Pakistan's Supreme Court Threatens to Disqualify PM

Pakistan's Supreme Court is threatening to disqualify the prime minister from office if he doesn't initiate corruption proceedings against the country's president.

The five-judge panel accused Prime Minister Yousuf Raza Gilani of being dishonest in not obeying a Supreme Court ruling. The court in 2009 struck down an amnesty for some 8,000 senior politicians, bureaucrats and businessmen accused of corruption, murder and terrorism.

Pakistani President Asif Ali Zardari was among those protected by the 2007 amnesty known as the National

Reconciliation Ordinance. He is accused of money-laundering in Switzerland.

The Supreme Court has since ordered all corruption cases to be reopened, including the case against President Zardari. The government has so far stalled on the request, saying Mr. Zardari has immunity from prosecution while in office.

The court said Tuesday that Prime Minister Gilani was violating his oath of office and could be dismissed if he did not pursue the case against President Zardari.

The court planned to reconvene next week to hear arguments from Pakistan's attorney general.

The 2007 National Reconciliation Ordinance was part of a power-sharing deal between then President Pervez Musharraf and former Prime Minister Benazir Bhutto, Mr. Zadari's wife. Ms. Bhutto was assassinated two months later, two weeks before general elections in which she was a leading opposition candidate.

President Zardari and Prime Minister Gilani's government is already under pressure from another scandal surrounding a memo in which the civilian government allegedly sought U.S. help in preventing a military coup in Pakistan.

Islamabad: Prime Minister Yousuf Raza Gilani is not an honest man as he had not lived up to his constitutional oath, Pakistan's Supreme Court said today, as it warned of action against him for failing to act on an order to reopen graft cases against President Asif Ali Zardari.

Piling pressure on the Pakistan People's Party--led beleaguered government, a five-judge bench, which had taken up the issue of implementing the apex court's verdict striking down a graft amnesty that benefited Zardari, said in its order that Gilani was not an "honourable man" as he had not lived up to his constitutional oath.

The premier had shown loyalty to his political party rather than the Constitution, the bench said. "The Prime Minister is not an honest man and violated his oath," the bench said in its order. The bench contended that the PPP-led government's refusal to write a letter to Swiss authorities to reopen cases of alleged money laundering against Zardari went against the Constitution and the Quran.

The bench listed six options for the government, including action against the premier for contempt of court and declaring Gilani ineligible to be a member of parliament for five years – and referred the case to Chief Justice Iftikhar Gilani. The bench recommended that the Chief Justice form a larger bench to hear the matter on January 16.

The bench asked Attorney General Anwar-ul-Haq to ascertain the government's views before the next hearing. It also summoned the Attorney General, the Law Secretary and the chairman of the National Accountability Bureau to appear before the apex court at the next hearing.

Then what does he gain oout of this coup?Unless he does a Musharraf there is nothing in it for him.If Imran khan is president what is the stake for shuja and pasha as individuals in this coup

I think there will be rigging or politicians in Sharif's party (PML-N) will be forced to join Imran Khan's party by hook or crook. PML-Q will be a willing ally to make Imran Khan as PM.

Democracy was forced on pakistan by the US and was a farce, now that the relations have gone stale its back to ruling for the PA.

True ,pak never had a democracy. It's the army who rules pak at the back stage, backed by sam papa.
