I am saying that not only DK, there are many others who are involved in the Adarsh Scam. What is the purpose of throwing dust at her when all the actual culprits are still roaming scott free ??
Why , that absolves of her heinous crime and responsibility> And where and when did I say others are holy cow?

Unless you have emotional affinity with Khobragade, you defense is untamable ..

And where did I say that it absolves her of any wrongdoing ?? Why do you derail this thread??

This thread is not whether she is guilty in Adarsh scam or whether she has dipped her finger in any other scam ?? If you want a discussion on that matter you can always open a new thread.

Well I am not quoting all your previous posts in this thread.

But, you are right in saying this thread is about US-India spat. In this if you are bringing in Aadarsh Scam to justify something or anything you are depending upon hindsight.

And it's immaterial to reiterate to a person your caliber that hindsight is a bitch and moreover what you are doing here is trying to find out who impregnated her. Whereas your step should be sterilization of all the dogs in the area.

Aadarsh scam is completely different from US-India spat involving DK and I didn't find ( sans two comment from her) her behavior, unbecoming of a IFS officer.

All other matter/s are related to the endemic corruptions in our country which is completely different from the specifics this thread.

Saumya Singapour..

That is a bad news... as CBI is meant to kill cases rather than secure convictions... their track record is abysmal ..

people such as Khobragade should be shot dead by the CBI under a fake encounter.. or she should be handed over a loaded pistol by the Foreign Secretary across a table to shoot herself in the name of protecting the honour of a service such as Foreign Service..

But it not only her being so corrupt.. she will go to SC Commission, SC politicians,, SC Service officers and allege discrimination... she will that not she but Ambedkar is being murdered..

What a sorry state..
hmm.. You should have worked in KGB.

CBI is likely to file charge sheet against diplomat Devyani Khobragade and her father Uttam Khobragade in the Adarsh Housing scam for allegedly acquiring a flat on the basis of false affidavit.

Sources said the agency has got evidence which show that the flat was allegedly purchased by her using false declaration and by hiding information about the flat alloted to her under government quota and the land possessed by them.

Her father Uttam Khobragade, a Maharashtra cadre IAS officer, is a former CEO of Maharashtra Housing and Area Development Authority (MHADA).

As part of its investigation, CBI is probing alleged illegal beneficiaries and benami property holders in the housing scam.

Controversial diplomat Devyani, India's then deputy consul general in New York, was arrested by the United States authorities in December last year over alleged visa fraud which triggered a diplomatic row between the two countries.

Uttam Khobragade, father of diplomat Devyani Khobragade, has refuted allegations that claimed he and his daughter submitted a false affidavit to procure a flat in the controversy-ridden Adarsh building in South Mumbai.

"Adarsh has become a tool to harass people and damage their administrative as well as political career. This started almost three years ago. Now, since discussions are going on about me joining a political party this week, suddenly news of prosecution regarding the affidavit has surfaced. There is nothing wrong in the affidavit," Mr Khobragade told NDTV.

Sources had told NDTV that the Central of Bureau of Investigation (CBI) is likely to file a case against Mr Khobragade and his daughter Devyani in the Adarsh Housing Society scam for allegedly acquiring a flat on the basis of a false affidavit

Manny Encarnacion's friends think India is getting its own back for the Khobragade Nannygate spat. "You guys like to strip-search our diplomats," an Indian security official reportedly told the NYPD cop at New Delhi's Indira Gandhi International Airport as he arrested him on March 10 for "inadvertently" traveling there with three bullets in his checked luggage.

Nearly four weeks later, NYPD is still trying to bring back its 49-year old officer, who was visiting India to meet his Iranian wife Vida because they found it easier to rendezvous there. It has written a letter to Indian officials explaining his "innocent mistake."

According to the NYPD version, Encarnacion was taking a required firearms recertification at a shooting range two days before he was to leave for India. At the end of the session, he tucked three spare rounds into his jacket pocket, and forgot about them. The bullets were still in the pocket when he packed his jacket in his suitcase to travel to India.

Ignoring the US viewpoint, India has refused to consider the Devyani Khobragade episode as "closed", saying there are "residual" issues which need to be addressed.

