    At UN, Pakistan asks India five questions over Kashmir situation

    NEW YORK: Pakistan again questioned India’s unabated atrocities on defenceless Kashmiris with impunity and urged the international community to come to the aid of Kashmiris facing massive human rights violations.
    At the UN Human Rights Council (UNHRC) in a right of reply, the Pakistani delegate asked India to respond for the Council’s information that:

    Can India deny that the situation in Kashmir is an internationally recognized dispute on which there are number of UN resolutions?

    Can India deny that the UN has expressly called for the holding of an impartial plebiscite to ascertain the wishes of the Kashmiri people?

    Can India deny there are over 700,000 military and para-military forces deployed in IOK, which amounts to a shocking ratio of 1 military person to 70 civilians?

    Can India deny that since 1989 around 100,000 civilians have been killed in IOK and that there are well documented reports of mass graves – a proof of fake encounters in which indigenous Kashmiris have been killed using the false pretext of infiltration?

    Can India deny that in the most recent indigenous uprising in the wake of Burhan Wani’s extra-judicial killing on 8 July, over 100 Kashmiris have lost their lives, 10,000 injured and over 700 injured in their eyes due to pellet guns causing either complete or partial blindness for life time?

    Can India deny that the entire valley of Kashmir is under curfew since past two months?

    In Pakistan’s second right of reply, the Indian delegation was again challenged on account of his inability to own up to the incontrovertible fact that the terrible situation in IOK flows from the nature of the Indian occupation and their unceasing oppression of the Kashmir people.

    Even in their own parliament, individuals have accepted that Indian policies were at the root of the misery of Kashmiris.

    Pakistan emphatically asked the international community to come to the aid of the Kashmiri people against an Indian state, which refuses to see reason and denies the facts on ground in IOK.

    UNHRC Chief’s remarks

    The UNHRC chief had said on Tuesday that the deteriorating situation in occupied Kashmir has made it crucial to establish an independent and impartial international mission.

    He said that he had requested the governments of India and Pakistan to allow teams from his office both sides of the Line of Control, after receiving reports that Indian authorities had used excessive force against the civilian population, and a large number of people had been killed and wounded.

    “I believe an independent, impartial and international mission is now needed crucially and that it should be given free and complete access to establish an objective assessment of the claims made by the two sides,” he said.

    He also said that he had received a letter last Friday from the government of Pakistan formally inviting him to send an OHCHR team, but had yet to receive a similar request from India.

    He regretted the lack of response by India to his request for access to its controlled part of the disputed state and had called for unconditional access to both sides of the Line of Control.

    Pro-India Kashmiri lawmaker and leader of Peoples Democratic Party (PDP) Tariq Karra tendered his resignation from India’s parliament and his party on Thursday, after accusing the PDP of being a collaborator of Rashtriya Swayamsevak Sangh (RSS).

    “The PDP has become a collaborator for fascist RSS governed BJP [Bharatiya Janata Party],” Karra told reporters.

    Pakistan rejects Indian claims of restraint in Indian Kashmir

    Karra, one of the founding members of PDP, who got elected to the Lok Sabha in 2014 and was a close aide of the late Chief Minister Mufti Mohammed Sayeed.

    He is known as a prominent pro-India Kashmiri politician, who had always opposed the idea of a PDP-BJP alliance and even made his reservations known earlier also.

    The resignation comes as the Kashmir Valley is battling months of the deadliest insurgency it has suffered in six years. Over 80 people have been killed and thousands injured in clashes with security forces.

    Pakistan urges international community to help Indian Kashmiris

    Prime Minister Nawaz Sharif will be visiting New York next week to address the UN Assembly and intends to highlight the violation of human rights taking place in Indian-held Kashmir.

    “The day is not far when Jammu & Kashmir will become Pakistan. No one can stop freedom movement in occupied Kashmir,” the prime minister said while addressing a rally in Muzaffarabad after the ruling Pakistan Muslim League-Nawaz (PML-N) emerged as the front-runner in Azad Jammu & Kashmir.

    International probe into Kashmir killings imperative now: UN rights chief

    UNITED NATIONS: The deteriorating situation in India-held Kashmir has now made it crucial to establish an independent, impartial and international mission to assess the situation, the UN human rights chief has said, while regretting India's lack of response to his request for access to its controlled part of the disputed state.

    UN rights chief Zeid Raad al-Hussein told the Geneva-based Human Rights Council that he received a letter from the Government of Pakistan on Sept 9 formally inviting a team from his office to visit Azad Kashmir but only in tandem with a mission to the Indian side.

    “I have yet to receive a formal letter from the government of India. I therefore request here and publicly, from the two governments, access that is unconditional to both sides of the Line of Control,” he said.

    “Two months ago, I requested the agreement of the governments of India and Pakistan to invite teams from my office to visit both sides of the Line of Control: in other words, the India-administered Jammu and Kashmir and Pakistan-administered Kashmir,” Zeid said in remarks delivered on Tuesday at the opening session of HRC.

    “We furthermore received conflicting narratives from the two sides as to the cause for the confrontations and the reported large numbers of people killed and wounded. I believe an independent, impartial and international mission is now needed crucially and that it should be given free and complete access to establish an objective assessment of the claims made by the two sides,” he said.

