1993 Mumbai blasts: SC commutes Sanjay Dutt's sentence to five years

New Delhi: Delivering its verdict in the 1993 Mumbai blasts case, the Supreme Court on Thursday commuted Bollywood actor Sanjay Dutt's jail sentence to five years.

Dutt had been given six-year jail term by the TADA court. As Dutt has already spent 18 months in jail, he will now have to spend another three and a half years in jail.

Dutt was convicted in November 2006 for illegal possession of a 9mm pistol and an AK-56 rifle but was acquitted of more serious charges of criminal conspiracy under the now defunct anti-terror TADA.

The SC also upheld the death sentence of Yakub Memon and said that that he was the biggest accused in the case.

Pronouncing the verdict the SC said, "We have no doubt about Memon's role in the blasts.”

The apex court also came down heavily on Pakistan. The SC bench said that Pakistan's complicity in the heinous crime could not be denied.

“The accused were trained in bomb making and to handle sophisticated weapons in Pakistan,” SC said adding, “Management and conspiracy of blasts were done by Dawood Ibrahim and others.”

It also said that Pakistan's intelligence agency ISI was also involved in the Mumbai blasts.

Meanwhile, the court reduced the death sentence of ten others to life term.

Yakub Memon is Tiger Memon's brother. Tiger along with Dawood Ibrahim is said to be the mastermind of the blasts. They fled India after the blasts.

The apex court had heard appeals and cross-appeals filed by and against 100 people who were convicted by the special TADA court in 2006 in the 1993 Mumbai blasts case.

After a marathon 10-month-long hearing beginning November 1, 2011, the Supreme Court had in August 2012 reserved its verdict on appeals and cross-appeals in the 1993 Mumbai serial terror bombing case in which 257 people were killed and 713 were injured.

During the hearing, the bench had for the first time used laptops in the court to peruse the voluminous documents and record of the case and the submissions of various counsel.

On March 12, 1993, Mumbai was rocked by a series of blasts which also damaged property worth over Rs 27 crore.

No he cannot,,, bail can be applied only for under trial accused not for the convicted,,,,, he can go for an appeal to a higher bench ,,, and then to the President to reduce or waive his sentence siting different reasons for that,,,,,,, otherwise he can stay in Air conditioned jail for years and can enjoy 1 year parole that he can easily buy !!!!!! hahahahahaaa

Some types of terrorists will take heart. We are from this particular religion and cannot be given stiff sentences. The process started when TADA charges were withdrawn.

^^^^ he may but the fact of the matter is that not only justice should be given but people should see that it is given, or else Italian marines type of thing will happen and people will end up loosing trust in our Judicial system and will take law in their own hands.

No better judgment could have been given to him, SC has kept all the facts in consideration i.e. Sanjay's fears of being attacked, his infringement of law , his non-involvement in terrorist acts or conspiracy. He has infringed a law and he deserves to be punished, what more can we say about it? Sanjay should surrender as soon as possible to let this headache go all in a once, the sooner he surrenders the better for him.

All things considered, he will have to pay for the huge mistake (or shall I say crime) that he made. It wasn't inadvertant.
Thanks to the Judiciary. Any lower punishment would have mocked the law of this land.
By the way is it legally possible that he gets out sooner, on basis of 'Good behavior' (cliche though :heh: )

He has not been convicted on terror charges but illegal possession of arms. You cannot have an assault rifle with you. Dutt had a history if bein brash. He was in drugs. Garam khoon as they say. He committed mistakes and will have to pay for it. He should thank the Indian justice system that its so slow that he didn't serve jail time at the peak of his life in 30s. I think he would have bought the gun for the thrill of it and it was easy for him to get one given bollywoods connections with the underwold.

I feel bad for the guy. Maybe a suspended sentence with fine should have been enough.

Then why don't you petition the SC to let him off? So many of people felt bad at hanging of Kasab. He got off lightly, being the son of a big Congi leader and a practising muslim.

He married and divorced and remarried according to shariat, did he not?

In Kishenganj, Bihar, while addressing an election rally he said: Who went to jail for you? I did.

    Audience was almost wholy muslim.

Of course he is a muslim, perpetual targets, it is claimed. He did get soft treatment.

Lets be real. An apple is an apple and not a device to mislead Adam and Eve.