Foreign secretary Sujatha Singh said India has made its expectations clear to the US on the issue and hoped that it will be resolved.

"There are residual issues," she told PTI in an interview when asked whether the Khobragade episode was a closed chapter as was being treated by the US. However, she refused to elaborate further on what steps were needed from the US to satisfy India.

This issue will only be solved when India goes ahead and arrests an American diplomat and strip search or cavity search. There is enough evidence to arrest even the American Ambassdor. It was her that issued a circular for diplomats and diplomat's wives to lie about their income to circumvent the laws. If the Americans think that these are flimsy grounds, then grounds fabricated to arrest an Indian diplomat are much more flimsy. Just to create evidence they spirited out the Maid's family to US and granted them special residential visa. It is pure case to fabricate evidence only permitted under US laws. (Deal making).

When the above happens US would huff and puff, but then run to withdraw all cases against the Indian diplomat in New York.

Further strengthening of relation then can begin.

American Embassy School reeling under crisis - Hopes pinned on Modi | Business Standard

The American Embassy School (AES) in New Delhi's plush diplomatic enclave is deep in crisis after nearly 40 teachers quit as a fallout of last year's India-US diplomatic row.

The staff is hoping that with a new Indian government in place, matters would mend soon.

The school, one of the most elitist and expensive in the capital, is in the throes of a crisis after 40 teachers quit since March this year and more than a dozen were forced to return to the US to renew their visas, knowledgeable sources said.

"Over 40 teachers have left since March this year," a source told IANS, not wishing to be named being not authorised to speak on these sensitive issues.

"While we do have teachers leaving regularly as their stay in India ends, this is unprecedented. We've never faced such a situation before," said the source.

"We are all hoping that with the Modi government coming in, things will now get better and the crisis in the school will be over," the source added.

The Obama administration is sending Nisha Desai Biswal, its point person for South and Central Asia, to India next week to hold talks with the new government on bilateral and regional issues. The upcoming Biswal visit has also led to hopes that the AES crisis would soon be a thing of the past.

The teachers were forced to leave as a result of India tightening the screws on visa and tax laws in a tit-for-tat measure in a fallout of the India-US diplomatic spat over the arrest and strip-search in New York of diplomat Devyani Khobragade on charges of visa fraud and underpaying her nanny last year.

Before the diplomatic row, spouses of many American diplomatic officials - as well as Indian diplomats - would join the AES faculty as teachers.

They would not mention in their visa that they were working at the school, thereby avoiding paying tax.

The spouses of many US teachers hired by the AES would also end up as teachers without mentioning it in their visas.

This wink-and-nod agreement that had been going on for decades came apart in the wake of the Khobragade affair when India insisted on being given the full details of the US employees at the school and the taxes filed.

Besides the 40 teachers who have left, around 15 teachers were forced to return to the US to renew their visas.

"Earlier, the visas would get renewed here. But since March, 15 teachers have had to go back to the US to get their visas stamped," the source added.

The school, which has a sprawling 13-acre campus adjacent to the US Embassy, has 1,450 students mainly from the diplomatic community as well as the children of corporate leaders. It has a swimming pool, tennis courts and soccer pitches besides vast athletic fields.

The school fees were raised by 24 percent this year. The fees are steep - ranging from $24,200 a year for Grade 5 (Elementary School) to $27,300 for Grade 8 (Middle School) to $28,700 for Grade 12 (Senior School).

"Things are definitely not like they were before. It has been very traumatic for the school," another source added.

"The school has a wonderful engaging atmosphere. Now there is a feeling of underlying stress," the source added.

Its staff strength is 180 presently. The school hires Americans to teach.

"They are internationally hired teachers, which means they are foreign nationals (not Indian)," added a source.

There are two-three Indian teachers who have been around for many years and teach specialised subjects.

The top administration staff is American while the support staff is Indian.

While the US staff get paid handsomely, the Indian staff, including the clerks, the drivers and others are paid "what they would get in any other good Indian firm".

"The salaries that Indians get at the school is not high. But what makes a difference is the working atmosphere. It is really a good place to work in. The weekend offs and the month-long vacation the staff are entitled to are also attractive," another source added.

Besides the school, the American community club has also been badly affected.

The embassy was told in January to shut all commercial activities being undertaken from inside the premises.