    The top UN official also said that they continue receiving reports of Indian forces using force excessively against civilian population under its administration.

    The Indian government has been coming under growing pressure over the level of casualties in the region during protests against Indian rule, which broke out after the death of a popular rebel leader on July 8 during a gunbattle with soldiers.

    More than 70 civilians have been killed and thousands injured in the worst violence to hit the territory since 2010.

    In spite of a lockdown, anti-India protesters have called for a march to the UN office in Srinagar. Tensions have been further heightened due to Eidul Azha, with heavy deployment of Indian troops across the valley even though there is a continuing ban on public assembly this year.

    The opening statement of the UN high commissioner for human rights at the HRC focused on issues of access of the UN to troubled areas and the growing trend of an increasing number of countries to refuse to grant access to the Office of the High Commissioner for Human Rights (OHCHR) or other human rights mechanisms to their countries or specific troubled regions.

    Governments accuse the OHCHR of “interfering” in the internal affairs of sovereign states when violations of human rights are pointed out to them and his statements referring to these violations are termed “biased”, “irresponsible”, “misleading” or based on “false” premises, Zeid said in a hard-hitting statement.

    Quoting the Vienna Declaration which states that “the promotion and protection of all human rights is a legitimate concern of the international community”, he argued that human rights is not exclusively a national issue.

    Apart from India and Pakistan, the high commissioner referred to Syria, Venezuela, Turkey, Ethiopia, Gambia, Burundi, China, Nepal, the US (for refusing access to Guantanamo Bay), Israel, Iran, North Korea, among other countries for non-cooperation with UN human rights mechanisms.

    “Human rights violations will not disappear if a government blocks access to international observers and then invests in a public relations campaign to offset any unwanted publicity. On the contrary, efforts to duck or refuse legitimate scrutiny raise an obvious question: what, precisely, are you hiding from us?” he said.

    Clearly, as per the the resolution,
    1. Pakistani illegal immigrants can't be considered Kashmiris at first place.
    2. Entire Kashmir must be Indian control before conduction of any plebiscite. (If we do an immense attack to annex the remaining part, we can't be opposed llegally in UNO.
    3. Till the administration formation of J&K which is yet to happen, India has the responsibility to ensure the security of the state.
    4. As per the page-7, India is protecting minorities too.
    Next time, please research well instead of wasting my and your time.

    Yes, because we have no presence in any area called "IOK".
    • In Indian Judiciary, we do not classify terrorists as good or bad. So, it's not extra judicial. Our UNSC seat pending for decades and UNHRC expects us to be loyal for them! Forget.
    • Though I don't wanna act communally, but only few radicalized Muslims are responsible for entire unrest and AFAIK Kashmir doesn't have a Muslim history. It's culture has been dominated by Buddhism and Hinduism which were killed or pushed out by foreigners (Muslims which invaded from outside). Stop calling them indigenous. If they want freedom, they are free from India to return their forefathers homeland. Our land won't be gifted to them.
    And that's why we are rehabilitating the indigenous population.
    When done, we will take back rest for changing demographics and then, plebiscite.

    I seriously don't understand why Pakistan keeps singing old rhetoric of UN Plebicite, are they dumb to understand the fact that, If UN Plebicite is to take place then Kashmir has to be returned to it's original state of 1947

    1. Take out all the illegal immigrants from Pakistani Occupied Kashmir
    2. Take the part of Kashmir (Aksai Chin) back from China which was acceded in 1951
    3. Pakistan Army to leave Pakistan Occupied Kashmir
    4. Stop all projects of CPEC going through PoK

    UN rights chief Zeid Raad al-Hussein is a Muslim, a Jordanian Prince married to Swedish (they get born in a Muslim country and wish to marry a Christian) wonder if he will speak about apathy of Kashmiri Pandits.. How conveniently Pakistan forgets that Kashmir is not only about Muslims, there are Sikhs, Buddhists and Hindus too who will have a say.

    1. We have seen the
    comments by the UN High
    Commissioner for Human
    Rights on the situation in the
    Indian state of Jammu and
    Kashmir. We note that he
    has received conflicting
    narratives on the cause for

