‘Humiliating treatment’ may amount to sexual harassment: Govt

    New Delhi:Humiliating treatment which is likely to affect women government employees’ health or safety may amount to sexual harassment, the government said today.
    “The implied or explicit promise of preferential or detrimental treatment in employment, threat about present or future employment and humiliating treatment likely to affect her health or safety may amount to sexual harassment,” Jitendra Singh, Minister of State for Personnel, Public Grievances and Pensions said in a written reply to a question in Lok Sabha.
    Besides, interference with her work or creating an intimidating or offensive or hostile work environment for women employees may amount to sexual harassment, he said. The Ministry of Personnel, Public Grievances and Pensions has amended the services rules on November 19 to check sexual harassment of women at work place.
    As per the new definition under the Central Civil Services (Conduct) Rules, 1964 sexual harassment includes physical contact and advances, a demand or request for sexual favours, making sexually coloured remarks, showing pornography and any other unwelcome physical, verbal, non-verbal conduct of a sexual nature, the reply said.
    As per rules, work place includes any department, organisation, undertaking, establishment, enterprise, institution, office, branch or unit which is established, owned, controlled or wholly or substantially financed by funds provided directly or indirectly by the central government!

    Stupid minister with stupid law. Already 50% of women govt. employees don't work half as much their most male counterparts - add in child care leave. Now this rule will simply mean that an underperforming woman employee cannot even be rebuked or issued a memo for her lack of performance. Silly, stupid morons!!!!!!!

    In this case I agree with you. Laws have to be gender neutral and implementation must be strict, robust and thorough. This whole idea of dumping more and more legislation to enforce social change is never going to work. It will boomerang badly.

    An underperforming employee need not be fired on grounds of misconduct on grounds of sexual harrasment. Framing a false claim against an employee with the intention of firing her will result in more catastrophe.
    Most employees (Govt) cannot be fired becase of the organism called trade union.
    Child care is the reason why the human race survives. Its a right. A woman cant fake pregnancy to get child care leave.Does it? I dont think this doesnt mean that they dont work. In my opinion, the women employees are less corrupt than their male counterparts and get the work done.

    While you are correct on few counts (cannot fake pregnancy; survival of human race, Trade-unions & blah-blah), your last point:
    , is seriously funny & evokes laughter & bewilderment. Maybe, your viewpoint is limited to what you have personally experienced. Because, there is absolutely no substance or truth in your outrageous claim.

    Can you back it up with something credible, apart from conjectures ?

    Laws definitely need to be gender neutral but slightly more favorable towards women because of the circumstances.

    Personal experience ..Yes! Cuz i found them prompt in clerical works than their male counterparts.
    I will try to get some statistical reports on the work efficiency of Govt employees. :D
