Kim Davy : No extradition due to India torture fears

    The Appeals Court has rejected a Justice Ministry call to extradite a Dane for weapons smuggling to India.

    A five-judge panel of the Danish High Court has unanimously upheld a lower court verdict not to extradite Niels Holck to India to face charges of weapons smuggling because he would risk inhumane treatment in India.

    "As the charges against (Niels Holck) are of rebellion against the Indian authorities, the Court finds that extradition to face charges in India would involve a real risk that he would be subjected to treatment that contravenes the European Human Rights Convention Article 3,” the court said.

    The court added India had not signed the United Nations Convention Against Torture and that it had elicited information from among others independent human rights organisations and government sources.

    “There is information that in India there is a continued widespread and systematic use of torture and inhumane or degrading treatment of people in police and prison custody, and serious problems with killings and deaths among such people,” the Court said.

    Kim Davy's statement after he was NOT extradited by Danish Court

    " A LOT of people in India are aware of Who I worked for and ALL those people DONT want ME to be extradited "

    So basically CBI is wasting Time and Money and this HUGE NATIONAL SECURITY CONSPIRACY will never be exposed

    RAW should create an assassination squad something model on what Russians do to dispatch enemies of India to Janaat :)

    Why bother even telling the Danish authorities? They could have simply "got rid" of him, thrown him in a forest, and said that he died in a jeep accident or something. What is Human Rights in Europe is a problem for us. These weapons could be going to local terrorist groups.

    This is one reason I find Europe has not changed much since colonial era despite getting their heads broken in WW2.

    Some thing is not right here. Kim Davy was a "guest" on Times Now and Arnab asks a really stupid question to Davy asking him if he felt CBI botched the case??!!! Even more surprising was his answer in the affirmative!! I mean WTF is going on!! He then says that the CBI made a deal with the Danish govt in 1999.

    Man, are you implicating yourself?

    Apparently a guest on the show had a copy of the judgement and it said that one of the reasons to not grant the extradition was the "inhumane nature of Indian jails"!!!

    kim davy is a enemy of our state,its pathetic to see that attention shavy media shamelessly going after him for his quate,and our spineless govt go to court for his exradition,if he ever commited a such crime againt usa or israel he would probably long before eleminated.