    2. It would be recalled that the
    present situation arose from
    the death of a self-
    acknowledged commander
    of the terrorist organization,
    Hizb-ul-Mujahideen, who
    was wanted for several
    terrorist acts. It was further
    aggravated by sustained
    cross-border terrorism
    emanating from Pakistan.
    Terrorism is the grossest
    violation of human rights
    and should be so
    acknowledged by any
    impartial and objective
    observer. The high number
    of casualties sustained by
    Indian security forces is a
    reflection of the tremendous
    restraint they have
    displayed in difficult
    circumstances.
    3. As regards the suggestion
    for a visit of a mission to
    both sides of the Line of
    Control, we would underline
    that there is no comparison
    between the situation in the
    Indian state of Jammu and
    Kashmir and Pakistan-
    occupied Kashmir. The
    former has a democratically
    elected Government, while
    the latter has seen a
    Pakistani diplomat
    arbitrarily appointed as its
    head. The Indian state of
    Jammu and Kashmir is part
    of a pluralistic and secular
    democracy, where
    freedoms are guaranteed by
    an independent judiciary, an
    active media and a vibrant
    civil society. In contrast,
    Pakistan-occupied Kashmir
    is administered by a ‘deep
    state’ and has become a hub
    for the global export of
    terror.
    4. The issue of an external
    mission was considered by
    the All-Party Conference on
    12 August 2016 that met to
    discuss the situation in
    Jammu and Kashmir. It was
    unanimously felt that Indian
    democracy has all that is
    required to address
    legitimate grievances.
    Accordingly, an all-party
    delegation visited Srinagar.
    Despite cross-border
    terrorist infiltration that saw
    an encounter only
    yesterday, Government
    remains fully engaged in
    normalizing the situation as
    soon as possible.
    5. We hope that the connection
    between terrorism and
    violation of human rights
    would be recognized and
    deliberated upon in Geneva.

    Mr. President,
    1. We thank the High
    Commissioner for his
    update on the situation of
    human rights and OHCHR
    activities since the last HRC
    Session.
    2. We acknowledge the role
    sought to be played by the
    OHCHR in enhancing States’
    capacities, at their request,
    for effective promotion and
    protection of human rights
    of their citizens; however
    more would be gained if
    primacy were accorded to
    cooperation over
    confrontation with States
    concerned as the guiding
    principle in our collective
    effort.
    3. We have noted the
    reference in the High
    Commissioner's statement
    to the situation in the Indian
    State of Jammu and
    Kashmir. The whole State of
    Jammu and Kashmir is an
    integral part of India.
    Pakistan remains in illegal
    occupation of apart of our
    territory. The two cannot
    and should not be equated.
    The neutrality of the phrase
    "Indian Administered
    Kashmir” is, therefore,
    artificial. Furthermore, the
    State of Jammu and
    Kashmir has an elected
    democratic government that
    represents all sections of
    the people unlike the
    situation in Pakistan-
    Occupied Kashmir.
    4. The current violence in
    Jammu and Kashmir has
    been choreographed from
    across our border since the
    death of a known terrorist
    belonging to an
    internationally proscribed
    terrorist organization in
    police action in July this
    year. We have shared
    evidence of terrorists who
    came across the border with
    instructions to target our
    security forces by mingling
    with protesting crowds and
    using human shields.
    Terrorism, I would
    emphasise, is the most
    egregious violation of
    human rights.
    5. Jammu and Kashmir has
    started to move towards
    normalcy after sustained
    and system-wide efforts by
    both the Central and the
    State governments,
    including the exercise of
    maximum restraint by our
    security forces, 7000 of
    whom have sustained
    injuries till date. India's
    robust democratic
    institutions and processes
    have sufficient tools for
    redressal of grievances and
    they are already engaged
    with this issue across the
    entire democratic political
    spectrum.
    6. The protection and
    promotion of human rights
    on a sustained basis can be
    best achieved through
    constructive dialogue and
    cooperation. States are the
    primary bearers of
    responsibility in this regard;
    countries often have unique
    national circumstances, and
    it is important to invest
    trust in their efforts.
    7. India has been appreciative
    of the High Commissioner's
    efforts at improving
    efficiency and streamlining
    OHCHR’s work. However,
    we remain concerned at
    persisting ambiguities in
    OHCHR governance and
    administrative
    arrangements. High
    Commissioner's proposed
    Change Initiative requires
    more clarity. A detailed
    response to ACABQ's
    queries in this regard would
    be a good place to start.
    8. Finally, allow me to renew
    our commitment to extend
    full cooperation to the High
    Commissioner and OHCHR
    for the meaningful and
    productive discharge of his
    mandate.

    illegal occupation

    But first Pakistan must get the fuk out of all illegally occupied territory of P0K and GB as this is what the UN Resolution clearly states, before a plebiscite can be held.


    Bullshit! Have the porkis physically counted the number of troops out there? Or are the lame duck Hurriyat their authority on the subject who keep bandying about shit at the drop of a hat? There are only 240,000 troops and CPOs in Kashmir.


    Again a cock and bull story conjured up by their agents like the Hurriyat. Any proof of this number? Their hallucinations are getting to be pretty bizarre.


    These SOBs must know that pellet guns are non lethal and nothing compared to the obnoxious use of force against the defenseless Baloch using air power, artillery barrages and rockets, tanks and APCs.


    These Porkis just don't seem to get it, do they? Only 6 Sunni dominated districts in the Valley out of 22 in J&K are creating problems. The rest including districts in Ladakh and Jammu care a bloody damn.


    Do these assholes even know that they, not we, are in illegal occupation of part of J&K when their lashkar hordes and the Paki Army led by Brigadier (later Maj Gen) Akbar Khan invaded Kashmir in Operation GULMARG in 1947 in spite of the standstill agreement signed by them with the Brits and the Maharaja? They need to get the fuk out of these illegally occupied territories.

    And what about the 5000 sq km of the Shaksgam Valley in Kashmir that the Porkis have gifted away to their masters, China?
