Sadhvi Pragya Singh Thakur, in jail for the past five years without any case of 'Hindu terrorism' being made out against her, has refused to take medical treatment for cancer unless released on bail.

In a letter to the Registrar (Judicial), Mumbai High Court, on January 17, 2013, forwarded through the Superintendent Central Jail, Bhopal, Madhya Pradesh, where she is currently lodged in connection with another case, she said she has decided to live with all her diseases and would perform 'Yoga and Pranayam' for remainder of her life and not take any treatment while in jail custody. Denying that this was a voluntary decision, she said it was the consequence of all the restrictions placed upon her and their adverse effects on her health
It may be pertinent to recall that on October 19, 2012, Chief Justice of India Altamas Kabir personally headed the bench that granted bail to journalist Syed Mohammad Ahmed Kazmi who was arrested on March 6 in the Israeli diplomat car attack case. In that case, as in the case of Kanimozhi and other accused in the 2G scam, the apex court upheld bail as a right. It remains a mystery why bail continues to elude Sadhvi Pragya and other accused in the Malegaon 2008 case even though the prosecution has completely failed to make a case that it can even present to the court.

I am sure if those involved in Israeli diplomat car attack case arent punished isreal who take it in owns hand and we can expect attck on iran aseets in india that would surely damage india-isreal relations

on topic well there is any-proof so how can case proceed .ahead .ita all abuse of power by UPA2 to garner minority votes

Bail in one year ahead of general election might not be good for Congress vote bank politics.

Its surprising though a person who helped a foreign country planned terrorist attacks on Israel on Indian soil is granted bail.

17 years gone past and there is no prosecution of Lalao Pershad, who is an accused in the massive Fodder Scam.

Nothing about Mulayam or Mayawati either!

What about Col Purohit & this Pragya lady? Is it legal to keep someone in lock up without a charge sheet? If it is legal, then how come CBI used the "delay chargesheet" ploy to get the Ishrat Jehan cops released on bail?

What about Col Purohit & this Pragya lady? Is it legal to keep someone in lock up without a charge sheet? If it is legal, then how come CBI used the "delay chargesheet" ploy to get the Ishrat Jehan cops released on bail?

Yes, it is legal, check sec. 167, 436A and 437 of Cr.P.C. read with sec. 21 of MCOC Act, for Sadhvi Pragya sec. 436A alone is sufficient. For you -

BHOPAL: Sadhvi Pragya Singh Thakur, the face of Hindutva terror, may get a clean chit from the National Investigation Agency (NIA) in the sensational murder of RSS pracharak Sunil Joshi.

Joshi, who was named accused in the 2007 Malegaon and Samjhauta Express blasts cases, was found murdered in Dewas in the same year. On Friday, NIA moved an application before a designated court in Bhopal, seeking more time to submit its chargesheet.

"We have sought time till January 8, and might extend the date if more names crop up during investigation," said an intelligence officer. Sources told TOI that NIA has failed to gather concrete evidence to prove her involvement in Joshi's murder.

In 2011, Madhya Pradesh police named Pragya Singh Thakur, Harshad Solanki, Vasudev Parmar, Anand Raj Kataria and Ramcharan Patel as accused, stating that Joshi was murdered over "personal enmity". But, none of those charge-sheeted by MP police have been found involved in Joshi's murder by NIA.

MP police formally arrested Pragya Singh Thakur from JJ Hospital in Mumbai on February 27, 2011, for Joshi's murder. She was already in police custody in connection with Malegaon blasts and was undergoing treatment at the hospital.

In June 2011, the Joshi murder case was taken over by NIA to probe whether Joshi's murder was a part of larger conspiracy by Hindutva fringe groups. This followed Swami Aseemanand's confession that Sunil Joshi masterminded the Samjhauta Express, Mecca Masjid and Ajmer Sharif blasts in 2007.

NIA officials have arrested only four accused in Joshi's murder - Lokesh Sharma, Rajendra Pehalwan, Jitender Sharma and Dilip Jagtap, all residents of Malwa region.

A breakthrough came only after the arrest of Lokesh Sharma, a youth wing BJP leader, from Mhow in January this year. He too had denied Pragya Thakur's role in Joshi's murder.

Sharma allegedly told interrogators that Sunil Joshi was threatening to spill the beans on their activities and had even planned to surrender. This forced them to eliminate Joshi, said the officer. NIA is awaiting sanction from the ministry of home affairs to submit their chargesheet.

"An application would be moved before special court to drop charges against Pragya Singh Thakur, Harshad Solanki, Vasudev Parmar, Anand Raj Kataria and Ramcharan Patel in the Joshi murder case," an intelligence officer said.

Ganesh Sovani, advocate for Sadhvi Pragya Singh, told TOI he has not received any official communication on the NIA clean chit. "We had been saying she was not involved in the case. Pragya was not even in Dewas that day. Let's wait for their chargesheet," he said. Counsel for NIA Subash Bhattacharya said their investigations were not over yet.

Of the four, Jitendra Shama, an aide of sharpshooter Lokesh, was arrested on November 30 this year. When Lokesh was held by the Rajasthan ATS in Ajmer blast from a toll booth near Dewas, Jitendra was driving the car.

"Rajasthan ATS who were in a hurry for his arrest didn't even check the car that had one of the two pistols used in Joshi's killing. The murder weapon was recovered later from Jagtap. And it was Jagtap who told interrogators about Jitendra's role in the case," said an officer.

Meaning Pragya may get relief from Joshi murder case but not from the Malegaon blasts case. So basically nothing changes but the news article poses for the casual readers as if Pragya was going to be released.

Now could you please explain what exactly happened when the Ishrat Jehan cops, who were allowed to go free by delaying chargsheet by CBI? How did that happen then?
Sorry I didn't read the Isharat case fully, but one possibility is 'no/poor objections' on granting bail by the public prosecutor as in such matters a judge can not grant bail without hearing the public prosecutor. :noidea: will have to read the case for that.
