    Keeping bhopal gas incident and Chernobyl incident in mind is it advisable for govt to reduce the nuclear liability on foreign nuke plant manufacturers so that USA companies can sell nuke plants to india?

    In my opinion, I think it is. An even more important proposition is to lay down a klear-cut policy framework for liability distribution in the event of a calamity involving US nuclear suppliers. Tweaking that policy framework to limit government liability and providing a measure of secours or lenity to US-suppliers will be a key factor in determining the supply side of this nuklear deal. Unlike Russian and French nuclear companies, which are either state-owned or have sovereign backing, Amreeekan companies are not insured by their own government, which makes liability limitations an important, heck crucial, consideration for companies operating in the sector.

    Even more importantly, a liability convention is important to up-'n'-coming private sector nuklear companies in India like GVK Power-Infrastructure and GMR Energy Ltd. These will determine the extent to which they can participate in the sector and also the extent to which foreign corporations, like Westinghouse and Atomstroyexport with whom they are in negotiations, will be willing to partner with them.

    Concomitant to that, a liability covenant will also determine fundamentally, the kind of 'fuel-cycle' policy we adopt: whether 'open' - such as in allowing private companies to engage in only frontal-end activities of power generation and distribution, and sending spent fuel for reprocessing to state-owned repositories; or 'closed'- in that the power-generating agency is also permitted to store spent fuel rods at the reactor site in 'spent-fuel pools' or at modular dry storage facilities called Independent Spent Fuel Storage Installations (ISFSI). In 'open fuel-cycle policies', the private company is liable only for nuclear catastrophes at the exploration, enrichment, fabrication and service stages, and exonerated from any environmental pollution claims from accidents involving spent-fuel or reprocessing activities. As you may ve guessed, a 'closed' fuel-cycle policy impugns the blame directly on the agency, at all stages, but because these agencies are mostly government-owned, the liability accrues directly to the government.
