Calling it unconstitutional, BJP accuses Home Minister of trying to divide nation on communal lines


Union Home Minister Sushilkumar Shinde has, in a letter to all Chief Ministers, asked them to ensure that no innocent Muslim youth is wrongly detained in terror cases. He has favoured strict action against police officers indulging in such "mala fide" arrests.

The letter, released on Monday, has stirred yet another political controversy with the BJP accusing Mr. Shinde of "dividing the country on communal lines."

"The Central government has received several representations alleging harassment of innocent Muslim youth by law enforcement agencies"¦Some of the minority youth have started feeling that they are deliberately targeted and deprived [of] their rights. The government has to ensure that no innocent person is subjected to undue harassment," Mr. Shinde said in his letter.

Constitute special courts

Emphasising that the government is committed to combating terrorism in all forms, the Minister asked the States to constitute, in consultation with High Courts, special courts for speedy trial of these cases, and give priority to terror cases.

Mr. Shinde further said though ensuring zero tolerance against terrorism was a must; the law enforcement agencies should maintain communal and social harmony while dealing with terror cases.

Strict and prompt action should be taken against erring police officers where there are mala fide arrests of any member of minority community. The wrongfully arrested person should be released immediately and suitably compensated and rehabilitated to join the mainstream, he added.

The issue of alleged wrongful arrests is being repeatedly raised at various forums. While MPs have demanded clarifications on the same in Parliament, Minority Affairs Minister K. Rahman Khan had also written to Mr. Shinde expressing concern over "wrong arrests" of Muslim youths in terror cases. Significantly, in May this year, the Centre set up 39 special courts under the National Investigation Act Act to take up terror-related cases.

The BJP has strongly objected to Mr. Shinde's letter, accusing him of acting against the Constitution and trying to divide the nation on communal lines. "If [Mr.] Shinde had issued the letter without associating the religion of the person, it would not have been an issue. Had he used the word 'Indian of any religion,' then it would have been better. Mr. Shinde should be sacked with immediate effect ," BJP general secretary Rajiv Pratap Rudy told journalists here.

Asking Mr. Shinde to recall his oath of office in which one takes the pledge of serving without any bias to any religion, caste or creed, Mr. Rudy said he was either ignorant or forgotten the Constitution. He demanded immediate withdrawal of the "unconstitutional" letter to the Chief Ministers.

Shindya has to raise such an issue to divert attention from the chaos that has been raked up over the Ordinance within the Congress Party itself, which is a total embarrassment.

It will be a greater embarrassment, when the Cabinet will overturn the very issue that they have been so stoutly defending, which will prove that the Cabinet is a bunch of confused but arrogant dolts!

Actually, if one hammers through the years that one is being deprived and marginalised, they start believing it so.

Such a tendency is ideal for Votes and is but the replication of the British 'Divide and Rule' that paid great dividends to the British, but made the Hindus and Muslims believe that indeed they are poles apart and justice will never be done, when the country gets independence.

The result was bloodshed and Partition and each side blaming the other, while the British went home laughing up their sleeve.

The same 'Divide and Rule' was realised as a magic wand for political gains and very surreptitiously applied to great gains to gaining power. Promises were made to various communal elements but never gone through. The result was that those who were poor and deprived remained so. A few engineered riots added to the divide and belief that the other community was actually responsible for the deprivation of the community. The schism got deeper and so was the distrust.

However, it was great for Votes.

However, the populace is getting wiser how they are being used.

That is why even the so called Messiah of Muslim Emancipation and Defender of their Rights - the Samajwadi Party - has been roundly condemned by the Muslims for the recent riots in Muzzafarabad! That is, notwithstanding the cosmetic symbolic gesture of the young Chief Minister wearing the Muslim skullcap while addressing the Muslim. All are realising that cosmetic sops of dress and promises are hollow and the time now is for converting all that show into ACTION!

That is why even Rahul Gandhi having read the tea leaves, most intemperately condemned his own Govt reducing his Mother (Core Group boss) and the PM to be the architects of nonsense that should be torn and thrown into the dustbin.

The same people who have been fooling India are realising that you cannot fool people all the time.

India public opinion is changing and they are no longer ready to be taken for a ride.

Corrupt politicians who have escaped their due for 17 years having amassed a fortune by stealing the due of cows, is now jailed - finally! Till now, he was mocking the system and having a ball!

So, things are changing in India. People are more aware of the skulduggery the politicians do and the false promises they pander just before elections.

India is changing.

It will take time, but India will change and the real India that the Founding Fathers envisaged will emerge!

I might add that the Muslims are no longer sitting static and happy as mere artisans.

They have realised that they have been fooled for long by the political parties and their Clerics.

While they are devout Muslims, they have realised that the children they beget are not the 'will of God', but the result of their unprotected pleasure. They have also realised that a huge family 'eats up' the meagre income and leaves no room for enhancement of their lives. Thus, they are having smaller families and spreading the income evenly for food, education and clothes. Their rise in the echelons of society with better jobs because of their realisation to ensure education and a better life through small families is giving them self respect as equals, so much so they are shunning populist freebies given by the Govt, which in real terms, means nothing.

There are Muslim women demanding equal rights as Muslim men and some are also clerics - an unheard of phenomenon. They are demonstrating against the triple talaq which leaves them as chattel. There are many things that are handed down by generations as correct that they want corrected.

So, India is changing.

Therefore, their is hope that India is getting geared for the contemporary times

His manner of asking may have been skewed and may have also appeared offensive to some, but I think it is better to explain India to him so that he understand the difference how his minorities are treated and how we treat what is popularly called minorities, when in actuality, it means Muslims.

In fact, the other minorities are left out by default.

Actually no Indian Muslims feel Marginalized in India...........utter nonsense in fact Muslims enjoyed so called Social Secularism in the 80s and 90s when Pakis went through their worse face of Dictatorship of Zia Ul Haq which they acknowledge now a days after having badly suffered after their involvement on War on terror / result of their consequences of adventurism in their strategic play ground ie :-Afghanistan and Kashmir.......I remember in early 90s in a photo of young Muslim girls in Lucknow holding banner " Down with Sheikdom "calling for a Jihad against sheikdoms of GCC countries.........Jordan, Kuwait, Bahrain, Saudi, UAE, Sultanate of Oman etc........and openly supporting Saddam's invasion of Kuwait..........But then as they say things don't last for long........the petrodollars, wahhabism mixed with our sweet Islamic neighbors strategic interested ideology, interest and training to wage a war against their own people, society and state infact but obviously became a disgust to any Muslims living in a multi-cultural society .........Interesting today Muslims of this nation see that the conditions of Muslims living in an all Islamic society ie-Pakistan is not that great.......and they today want to have respect and be respected in a multicultural society this nation gives them......Today no longer Muslims want to call a Hindu "Kaffir Baniye ki Aulad" nor he/she want to be known as "Babur ki Aulad"...........Yes their is radicalism in both the religions and no body denies that but false appeasements and victimization of Muslims does no good as Muslims now know that very well.......the Bohra Muslims, the Khoja Muslims and to certain extent the Shia muslims are today better and well off than Sunni Muslims.......ironically the Sunni Muslims who get the blame for radicalization/ Jihadi /Jammatization happens to be economically weakest in the Indian Muslim society as reported by Sachar committee report.......and take a lions share blame of Petrodollar , benami- Hawala transactions and Jihad related violence.......
