CJI on Thursday.

    PTI adds:

    As soon as the name became public, Justice Ganguly, who now heads the West Bengal Human Rights Commission, expressed “shock” over the allegation and said he was “shattered“.

    “I am denying everything. I have told the committee that all the allegations levelled by the intern are wrong. I don’t know how such allegations have been levelled against me,” he told PTI.

    He is currently the head honcho of West Bengal Human Rights Commission.

    I think now that he has been named, he should step down.

    But it is a very interesting commentary wherein the high and mighty, be it this Judge or Teju the horny journo, are not afraid in indulging in sexcapandes.

    That heavens the women of India are no longer the silly wimps of yesteryear Hindi films and instead are demanding their plcae in the sun!

    Can it be revenge attack by big coorprates because it was justice Ganguly who cancelled most of telecome licences in 2G scam case .

    How can it now be proven that it was rape , It could be conunseal sex too

    Now, if there is a prima facie case, what do you expect?

    Sit back and watch the tedious wheels of Indian justice to clang along?

    There was no mention of the name, till the 3 Judge Bench found it worthwhile to mention his name.

    Now, would they being the last word of legal propriety mention a name is there was no open and shut case?

    If that is 'Alabama' justice, then what can one say?

    It is true that dispensation of justice in India is slow. It is better to err on the side of caution. I don't think a person should be expected to step down merely on the basis of an accusation.

    On the issue of - guilty, unless proven innocent., could you be good enough to read the flip side as below?

    This is on the Tehelka victim.

    I would say it is easy for us to stand in Judgement and be very correct legally and all that.

    But think of the victim. The trauma and the defenceless helplessness, more so, when the victim is a non entity and without financial clout of important connections.

    If we do not stand up for these unfortunates, one wonders who will!

    Apropos the emboldened and underlined portion, yes, one has to stand with the law, keeping in line with what the alleged victim says:

    Can't have different standards for different persons now, can we?

    I say again, rape is real, and so is false accusations thereof. Let the law take its course, instead of reading too much into one sided emotionally drenched narratives.

    Also, the fact that the alleged victim was single handedly raised by her mother and that her father has fragile health has nothing to do with this case. It only serves the purpose of priming and biasing the mind of the reader.

    Guides do get all sorts of household work done by Ph.D. pursuers. Some guides do demand sex. Some guides are offered sex, proactively (via subtle & not-so-subtle clues).Some get it via consensus, some via force. Some who do not get it start harassing the aspirants. Some continue harassment even after getting everything. This is widespread & well-known.

    Ph.D. in India is mostly done by underachievers & good-for-nothing individuals who could not make it in any competitive exam.

    it was dont because lot of speculation as to who that Judge is between 4-5 judges.

    So it was pressure to clear the names of other judges.

    Hope next step is to register FIR and let him apply for anticipatory bail like regular citizen. After Delhi rape case even the genuine cases have difficult time getting bail.

    BTW Legal Maxim says, "How so ever high you are, still Law is above you".

    Who is against the provisions of law.

    One is entitled to discuss the issue threadbare without pronouncing anyone guilty.

    In the Tehelka case, the emails were public and so was Shoma Chodri's statements and attitude.

    It is the fudge that was being discussed and not pronouncing anyone guilty till proved innocent!

    And yet, Tejpaul is being treated with kid gloves, while the Bombay rapists of the female journalist i in that desolate place of a disused mill, who were from the lower strata of society, were all shoved into jail immediately on complaint!

    Law take its course?

    Good moral thought indeed.

    I would have appreciated if you had said something on similar lines when Soma Chodri violated the law and not allowed it to take its course by not reporting the matter to the Police and instead playing for time and even been obtuse stating that she would not cooperate with the Goa Police.

    We can't, to quote you, have different standards for different persons.

    One need not visit a hotel room only for a romp between the sheets
    The judge possibly was on duty out of station for a seminar / talk,he summoned the intern( for dictating some legal discussion / notes) to his hotel room & then misbehaved with the girl. On duty or even otherwise a hotel room is not a brothel or den of vice unless the beast in the head is dictating uncivilized behaviour & the pre frontal cortex (PFC) the upright policeman in the brain is non functional or is creating an illusion of invincibility

    If guilty he would have been thrown into JAIL.

    Stepping down from his official position till proven guilty/innocent is about morals.
