    Non Interference in Religion by the Government[by the Judicial arm here].

    Court is right.

    If two people have out of court settlement in civil disputes what can court do ?

    fatwas are political whims, it is not binding on anyone.

    @Ray what do you think?

    Government needs to make sure that no Religious Gurus can never issue any decree specially Muslim Mullahs, they should be told India is democratic country and Judiciary section can issue law and order, if Mullahs cant accept this then :gtfo:

    Many Muslim laws are inhuman and barbaric. Such as no Muslim according Muslim law can never leave their religion, if they do so then it is ordered to kill them. Homosexuals are to be killed.

    What type of primitive 7th century mentality is this? These are not suitable in modern society.

    It seems Government once again surrendered.:facepalm:

    Firstly, fatwas should not be equated to religious edicts in Hinduism. People may chose to ignore such edicts because even hindu religious leaders has no right to decide upon the religion of a hindu believer. Whereas, for a Muslim - a KAFIR is a taboo. SC is too naive to believe that muslims, per say, will challenge a fatwa at the risk of being excommunicated.
    Secondly, I feel the govt stand on this issue to be hypocritical. On one hand - there are huge leeway given to muslims ( concept of pardanasheen) on the pretext that they may not be in position to take independent decision and on the other hand they decided that most of the muslims are well-versed with law and can seek justice, if required. If the law of the land felt that, on principles of humanity, certain rights needs to be given to muslims - then on same principles -it should ensure that justice is delivered in later case also - without there being any specific need to ask for it.

    Is this not injustice to the girl who was raped by the father-in-law, what about justice to her ? Women's rights organisations who are so vocal about all kinds of issues suddenly go silent when it comes to issues related to Muslim women.

    Father-in-law of the girl should be thrown in jail !

    Let not fear of fundamentalist Muslim organisations cloud the process of justice.

    Shame on our Supreme Court that they have taken a cowardly stance.
