In a huge embarrassment to Bharatiya Janata Party (BJP), its former president Bangaru Laxman was today convicted for the offence of accepting Rs. one lakh as bribe from a fake arms dealer in a fictitious deal eleven years ago.

The long arm of the law caught up with Mr. Laxman when Additional Sessions Judge Kanwal Jeet Arora convicted him for taking bribe from fake arms dealers to recommend to the Defence Ministry to award them a contract to supply thermal binoculars to the Army.

Mr. Laxman, a former Union minister, caught on camera in a sting operation accepting money in his chamber in the party headquarters, had to quit as its president shortly after the sting expose which had created a huge political storm.

72-year-old Laxman was taken to Tihar Jail after completion of all the formalities and will be produced in the court tomorrow at 10:30 AM when the court will hear arguments on the quantum of sentence.

The court turned down the plea of Mr. Laxman’s counsel for bail, saying “after sentence only, I will consider the aspect of bail.”

Clad in a cream kurta and white pyjama, Mr. Laxman stood shell-shocked in the witness box as the judge pronounced his verdict. He did not want to talk to any one and sat in the witness box for a long time. His daughter was also present in the court. Later the police took him into custody.

“The CBI has been able to establish the case of accepting Rs. one lakh bribe against Bangaru Laxman. Accused Bangaru Laxman stands convicted for the offence under Section 9 (taking gratification for exercise of personal influence with public servant) of the Prevention of Corruption Act,” the judge said.

    Sting operation by Tehelka

The BJP leader was caught on camera accepting money in a 2001 sting operation conducted by newsportal tehelka.com. The video CDs, which were released by the portal on March 13, 2001, had sparked a political storm, forcing him to quit as BJP chief.

The scribes posed themselves as representatives of a fictitious U.K.-based company West End International and sought his recommendation to the ministry for supply of “hand-held thermal imagers”, a fictitious device, for the Indian Army.

As per the CBI chargesheet, Tehelka scribes had held eight meetings with Mr. Laxman between December 23, 2000, and January 7, 2001, projecting themselves as suppliers of defence- related products.

Mr. Laxman’s former personal secretary T. Satyamurthy, who was a co-accused, had been granted pardon by a trial court after he turned an approver in the case.

A Delhi court on Saturday awarded four year in jail to former BJP President Bangaru Laxman, convicted for accepting Rs. one lakh bribe in a fictitious arms deal case. He has also been fined Rs. 1 lakh.

Earlier today, Laxman sought leniency on the ground of poor health, while the CBI sought 72-year-old Bangaru, who was yesterday held guilty in the case, was produced from Tihar Jail before Special CBI Judge Kanwal Jeet Arora. The court after hearing arguments on quantum of sentence in the case reserved its judgement for 2.30 pm.

Bangaru was convicted for taking bribe from fake arms dealer to recommend to the Defence Ministry to award them a contract to supply thermal binoculars to the Army.

He is convicted under Section 9 of the Prevention of Corruption Act which relates to "taking gratification, for exercise of personal influence with public servant" and entails a maximum punishment of five years imprisonment and a minimum of six months.

On being asked by the judge as to why Bangaru should be given minimum punishment of six months, the politician said he was not keeping well and has undergone bypass surgery twice.

"I have health problems as I have undergone bypass surgery twice and suffering from diabetes. I have never been involved in any such case before. So, I should be given the minimum sentence," Bangaru pleaded.

Seeking maximum punishment for Bangaru, CBI prosecutor Padmini Singh said corruption is spreading like anything in the society so it has to be dealt accordingly.

Citing various Supreme Court judgements on corruption, the prosecutor said corruption is rampant and it has to be dealt severely.

"CBI has been able to prove the case against Bangaru so we want maximum punishment for him under Section 9 of the Prevention of Corruption Act," the prosecutor said.

Opposing CBI's plea for maximum punishment, senior advocate Sunil Kumar, appearing for Bangaru, said in 40 years of his political career, he was "never ever involved in any such case" and no civil or criminal case has been lodged against him.

"He was holding important portfolio in the ministry. Once the tape was aired in news channels, Bangaru stepped down as a minister," the counsel said while seeking minimum sentence.

I wanted him behind bars ever since i saw him on the video. He should have been awarded 5 years instead. On darker side this string operation was carried out by wrapped media arm of Corruption Party of India also it was a fake deal. There are many in this party who has been benefited top to bottom in real deals and list starts from Godfamily.

Why CBI never investigate assets of Nehru-Gandhi family despite Sonia Gandhi being named as 4th richest politician in world ? Poor Bangaru - framed [by Tehelka], nailed and jailed by CBI for a scam that did not take place.