Several commercial activities are undertaken under the aegis of the American Community Support Association (ACSA). These include a restaurant/bar, video club, bowling alley, swimming pool, sports facility and field, beauty parlour and gym.

"The club has been badly hit. All the American Embassy School teachers would use the club. Now they are not allowed to do so," said a source.

Non-American diplomats are also barred from using the premises and the supply of cheap liquor is now a thing of the past, say diplomatic sources.

@Manas7, and others

One would expect that the Modi government would follow Indian Law, as expressed by the Delhi High Court, In Vikramaditya Jain (Minor) vs Union Of India And Others (Delhi High Court, on 14 September, 1998; Equivalent citations: 1998 VIAD Delhi 386, AIR 1999 Delhi 232; Author: A D Singh; Bench: A D Singh):

ORDER

Anil Dev Singh, J.

1. This is a writ petition whereby the petitioner challenges the order of his expulsion dated June 2, 1998 from the American Embassy School. The facts lie in a narrow compass.
...
6. ... Thus, in other words, [neither] the third respondent nor the fifth respondent have been conferred any diplomatic immunity by the Government of India. According to section 9 of the Diplomatic Relations (Vienna Convention) Act, 1972, if in any proceedings any question arises whether or not any person is entitled to any privilege or immunity under this Act, a certificate issued by or under the authority of the Secretary to the Government of India in the Ministry of External Affairs stating any fact relating to that question is to be regarded as conclusive evidence of that fact. From the stand taken by the Government of India by means of the above said affidavit and keeping in view the terms of the mutual understanding dated June 28, 1973, I have no difficulty in holding that neither the American Embassy School nor the American Embassy School Association are enjoying any diplomatic immunity. Therefore, they are not immune from the jurisdiction of the Indian court system. ...
and, from the same para. 6 of that case report:

An affidavit has been filed by Shri B.K. Gupta, Director/Deputy Chief Protocol (F), Ministry of External Affairs, South Block, New Delhi. It is averred that the building and the land of the respondent school belongs to the American Embassy in New Delhi, and as per the terms and conditions of the memorandum of understanding arrived at between the Government of India and the Government of the United States dated June 28, 1973 the allotment made by the Government of India was solely for the purpose of operating educational facilities. It is further clarified that as per the memorandum of understanding the staff of the school and the premises of the school do not enjoy the immunities and the privileges as are normally available to the staff of the Embassy. But such of the staff of the school having American nationality are entitled to such exemption only from Income Tax as provided under section 10(6)(v) of the Income-tax Act, 1961. ...
One hopes that the Modi government will "take the high road" with respect to the American Embassy School (AES) and American Community Support Association (ACSA), and other non-diplomatic activities. By "take the high road", I mean following applicable law (here Indian Law) and ending the "wink and a nod" subterfuges that have been employed by both the GOI and the USG in the past. The same goes for the "Visa Application Trap" involved in Ms Khobragade's case, where again both the GOI and the USG "winked and nodded" at the "two contracts" subterfuge - despite that subterfuge violating both Indian and US laws.

Hopefully, the new MEA will employ her adroitness in domestic hardball politics, and her obvious experience and expertise as a Supreme Court advocate, to eliminate the "winks and nods" in these relatively minor areas. There will be enough major areas where India and the US, as global powers, will have to work on "winks and nods" bases - e.g., clandestine and covert mutual security operations.

Regards

Mike

Preet

This probably should go in the DK thread, but that thread is already interminably long.

After years of silence on the issue, India-born U.S. Attorney Preet Bharara has begun to open up about the cultural scorn he has faced over his high-profile prosecutions of South Asian defendants, particularly that of an Indian diplomat that led one commentator in India to call him an "Uncle Tom."

In a recent speech at Harvard Law School, he noted the criticisms and countered them with unusual candor. Citing one commentator in India who questioned if he took up the diplomat's case "to serve his white masters," Bharara quipped about who those white masters might be.

"Presumably, Eric Holder and Barack Obama," he said.

Bharara is more loyal to the King than the King himself.

It is a natural phenomenon one sees in some Indian origin people who want to show that they are 'different' and oh la la they have 'arrived'!

It is like what we call Bhenji turn mod.
