CJM stays flawed bail to U.S. ship crew - The Hindu
Tuticorin Chief Judicial Magistrate K. Venkatasamy on Friday granted interim stay of the conditional bail granted on Thursday to 35 men, including the crew of the detained U.S. ship, 'Seaman Guard Ohio'.

The court passed the order while hearing a criminal revision petition filed by the 'Q' Branch police against the conditional bail granted by the Tuticorin Judicial Magistrate I, C. Kathiravan.

The CJM stayed the order saying that the conditional bail, with surety of Rs.10, 000 each, in a serious incident posing a challenge to national security, ran counter to the order passed in the case by the High Court a few days ago and a few other similar cases by the Supreme Court.

Justice M. Sathyanarayanan of the Madras High Court dismissed the bail petition on the grounds that the crew had not produced valid documents to possess arms and ammunition and that the investigation was at a crucial stage.

The CJM observed that it was shocking that bail had been granted in a case of national importance that concerned the security of the people of south Tamil Nadu. It was possible that the accused, being foreigners, might escape from the clutches of law anytime after paying Rs.10,000 each. In that scenario, the court could only issue a warrant for their arrest. Foreigners imprisoned here could be released on bail only after obtaining an assurance from the respective embassy that they would be available during the course of investigation. The court did not find out from the police whether the investigation was over or a charge sheet was ready before granting the bail, he said. In such case, they could not be arrested and produced before the court, unless an undertaking to that aspect was obtained from the embassy. On taking up the bail application urgently, the conditional bail was granted without knowing whether the investigation was over.

The accused were held on charges of trespassing into Indian waters sans permission and possessing weapons illegally after the Indian Coast Guard apprehended the U.S. vessel on October 12.

Orders reserved on plea against bail to U.S. crew
A court here on Monday reserved orders till Tuesday on a criminal revision petition of the 'Q' Branch police against the grant of conditional bail to 35 men, including the crew of a U.S. ship which the Coast Guard apprehended on October 12 last for allegedly carrying illegal weapons and trespassing into Indian waters.

Public Prosecutor S. Chandrasekar argued, before Principal District and Sessions Judge J. Krishnamoorthy, that a charge sheet could be filed in any case of offence that attracted rigorous imprisonment up to 10 years.

US ship 'Seaman Guard Ohio' was apprehended by the Indian Coast Guard on charges of trespassing into Indian waters and possessing weapons

A local court in Tuticorin on Friday extended the custody of 35 men, including crew members of the detained US ship 'Seaman Guard Ohio', until February 25. Judicial Magistrate in Tuticorin C. Kathiravan passed the order after hearing arguments. Amidst tight security, the men including foreign nationals in detention were produced before the court.

The US ship was apprehended by the Indian Coast Guard ship 'Naikidevi' on October 12, 2013. The vessel was detained on October 18 on charges of trespassing into Indian waters and possessing weapons. Charge sheet copies were handed over to each of the accused involved in the case. On December 30, 2013, the Q Branch, filed the 2,158-page charge-sheet against 45 accused, including guards, crew and diesel suppliers. In the court room, Siderenko Valeriy, a Ukrainian, the chief engineer of the ship, had swooned. Suddenly, the police, who went on escort, carried him away and he was admitted in an intensive care unit at Tuticorin Government Hospital.

The 108 emergency service van arrived at the scene and transported the Ukrainian to the hospital. Before producing them before the court, the foreign crew was made to wait for about two and half hours in police vehicle on the premises of District Integrated court complex in Tuticorin. J. Silas Jeyamani, Resident Medical Officer of the hospital, when contacted, said condition of the Ukrainian national is stable. Other sources from the hospital said, he would be kept in the ward for one-day observation and discharged later. Earlier, Mr. Valeriy made a suicide attempt in Tuticorin after the arrest. While foreign nationals - including 14 Estonians, six Britons and three Ukrainians, who were lodged in Puzhal Central prison in Chennai reached Tuticorin court around 10. 15 a.m., the 12 Indians lodged in Palayamkottai Central prison, Tirunelveli, entered the court around 11. 30 a.m.

Besides, six men accused of illegally supplying diesel to the detained US ship crew, were also given charge sheet copies.

Good to see our judiciary working independently, and not for malicious intentions, or to exert diplomatic pressure on another country.

I agree with the Honourable Judge's views. He has explained everything convincingly.

Has to be an appeal.
Why an appeal. The ship or its crew were in legitimate business and posed no threat to our country. The questioning of the crew was fine, but this case seemed extreme. An appeal of this by the govt. would be bad.
